Adopt Resolution No. 7'3" Pf ? approving plans and specifications, authorizing the
Clerk to advertise for bids for the construction of the Jefferson Street Bike Lanes,
authorizing the Mayor to sign the program supplement no. 17 to the Local Agency-!
Master Agreement for Federal Aid Projects from the State of California Departme
Transportation.
I ITEM EXPLANATION:
The project creates two four-foot wide bicycle lanes along a section of Jefferson S
between Interstate 5 and Marron Road in the City of Carlsbad. To accommodate the
eight-foot width of the bike lane, portions of Jefferson Street will be widened wherc
existing road shoulder is not wide enough. A minimum amount of fill will be placed tc
north side of Jefferson Street. A crib wall will be placed along a 250-fOOt stretch c
bike lane where there is a near vertical drop to the lagoon.
Caltrans, as program manager for Federal funds, requires the City to have an appr
bidding package prior to issuing its approval to release the funds. The City's F
specifications, and cost estimates have been completed in accordance with Cal
criteria.
The City has requested Federal funds through the lntermodal Surface Transport
Efficiency Act (ISTEA). Caltrans issued program supplement number 17 to the ~
Agency - State Master Agreement Number 11 -5308 for Federal Aid Projects to help
this work. The master agreement sets terms for the use of Federal money for infrastru
construction.

The Planning Director has reviewed this project and has issued a mitigated Ne$
Declaration and a finding of General Plan Consistency has been made by the Plal Commission,
The proposed project will impact 0.1 0 acres of wetland habitat. The California Cc
Commission, the United States Fish and Wildlife Service, and the California Departmc
Fish and Game require mitigation of the disturbed area at a ratio of 4:l. The PI
provides 0.4 acres of revegetation by the elimination of exotic plants nearby and mitic
plantings of native wetlands species. Permits were required and have been receivc

Currently, the City has State Grant funds on deposits in Account No. 380-820-81 05.
in the amount of $69,281. Federal funding from the lntermodal Surface Transpor
Efficiency Act (ISTEA) will provide $1 62,717. The sum of the funds are in excess t

SPECIAL COVENANTS OR REMARKS
1. All mai-ntenance, involving the physical condition and the operation of the improvements, referred to in Article VI
MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as reqL
for efficient operation of the completed improvements.
2. The Local Agency will advertise, award, and administer this
project and will obtain the State's concurrence prior to eitl
award or rejection of the contract.
3. The Local Agency agrees the payment of Federal funds will be
limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2) /D Estimate, or its modification (PR-2A) or the FN"76, and acc any increases in Local Agency Funds as shown on the Finance
Bid Letter or its modification as prepared by the Division o
Local Streets and Roads.
4. This agreement supplements State/County Master Agreements No
11-5308 and pertains to the Federal Transportation Enhanceme
Activities (TEA) funding with the understanding that all
provisions of the 1991 Intermodal Surface Transportation
Efficiency .Act (ISTEA) apply.
5. In accordance with the California Transportation Commission
Resolution No. FP-93-37 passed on March 31, 1994 the maximurr
Federal TEA funds available for this project are $162,700 ur
provided otherwise by the CTC.
6. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances"
contained in the aforementioned Master Agreement for Federal. -Aid Program.

CARLSBAD, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS, AUTHORIZING THE CITY CLERK TO
ADVERTISE FOR BIDS FOR THE CONSTRUCTION OF THE
JEFFERSON STREET BIKE LANES, PROJECT NO. 3156, AND
AUTHORIZING THE MAYOR TO SIGN THE PROGRAM
AGREEMENT FOR FEDERAL AID PROJECTS.
SUPPLEMENT NO. 17 TO THE LOCAL AGENCY-STATE MASTER
1 WHEREAS, the City Council of the City of Carlsbad has determined it nec

desirable, and in the public interest to construct the Jefferson Street Bike Lanes; and
WHEREAS, plans, specifications, and contract documents for the furnishing of a

materials, tools, equipment, transportation, and other expenses necessary or incidental
project have been prepared and are on file in the Engineering Department of the
Carlsbad; and
WHEREAS, the City Council of the City of Carlsbad has previously appropriate
Grant funds with a remaining amount of $69,000 for said project; and 15

WHEREAS, the City has made application for Federal Intermodal Surface Transp
Efficiency Act (ISTEA) funding through Caltrans in the amount of $1 62,717.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of CE
California, as follows:
1. That the above recitations are true and correct.
2. That the plans, specifications, and contract documents as presented are
approved.
3. The Mayor is authorized to sign the program supplement number 17 to th
Agency-State Master Agreement Number 1 1-5308 for Federal Aid Projects with Caltrans
4. The City Clerk of the City of Carlsbad is hereby authorized and dire
proceed to publish, in accordance with law, Notice to Contractors inviting bids
construction of the Jefferson Street Bike Lanes, Project No. 3156, in accordance with thl
specifications, and contract documents hereinabove referred and to return a signed ai
program supplement no. 17 to the Local Agency-State Master Ag ~eement Number 1 1 -f
Federal Aid Projects to Caltrans.
