2. Accept improvements, authorize the City Clerk to record the Notice of Completion, and
retention funds and bonds in accordance with State laws and City ordinances for the 1992-!
Gutter, and Sidewalk Replacement Program, Contract No. U/M 93-7.
ITEM EXPLANATION:
On September 28, 1993, the City Council adopted Resolution No. 93-272 thereby 2
Contract No. U/M 93-7 for the 1992-93 Curb, Gutter, and Sidewalk Replacement Progra
Enterprise Corporation in the amount of $85,030.91. A "Notice to Proceed" was issued for I
15, 1994, and construction was subsequently completed on April 4, 1994.
The areas slated for replacement were appraised more than a year before construction be
during this time additional root damage occurred. Due to heavy rains and contractor de
damage was extensive. Many areas were added in order to ensure a quality prod1
completion. Many factors influenced the decision to add these areas to the contract inch
low unit price, the outstanding quality the contractor was providing, the availability of fun1
the current budget appropriated for cement repairs, and public safety. Staff took a p
approach and decided it was more prudent to make all necessary repairs now rather tha
return to the same neighborhoods in a year or two. Areas added during the course of thiz
due to additional damage resulted in an increased amount of $5,393.87.
In addition, the amount of work to be done was under estimated, which increased the tota
amount by $4,860.22.
All aspects of this project have now been completed and the improvements are acceptab

FISCAL IMPACT:
The combined cost for additional work, $5,393.87, and the underestimated calculations, $
equals $10,254.09 for a new total contract amount of $95,285.00. Purchase Order N
adequately covers the orginal costs of this project but will require the additional $10,254.0!
the cost of Change Order No. 1. Sufficient funds are available in the Gas Tax Fund cemE
account to cover these additional costs.
