RECOMMENDED ACTION:
Adopt Resolution No. 94-/d , authorizing the destruction of certain fil in the City Clerk‘s Office.
ITEM EXPLANATION
This Agenda Bill is part of a continuing Records Management Program for 1
bids City, Adoption of the attached Resolution will allow for destruction
Section 34090 of’ the Government Code provides authority for destruction documents that are more than two years old and are no longer required. - section a1 so requires City Attorney consent and City Council authorizat. prior to destruction of any document.
The documents 1 i sted on Exhibit “A” have been reviewed in accordance with 1 provisions of the Government Code. They meet the requirement, and the C. Attorney has consented to their destruction.

RE: REQUIRED WORDING FOR NOTARIAL ACKNOWLEDGMENTS
Just a few days ago Kathleen returned some documents to Ben Ellorin which been rejected by the County Recorder. The documents were rejected beca incorrect notarial acknowledgments had been used. Although use of the I' Purpose" acknowledgment became mandatory 1 ast year, a "grace period" was gi during which notaries could use the old forms and still have documents record€
Effective January 1, 1994 documents which contain the old, incorr acknowledsment are beinq rejected by the County Recorder!
I have attached a copy of the rejection notice we received from the Recorde Office for your information. Also attached is a copy of the mandatory 'I Purpose'' acknowledgment wording. The wording hi -1 i ted in ye1 1 ow is mandata all other is optional.
Please make sure that any notarial wording which you have included on forms correct. A1 so, I need to ask your he1 p in making sure that everyone, who acce completed documents which will be sent to us for recording, is aware of change and does not accept documents which we cannot record! Process
incorrect documents just makes more work for us all.

RE: INITIATIVES AND UPCOMING ELECTIONS
There have been a lot of comments and questions lately concerning initiatives, advisory
measures and upcoming elections. In an attempt to insure that everyone is getting the
same information, I have prepared the attached calendar for processing an initiative for the
November, 1994 General Municipal Election.
Please keep in mind that the calendar was developed using maximum times allowed by the
Election’s Code for the different activities.
With respect to the June, 1994 election, there are not enough days to calculate maximums
for each activity. I can tell you, however, that the deadline for Council to place a measure
on the ballot is March 11, 1994. That means the Resolutions would need to be adopted
and to the Registrar of Voter‘s .Office no later than 5:OO p.m. on Friday, March 11, 1994.
I hope this information helps, and if you have any questions on this information, please let
me know and I’ll do my best to clarify the information and/or explain my calculations.

In response to your September 16th memo, I have no problem with providing Council R
2 sets of documents rather than providing individual copies. I do think there would hi
to be some type of guidelines for staff to know which ones are to be processed in t:
manner. Two possibilities immediately come to mind:
1. Whenever an agenda bill lists an item as on file in the City Clerk’s Office, that it
could be copied and provided to the Council Office library.
Timing would be the main concern. We currently pull large items from agenda E
and note them as being on file in the City Clerk’s Office. If the procedure inch
these items, we would make two copies of the document and provide them
Bonnie for addition to their library. It should be noted, however, that these ty
of exhibits would not be available in the Council Office until the Thursday or Fric
prior to the Council meeting.
The other side of that issue, however, is that we would then be making copies
documents we don’t currently copy, which could result in an increase in our cc
costs.
2. Limit the procedure to items which are processed through Planning Commiss
where the information is distributed in 3-ring binders (and the agenda bill 1
those items as having been distributed to Council previously). They generally cc
from Planning, and they are all ready documents that are generally provided
Council well in advance of the Council hearing date.

It has been suggested by a couple of Council Members that the City Council create a librar
of items that will be considered at their weekly meeting in lieu of each Council Member
receiving a copy of everything that is on the agenda. Specifically, it was suggested that having all Council Members receive the Zone 20 Local Facilities Management Plan, Specific
Pian and EiR is unnecessary. What is being suggested is that the City Council could receil
two copies in advance in order that they might take turns reviewing the material. The resul
would be a reduction in the overall cost to prepare the various documents associated with
the development process.
I would appreciate your review and suggestions on how this might be accomplished. If thc
is some statute that requires each Council Member to have a copy, the sooner we know th
the sooner we can close this question. If you have any questions contact me, otherwise
respond by September 21, 1993.

In our continuing journies through the Municipal Code, we discovered a discrepancy wk

Section 18.40.080(a) is in direct conflict with Section 18.40.080(b).
Section 18.40.080(a) refers to an appeal in accordance with Section 1.20.600. Sect
1.20.600 says appeals are to be filed with the City Clerk within 10 days and says
appeal fee is set by Resolution (which is now $120).
Section 18.40.080(b), however, says that the appeal and a $25 appeal fee is to be f
with the the City Clerk within 5 days.
