Clm OF CARLSBAD - AGEgA SEAPOINTE RESORT - AMENDMENT OF THE GENERAL PLAN AND THE MELLO II SEGMENT OF THE LOCAL Both the Planning Commission and staff are recommending that the City Council direct thc Attorney to prepare documents APPROVING the Negative Declaration, GPA 93-04, ZC ' and LCPA 93-04. ITEM EXPLANATION On May 18, 1994, the Planning Commission conducted a public hearing and recommc approval (7-0) of the General Plan Amendment, Zone Change and Local Coastal Prc Amendment. These amendments propose change in the allowed land use of a 2.35 acre s< of an 8.02 acre parcel from office to tourist serving commercial. It is the applicant's intent to follow approval of the land use change with a request for apprc a 78 unit timeshare resort. Concerns have been raised by La Costa Downs lot owners to the south regarding the pl development of the site which the Planning Commission indicated should be considered ( project review. Support of the land use change has been submitted in the form of a form signed by several Village merchants and a separate letter from the Carlsbad Convention and V Bureau. Please see the attached staff report to the Planning Commission for additional details regardir proposed amendments. ENVIRONMENTAL REVIEW Since the proposed action is legislative and involves no site specific development, no ac environmental impacts are anticipated. However, assessment of the site indicates that ther not be any adverse impacts associated with the anticipated development of the site. Therefor Planning Director issued a Negative Declaration on March 22, 1994, in accordance wit California Environmental Quality Act. FISCAL IMPACT Typically uses allowed within an office zone provide revenue to the City in the form of prc tax and business license tax. Uses typical of a tourist serving commercial zone, generate prc tax, business license, transient occupancy tax and possibly some sales tax. Thus, there potential for greater tax revenue by the tourist commercial land use. The cost of services for an office or commercial tourist land use are assumed to be equivalent. Approval of the lar change will not create additional fiscal burden to the City. Although the site is near the Pacific Ocean, it is not contiguous and development of the proper directly effect beach sand or modify a channel of free flowing waters. The project is a commercial residential timeshare and the typical operation of such uses does nc change to air flow, movement, or temperature and does not consume great quantities of natural fuel or energy. The project will be required to obtain gas and/or electric service from San Dieg Electric and will be charged the appropriate service fees. Biological Environment The site is currently in a disturbed state as a result of previous grading and agriculture. There are sensitive species of plants or animals within the area of development on the site. There is also nl that there will be adverse impacts to the biological environment offsite as a result of this develo] Human Environment The project proposal to develop a timeshare includes a General Plan Amendment, Zone Change, Coastal Program Amendment. The requested change is from Office (0) to Travel Services Comme change it is anticipated that activity on the site will change from daytime, 8:OO a.m. to 5:OO p.m., tc Future traffic patterns may change from heavy peaks in the morning and evening hours for an of a more even flow throughout the day and mid-day on Saturdays when guests are checking in anc timeshare. Parking for the proposed use will be provided in an onsite garage and existing and future street imp will adequately serve circulation needs. All of the utility services required by this development will be provided by standard meth( development would introduce new levels of noise and light into the area. II. PROJECX DESCRIPTION AND BACKGROUND The site is located to the east of Carlsbad Boulevard at the intersection of (Ponto) Anaca Drive. Total acreage is 8.02 but the proposed General Plan Amendment, Zone Change a Local Coastal Program Amendment as well as the subsequent and related developme applications (tract map, hillside development permit, condominium permit and conditior use permit) are submitted for only a 2.35 acre segment of the site. The segment und consideration for development is vacant, has been previously used for agriculture and h a General Plan and a Zoning designation of Office (0). The remaining portion of the si has a General Plan and Zoning designation of Open Space (OS) and will remain as 0 The Mello I1 segment land use designations of the Coastal Program are consistent with t Carlsbad General Plan and Zoning. The project site was analyzed within a larger study, Seapointe Carlsbad, in 1986 determine appropriate land uses for an approximate 340 acre area. The stuc recommended that the property, P3a (project site), be designated as Residential Mediu High (RMH) with an alternative of Office (0). The rationale for RMH was that residential designation would create a solid block of housing from Poinsettia Lane to ju south of Palomar Airport Road. Also, because there are exceptional view opportunities, General Plan Amendment, extensive work has been done on the Encina Wastews Treatment Facility to inhibit the release of odors into the surrounding area. The study included a short discussion of the site as a visitor or recreation oriented locati The study stated that because the site is located away from the Palomar Airport Road i Poinsettia Lane freeway intersections, it is less competitive as visitor or recreation semi However, the view was noted as desirable for office or residential. Goals of the General Plan Land Use Element include: 1) the generation of comer enterprises that support local industries, population and tourist trade, and encouragement of development only in those areas which can best support a changt land use without impact. The site would change fi daytime office use, to 24 hours for a timeshare. A 24 hour site occupancy could resuli evening noise and light generation. Guest room lights will be on during hours that office building would typically be dark. Televisions or radios may be used during evening hours while an office would typically be unoccupied by workers and wo therefor be silent. However, custodial services for an office