Adopt Resolution No. 94-2/9 accepting bids and awarding a contract to J.C. Baldwir
Construction Co. for the repair of Buena Vista Creek Concrete Channel east of El Caminc
ITEM EXPLANATION:
On April 26, 1994, City Council authorized the advertisement for bids for the repair c Buena Vista Creek concrete channel east of El Camino Real. Four (4) sealed bids wer
received on June 30, 1994, as follows:
J.C. Baldwin Construction Co. $1 03,853.00
2. Hunter’s Construction Company $1 08,031 .OO
Marquez Constructors, Inc. $1 i4,Q52.02
4. Roberts Earthmoving $1 21,536.00
This project will execute the measures designed to repair the undermining and uplift of tt concrete channel extending from El Camino Real easterly 300 feet.
The Engineer’s Estimate for this project was $112,680, Staff has verified referencc
submitted by the low bidder and recommends the award of this contract to J.C. Baldw
Construction Co.
ENVIRONMENTAL REVIEW:
The Planning Director issued a Notice of Exemption for this project on September 10,19S
California Coastal Commission
The repair activity is outside the coastal zone.
California Department of Fish and Game
The City and the Department of Fish and Game reached agreement on March 16, 19
regarding the repairs. The agreement conditions have been incorporated into the proje E!

4 The Corps of Engineers has determined that the repair work complies with the terms a
conditions of a nationwide permit. The repair work complies or will comply with
nationwide permit and special conditions.
Reaional Water Qualitv Control Board
A waiver of water quality certification has been automatically granted for the project
Regional Board staff.

GENERAL PLAN CONSISTENCY:
The Planning Commission Determination for General Plan Consistency was approved or
September 18, 1991 as part of the Capital Improvement Program.
FISCAL IMPACT:
City Council has previously appropriated $50,000 in the 1991 -92 Capital lmprovemen
Program and $1 50,000 in the 1992-93 Capital Improvement Program, both from Genera
Capital Construction funds, for the design and construction of the repairs to the concrete
channel.
Estimated project costs are as follows:
Estimated Construction Cost $1 03,853.00
Construction Contingencies (1 5%) $ 15,578.00
Inspection/Administration (1 0%) $ 10,385.00
TOTAL PROJECT COST ESTIMATED $1 29,816.00
The current account balance available to perform this work is $1 45,752.00.

A RESOLUTION OF THE CIW COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT FOR THE REPAIR OF BUENA VISTA CREEK
CONCRETE CHANNEL EAST OF EL CAMINO REAL,
PROJECT NO. 3385.
WHEREAS, the City Council of the City of Carlsbad has previously authorized thc
advertisement for bids for the repair of Buena Vista Creek concrete channel east of El Caminc
Real, Project No. 3385; and
WHEREAS, four (4) sealed bids have been received on June 30, 1994 by the City o
Carlsbad for the execution of the repairs; and
WHEREAS, all bid documents received from all bidders have been reviewed in deta
and the City Council does hereby find that the lowest responsive, responsible bid received wa
submitted by J.C. Baldwin Construction Co., in the amount of $103,853.00; and
WHEREAS, funds are available in the amount of $145,752.00 from previous1
appropriated funds for said project; and
WHEREAS, the City Council has the authority to authorize the City Manager to appro\
change orders within a certain percentage of the total construction contract amount; and
WHEREAS, the City Council of the City of Carlsbad has determined it necessar
desirable, and in the public interest to execute the repairs;
NOW, THEREFORE, be it resolved by the City Council of the City of Carlsbad, Califorr
as follows:

That the above recitations are true and correct.
That the bid of $103,853.00 as determined by extension of the unit pric
submitted by J.C. Baldwin Construction Co. for Project No. 3385, for the repairs of Buena Vi$
Creek cancrete channel east of El Camina Real is hereby accepted, and the Mayor is here
authorized to execute a contract thereafter.

4. That the City Manager is hereby authorized to approve individual construction
change orders in conformance with Municipal Code Section 3.28.172 b(3) in a cumulative
amount not to exceed $1 5,578.00.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Counc
heldonthe 2nd day of AUGUST , 1994 by the following vote, to wit:
