I CITY A' MTG. 3'22%-?+ DEPT.- TWIN 'D' SITE IMPROVEMENTS CITY M RECOMMENDED ACTION: Adopt Resolution No. 9Y - 8Li to establish fee for agricultural land conversion mitigation for - Reservoir Site Improvements, Assessor Parcel No. 21 5-08-23, (2.74 acres), CMWD Project No. Contract No. 3376. ITEM EXPLANATION: The Twin "D' Reservoir Site Improvements are located within the 'Designated Coastal Agricultural L, Mello II Local Coastal Program (LCP). Any development of the 2.74 acre site requires the presen prime agricultural land elsewhere within the statewide coastal zone or the payment of an agricultL conversion mitigation fee. The amount of fee set by the Carlsbad City Council ranges between $5,1 $1 0,000 per acre and is based upon the per acre cost of preserving prime agricultural land elsewhe state. The conversion mitigation fee is deposited in the State Coastal Conservancy Fund, thro administration of our coastal development permit, and is used to preserve or enhance other importani resources. Since the site will be developed by constructing a new 8.5 million gallon potable water storage facility the existing adjacent potable water storage reservoirs to be converted to reclaimed water uses, both are necessary and complimentary to adjacent agricultural uses, staff recommends that the mitigatio set at the minimum of $5,000 per acre for a total fee of $13,700. ENVIRONMENTAL REVIEW: EIA 91-15, a conditional negative declaration, was processed through the City of Carlsbad I Department and approved in 1992. Proposed Twin 'Dn Reservoir Improvements were reviewec conditional permit was issued by the Coastal Commission in September 1993. In both instances, a c was placed on the project requiring the payment of agricultural land conversion mitigation fees. FISCAL IMPACT: Approximately $4,380,000 is available in the 1993/1994 Capital Improvement Projects Budget for the Reservoir Improvements, therefore, funds are available for the expenditure of $13,700 for the pa) agricultural land conversion mitigation fees. Considering that said Assessor Parcel No. 215080-23 will be develol potable water storage facilities and existing adjacent potable water reservoirs are being conv reclaimed water storage, both of which are necessary and complimentary to adjacent agricuku the mitigation fee should be in the lesser amount of $5,000 per acre for a total fee of $13,700; WHEREAS, approximately $4,380;000 is available for development of the Reservoir Improvements, therefore, funds are available for the expenditure of $13,700 for the pa agricuttural land conversion mitigation fees; I NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of ( 20 21 22 23 24 25 26 27 28 I California, as follows: 1.