may be provided dux evening hours and would require that lights be on. An office or a timeshare may h security lighting which could be on from dusk till dawn. A timeshare could have very similar physical characteristics as an office. However, tra generation and peak hour intersection impacts created by a timeshare are less than office, assuming they are equal in size. ComDatibility with surround in^ Uses and Zones The property located immediately to the west is City-owned land containing a stretcl Anacapa Road, the terminus of an existing bridge over Carlsbad Boulevard, and associated entrance and exit ramps. The future elimination of this bridge and ra development potential. Directly west of the ramp structure is Carlsbad Boulevard and northern end of the South Carlsbad State Beach campground. Property to the nortl open space and the Solamar Mobilehome Park. Directly to the south is a vacant l/z a office parcel, immediately south of that is a vacant residential subdivision, La Costa Dov and the Lanikai Mobilehome Park. East of the site is the NCTD railroad right-of-way i vacant land zoned for Office/Planned Industrial. The proposed Commercial-Tourist (C-T) land use is in many ways compatible with exist surrounding uses. The state beach campground and the proposed timeshare are similar in that both intended to attract visitors to the California coast. The length of stay and number of gut per timeshare unit or campground space could reasonably be the same. Access to b sites are separate and will therefor not conflict. The hours of activity for either site also be expected to reasonably be the same. Carlsbad Boulevard acts as a buffer betw the two uses, however, exterior lighting from the project site may intrude into northernmost camp sites. The project parcel is divided into two zones. The southerly 2.35 acres is zoned as Of and the northern 5.67 acres zoned as Open Space. The Open Space zone acts as a bu between the Solamar Mobilehome Park and the project site. Because of the dista between the two, there are few, if any, issues of compatibility. Traffic access to either is separate, excessive levels of noise are not anticipated from either use and neither 1 use will deprive the other of natural light or air. Lots within the La Costa Downs subdivision begin approximately 120 to 170 feet south the project site and this transitional distance does provide some buffer. Howev depending on the nature of two neighboring uses, distance alone may not be adequa Primary concerns raised by La Costa Downs lot owners are: the physical presence, heij and bulk, of a multi story building; potential loss of ocean views; potential traffic relai impacts and general compatibility with the surrounding area. Maximum allowable height within the proposed C-T Zone is 45 feet (if approved by i City Council) and the maximum height allowed in the La Costa Downs Specific Plan is on the two sites, the distance between sites will provide the greatest amount of relief. T is because in addition to the width of Descanso and the Yz acre office parcel, developmc on the project site as well as any future residential development within La Costa Dov will be required to incorporate setbacks. The setbacks could add another 20 feet separation between structures. The design of development on the project site and mc importantly the design of development on the interceding vacant ?h acre office parcel \ be additional opportunities for the creation of a transition from the project site to the Costa Downs subdivision. Natural light or air to the La Costa Downs will not be reduc or denied as a result of development of the project site. Development of the site in any form has the potential for impairing views directly to north from the southerly properties. However, the focus of the views in the area k Pacific Ocean which lies to the west. Those properties to the south which have views the ocean will therefore not be impacted by development of the project site. In additii the City has not adopted a view preservation ordinance which guarantees existing vie1 by any development which lies to the west. Based on the SANDAG generation rates it can be assumed that a timeshare will have fei ADT. But the design for circulation of vehicles, and to a greater degree of pedestria becomes critical. If the site is to accommodate a tourist serving use then access to beach from the site for the pedestrian is imperative. In order to accommodate this, si has been considering a relocation of the access to the project site and La Costa Do= Descanso. The applicant has submitted development applications for permit approval of a timesh resort. The review of those applications will include the implementation of measi which will create a reasonable transition between properties with differing land uses. issues within this staff report and minutes of this public hearing may provide direction the design of any future development. Local Coastal Prom The project site is within the Mello I1 segment of the Carlsbad Local Coastal Program is designated as Office. Discussion of the appropriateness of the proposed Local Coa Program Amendment (LCPA) is nearly the same as the General Plan discussion. The L( is required because the LCP and the City's General Plan must be consistent. The LCP encourages lateral access to the beach (Policy 7-3), visual access (Policies 7 & 8-l), and the inclusion of a limited amount of hoteVmote1 within the study area (Po addition, because it is not appropriate to condition the zone change, discussion of 6-5). Consistent with the intent of the LCP, access to the beach is considered a priority if land use change is to be granted. Development of the site should include a design: pedestrian crossing of Carlsbad Boulevard. Future development should also be reason; sensitive to views of the ocean and coast line. The goal of providing hoteVmote1 wii the Coastal Zone can be achieved through implementation of the proposal. Growth Management The proposed General Plan amendment will result in a reduction of the Average D Traffic (ADT) and will not require that existing or planned facilities be increased. Becs no new conditions will be required within the Local Facilities Management Plan (LFI an amendment to the plan has not been required. Notice of a land use change within LFMP would be provided