The second reading allows Council to adopt the ordinance which would the: become effective in thirty days. The City Clerk will have the ordinance published in th within fifteen days, if adopted. NS-263 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA SETTING LIMITS ON RENTAL INCREASES IN MOBILEHOME PARKS WHEREAS, the City Council adopted urgency Ordinal N.Sr 2 6 2 effective immediately and remaining in effec until the adoption and effective.date of this ordinance, NOW THEREFORE, the City Council of the City of Ca: California does ordain as follows: 1. No rental increase to an existing individual in any mobilehome park shall be allowed except in accordan the applicable consumer price index or applicable index in t recently expired lease, whichever is greater, as determi approved by the City Manager. 2. A mobilehome park owner or landlord may appl rental increase exceeding the applicable .consumer price provided first the owner or lessor applies to the City Mani . approval of such increase and provided further that such j shall be' based on either financial hardship or e 1 ~ I I 1 I I I ~ 19 20 21 22 23 24 25 26 27 demonstrating -that the landlord or owner has been depriv just and reasonable return on his investment, or that the been extraordinary expenses after the adoption of this 01 threatening insolvency. 3. This ordinance shall not apply to leases or 1 agreements in exce.ss of twelve (12) months duration. EFFECTIVE DATE: This ordinance shall be effective 1 days after its adoption, and shall remain effective unti completion of a mobilehome park fair market rent study and on it by the City Council is taken as to whether or not to permanent mobilehome rent control legislation, and the City shall certify to the adoption of this ordinance and cause it published at least once in the Carlsbad Sun within fiftee aEter its adoption.
