MTG. 11/9/93 AND CONSTRUCTION ACT, TITLE 11, CITY A CITY I DEPT. RECOMMENDED ACTION: I .TR&IRY GRANT FROM THE CALIFORNIA STATE LIB Adopt Resolution No. Cr3-JdQ accepting and appropriating a Library Services and Construction Act, Title 11, Grant in the amount of $36,231 from the California State and approving Amendment No. 1 to the Master Agreement for City of Carlsbad Libri design services work associated with the Americans with Disabilities Act improvemei the Cole Library. ITEM EXPLANATION: On June 22, 1993 the City Council approved the Carlsbad City Library's application Library Services and Construction Act, Title 11, Grant. On August 13, 1993, the Stat Librarian sent a letter to Mayor Pro Tem Stanton announcing the approval of the Lit application for the grant. The purpose of the application was to secure grant funds . partially support the remodeling of various parts of the Cole Library building to brin into compliance with the Americans with Disabilities Act. The following items will 1: remodeled, modified or replaced: public and staff restrooms; hand rails and stairway public mezzanine; hand rails on the stairway from the library to city hall; drinking fc signage throughout the library building. The proposed ADA remodeling includes itei recommended for modification in the 1990 Cole Library Feasibility Study executed b firms of Caldwell/Thomas Associates and McGraw/Baldwin Architects. Use of the g allow the City to complete the ADA remodel ahead of schedule. FISCAL IMPACT: The estimated total cost of the library's proposed ADA renovations is $86,264. The will supply $36,231 toward the total cost, and the City portion will provide $50,033 matching funds must be at least 57.5% of the total cost of the project. Funds in the amount of $275,000 are available in the 1993-94 Capital Improvement Budget for tl Library remodel. Remaining funds will be used to design the remodeling of other PO of the building as proposed in the 1990 Feasibility Study. EXHIBITS: 1. I TO THE MASTER AGREEMENT FOR CITY OF CARLSBAD LIBRARY DESIGN SERVICES FOR WORK ASSOCIATED WITH THE AMERICANS WITH DISABILITIES ACT IMPROVEMENTS FOR THE COLE LIBRARY. WHEREAS, the Carlsbad City Library has been selected to receixe_a Libra Services and Construction Act, Title 11, Grant from the California State Library i: the amount of $36,231; and WHEREAS, the purpose of the grant is to remodel portions of the Cole Library to-comply with provisions of the Americans With Disabilities Act; and -- WHEREAS, the architectural firms of Cardwell/Thomas and Associates ar McGraw/Baldwh are party to an Agreement with the City for Library Design Services; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. That the above recitations are true and correct. That the Library Services and Construction Act, Title 11, Grant in t amount of $36,231 is hereby accepted and appropriated. 3. MU // // // // // // // // // // // // W e AMENDMENT NO. 1 TO AGREEMENT FOR LIBRARY DESIGN SERVICES FOR GEORGINA COLE LIBRARY ADA ACCESS IMPROVEMENTS THIS AMENDMENT NO. 1, made and entered into as of the 16th day of NOVEMBER , 1993, by and between the CITY OF CARLSBAD, a municipal corporatior hereinafter referred to as "CITY," and CARDWELUMcGRAW ARCHITECTS, hereinaftei referred to as "CONSULTANT." RECITALS WHEREAS, the City Council of the City of Carlsbad, California, adopted Resolutio No. 90-1 02 on April 10, 1990, approving an architectural consultant agreement for librar design services with CONSULTANT; and WHEREAS, said agreement included provisions for CONSULTANT to provide supplemental design services for CITY'S library facilities at the request of CITY; and WHEREAS, the parties to this aforementioned agreement desire to expand the scope of services to include the design of improvements to CITY'S Cole Library facilit for ADA access and related work; and WHEREAS, a supplemental scope of work and fee schedule have been preparec and agreed to between the parties hereto; and WHEREAS, the City Council of the City of Carlsbad, California, hereby finds it necessary, desirable, and in the public interest to proceed with this Amendment No. 1 fc said additional work. w 0 NOW, THEREFORE, in consideration of these recitals and the mutual covenant! contained herein, CITY and CONSULTANT hereby agree as follows: 1. CONSULTANT shall provide CITY additional design services to include thc design of improvements to CITY’S Cole Library facility in accordance with ADA requirements under the Librarv Services and Construction Act, Title II, and CITY’S LSCl grant agreement for handicapped access remodeling and improvements. CONSULTAN’ shall provide all plans, specifications, construction documents, cost estimates, and customary reimburseables for CITY to bid these improvements. For the purposes of thii Amendment, the scope of the improvements shall include: building entrances and exits restrooms, drinking fountains, signage, and interior and exterior handrails. 2. CITY shall pay CONSULTANT for all work associated with Paragraph 1 above the lump sum of $9,100.00 payable to CONSULTANT upon receipt of the final construction documents ready for CITY to bid the aforementioned improvements. 3. All provisions of the aforementioned agreement entered into on April 10, 1990, by and between CITY and CONSULTANT shall remain in full force and effect. Ill Ill Ill 111 Ill ill Ill W 0 4.
