RECOMMENDED ACTION:
EMPLOYEES REPRESENTED BY THE CARLSW CITY EMPLOYEES' ASSOCIATION
City Council adopt Resolution No. 9 4- 17,!?approving a cash compensation payment for employees represented by the Carlsbad City Employees' Association.
ITEM EXPLANATION:
The Memorandum of Understanding (MOU) with the Carlsbad City Employees' Association specifies that the parties:
"will met and confer on the subject of a salary adjustment beginnin! December 1993. Upon mutual agreement, the parties may reopen discussions at either an earlier or a later date. The effective date of the adjustment will be a subject of meeting and conferring."
In December 1993, both parties agreed to postpone reopening discussions on the subject of a salary adjustment until May of 1994.
The last salary adjustment for employees represented by the Carlsbad City Employees, Association was effective December 23, 199 1. Because of current economic conditions both at the city and state level, it has been mutually agreed that no adjustment to the salary schedule or individual salaries will be made at this time. However, the parties have agreed that each hll time employee represented by the Carlsbad City Employees' Association will receive a cash compensation payment in the amount of onc thousand two hundred dollars ($1,200), to be paid by separate check on 01 before July 1, 1994. Such cash compensation payment will be treated as a
part of salary and, as such, will be subject to all withholdings as required b: law.
FISCAL IMPACE
The cost associated with this action is $366,600 for 235 employees. This cost is to be supported by a transfer from the General Fund balance.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A CASH COMPENSATION PAYMENT FOR EMPLOYEES REPRESENTED BY THE CARLSBAD CITY EMPLOYEES ASSOCIATION.

WHEREAS, the City Council did on February 2, 1993, by
Resolution No. 93-29 approve the Memorandum of Understanding
(MOU) between Management and representatives of the Carlsbad Cit
Employees’ Association (CCEAJ, which called for the parties to meet
and confer on the subject of a salary adjustment: and
WHEREAS, because of current economic conditions both at th
city and state level, it has been mutually agreed that no adjustment t
the salary schedule or individual salaries will be made at this time: a
WHEREAS, the City Council has determined that it is
appropriate to grant each employee represented by the Carlsbad Cit
Employees’ Association a cash compensation payment in the amounl
one thousand two hundred dollars ($1,200) on or before
July 1, 1994; and
WHEREAS, the City has met and conferred with the Carlsbad
City Employees, Association regarding this change as noted in
Attachment A, attached hereto and made a part thereof: and
WHEREAS, the cost of this cash compensation payment will k
funded from the General Fund balance.

NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Carlsbad. California, as follows:

That the above recitations are true and correct.
That the recommendation that the City grant a cash
compensation payment for performing normally required duties
performed on regular work shifts as defined in Government Code
Section 20022(a)(8), in the amount of one thousand two hundred
dollars ($1,200) paid to all employees represented by the Carlsbad
City Employees' Association who are employed on June 28, 1994, is
hereby approved. Such cash compensation payment will be treated as
a part of salary and, as such, will be subject to all withholdings as
required by law.
PASSED, APPROVED, AND ADOFED at a regular meeting of the
Carlsbad City Council held on the 28th day of JUNE , 1994, by
the following vote, to wit:

AGREEMENT WITH THE CARLSBAD CITY EMPLOYEES’ ASSOCIATION
Article 14 of the current Memorandum of Understanding (MOU) states th:

It has been mutually agreed that no adjustment to the salary schedule 01
individual salaries will be made at this time. However, the parties have
agreed that each full time employee represented by the Carlsbad City
Employees’ Association will receive a one time cash compensation
payment in the amount of one thousand two hundred dollars ($1200)’ to t
paid by separate check on or before July 1, 1994. Such cash compensatic
payment will be treated as a part of salary and, as such, will be subject
all withholdings as required by law. Furthermore, the parties agree th:
this cash payment does not in any way limit the scope of options that m
be negotiated between the parties in future negotiations.
Except as expressly stated here, the terms and conditions of employmer
contained in the Memorandum of Understanding dated January 1, 1993
shall continue in effect until the expiration of the MOU on December 31,
1994.
