GM CITY REGVMMENDEE AGTIVNi That the City Council ADOPT Resolution No. $3 - 399 , recommending APPROVA amendment to the Zone 11 and 12 Local Facilities Management Plans based on the contained therein. ITEM EXPLANATION Zones 11 and 12 are known as La Costa Southeast and La Costa Southwest. Attac Location Map (Exhibit 2) showing the locations of both Zones. The Zones 11 and 12 Local Facilities Management Plans (LFMP) were originally ad February 23, 1988, and August 21, 1990, respectively. On May 19, 1992, the City approved the Financing Plans for Zones 11 and 12 which called for the formatic Assessment District to finance the construction of Rancho Santa Fe Road, Olivenhain R other related minor infrastructure improvements. Changing economic conditions have option of Assessment District formation less appropriate for these particular facili response, the City in cooperation with the property owners in Zones 11 and 12 is now a Community Facilities District (CFD) in place of an Assessment District for the facilities. The proposed amendment would simply allow for this alternate financing me or any other mechanism that is acceptable to the City Council. No other changes to 1 Facilities Management Plans are proposed at this time. For the Council's information, the following is a summary of the updated status of ea eleven facilities for Local Facilities Management Plan Zones 11 and 12. City Administrative Facilities, Library, and Parks. Community Facilities District (CF was formed in 1991 to finance a number of facilities of Citywide benefit. All properties 11 and 12 are already participating in CFD No. 1. A combination of CFD No. 1 and pa Public Facilities Fee (PFF) constitutes the required financial guarantee for City Admi and compliance with special conditions contained in the LFMPs. Wastewater Treatment Capacity. The Phase IV expansion of the Encina Water Pollutioi Facility has been completed. Therefore, the special conditions stated in the approved are now satisfied. Drainage. All development within Zones 11 and 12 will be required to construct facilities or pay any drainage area fee established by the Revised Drainage Master indentified in the hydrology study. Circulation. With the circulation improvements required by the LFMP, particularly th financed by the proposed CFD, Zones 11 and 12 will meet the standards of the Management Ordinance. Facilities and Library. Park facilities are guaranteed by a combination of park-in-lieu Fe 0 a Page Two of Apenda Bill No. 12, 5 L5' Open Space. Open space within Zones 11 and 12 will be provided in compliance with adopted standards. Schools. Zones 11 and 12 will pay required school fees in effect at the time of develor addition, a new high school and an elementary school are currently under constructil Zone 11. FA. established standard. Water and Sewer. All facilities will be provided pursuant to the 1990 Water Master 1 potable water and reclaimed water facilities required to serve Zones 11 and 12 will be cc or appropriate fees paid at the time of development. Sewer facilities will be provide( established standards as stated in the LFMPs. The Planning Commission reviewed and approved the proposed amendment at its ni October 20, 1993. ENVIRONMENTAL REVIEW The proposed LFMP amendment is covered by a previously certified Negative Declarati by the Planning Director on December 11, 1987 for Zone 11 and EIR 86-02 for Zone FISCAL IMPACT There will be no fiscal impact as a result of this action. Don Rideout, Senior Management Analyst, reviewed the background of the request and stated that 1 financing plans for Zones 11 and 12 were originally approved by the City on May 19, 1992. The prir facilities being addressed in that financing plan are Rancho Santa Fe Road and Olivenhain Road. ( course there are other facilities, but those are the two facilities that the City is most concerned aboul There were efforts to form an assessment district to finance the two roads but after a considerable a of work it was determined that a financing district was not the most appropriate mechanism for finar these roads. The property owners are now pursuing a Mello-Roos Community Facilities District (CF This will be called CFD #2 because CFD #1 was formed in 1991 to finance a number of facilities whi benefit the entire City. Many steps still remain to form CFD #2 but the financing plan needs to be an to reflect the appropriateness of a CFD or other similar mechanism. Staff is recommending that whc the financing plan states "assessment district," it would be modified to state "assessment district, community facilities district, or other financing program acceptable to the City Council". That is the I change staff is recommending. Commissioner Erwin inquired if any communications had been received from the Encinitas School [ Mr. Rideout replied that staff did receive a phone call inquiring what this was all about. We explaine them and they had no further concerns. Of course, they or any member of the public can bring conc forward at any time. Commissioner Betz inquired about the Mello-Roos concept. Mr. Rideout replied that this change wi the use of Mello-Roos in addition to an assessment district or other mechanism which might be appropriate to finance the two major roads in Zones 11 and 12. Commissioner Hall inquired about the cost of Rancho Santa Fe Road. Mr. Rideout replied that it wil probably be in the neighborhood of $40 million. Commissioner Hall inquired what the zone's share of that cost would be. Mr. Rideout replied that thi developers in these two zones would be financing the entire project except for a contribution of $6 rn from the City's CFD #1, or approximately $34 million. Commissioner Hall inquired how many homes are projected in the two zones. Mr. Rideout replied tt there will be approximately 2,500 dwelling units. Commissioner Hall stated that it looks as though this will cost around $1 7,000 per unit. Mr. Rideout that his calculation sounded about right. Chairman Noble opened the public testimony and issued the invitation to speak. There being no persons desiring to address the Commission on this topic, Chairman Noble declared public testimony closed and opened the item for discussion among the Commission members.