administratively through an addendum sheet within the z plan. SUMMARY With sensitive design, the proposed land use can be compatible with the surrounding 1 uses. It is the office portion of the site is under consideration for the designations of commercial tourist and travel service. The study recommended an RMH designation (1 1.5 dulac) for this site. However, because of the Encina facility to the east, an altern; land use of Office was adopted. The Encina facility has undergone significant improvement since 1 and odors have been controlled to a much greater degree. The improvement in odor control elimin previous issue of land use compatibility. Another positive quality of the site which supports a tourist oriented use is its location. The state off of Carlsbad Boulevard, which is a major arterial serving inter-regional traffic. By comparison, tr trips generated by a hotel will be about half that of an office building, if they are the same size. Thi: anticipated reduction in daily trips will have a positive effect on surrounding intersections and road segments. However, under the same comparison scenario, water and sewer services would be incr but no change in the facilities as identified in the Zone 22 facilities plan would be necessary. lmpac associated with any development of the site are not expected to be significant and can be address@ through the Site Development Plan process. The applicant has submitted a CT, SDP, CP, HDP, and CUP which will be brought before the Planr Commission if the land use amendments are granted. Special concerns of the Commission can be incorporated into staff's review. For the record, Mr. Westman submitted letters addressed to staff fr owners in La Costa Downs identifying concerns with the proposed use and development of the site. concerns were discussed in the staff report. Also, letters in support of the zone change were submii Village merchants and the Carlsbad Tourism Board. Staff recommends approval. Commissioner Welshons inquired if it is the Commission's responsibility tonight to make the finding change the zoning in the general plan, rather than discussing building heights, access, egress. Mr. Westman replied yes, that the issue is land use determination--whether or not commercial tourist : travel service are appropriate uses for the site. Chairman Savary opened the public testimony and issued the invitation to speak. Mike Howes, Hofman Planning Associates, 2386 Faraday Avenue, Suite 120, Carlsbad, representin applicant, addressed the Commission and stated that he concurs with the staff recommendation. H that the staff presentation adequately addressed the land use issues. There are many office sites in Carlsbad and many of them are currently sitting vacant. However, there are not a lot of sites in clos proximity to the beach which lend themselves to commercial uses. He is currently working with staf five different discretionary permits and if this land use determination is approved, he hopes to be ba a project sometime in July. He introduced Dave Brown of Continental Commercial Corporation, his The other principal, Tim Stripe, is out of town and could not attend tonight. Mr. Howes stated that Continental Commercial Corporation is a sister corporation to Shell-Winners Circle. Shell-Winners is a local Carlsbad company which employs over 450 persons. Shell-Winners Circle has been invo development of successful timeshare projects in Coronado, San Clemente, Oceanside, Del Mar, ant Carlsbad. In Carlsbad, they developed the Carlsbad Inn project in downtown Carlsbad. The Seapo Resort being proposed will be about one-third the size of the Carlsbad Inn project. It will have no restaurant, bar, or any other commercial use. They are only proposing 78 timeshare units at this tir Stated that this is not a speculative use because the applicant has a proven track record to develop i: successful timeshare project at this site. He requested an opportunity to respond to the public testin David S. Brown, Continental Commercial Corp., 5050 Avenida Encinas, Carlsbad, addressed the Commission and stated that he and Tim Stripe are the owners of Continental Commercial Corp. Th have built six timeshare projects in 12 years. All have been successful. It is their only business and carefully build one project at a time to ensure success. They have studied the proposed site very ca and are confident it will be as successful as their other projects. Those improvements are now through plan check and are awail City Engineer's signature. He is not necessarily opposed to the Seapointe Resort project because h the use could be compatible to the single family residences at La Costa Downs. However, he is con about the access requirements which are part of the zone change amendment. The current access across the Ponto bridge but the Seapointe Resort project is proposing access from Descanso Boule! which is triggered by the ZCA being discussed. He would like the access explored so that it is not ir conflict with the La Costa Downs residential development. He hopes that access to the project coulc moved a little further north. Commissioner Schlehuber inquired where he thinks the access should rightly be. Mr. Montgomery that it should probably be across the Ponto bridge. Both Anacapa Road and Francisca Road were originally cul-de-sacs. In the future, the Lanakai Mobile Home Park will take access to the south. - remaining lots and Seapointe could easily take access from the bridge. It would be better than havi of the traffic pass by the residential project because it will all back up at the traffic signal. Commissioner Erwin inquired how Mr. Montgomery would access the beach if the new access were created. Mr. Montgomery replied that it would have been across the bridge. He proposed a pedestr crossing there going to the beach but it wasn't met with great fanfare. He reiterated that he likes the project but is concerned only about the access which is being triggered by the general plan amendn Richard Donahue, 4964 David Way, San Bernardino, California, addressed the Commission and st; that he purchased his lots in La Costa Downs in 1984. His biggest concern with the Seapointe Resc the access. What most people don't know, and he just found out today, is that the reason the acces Resort has been changed is because a deal has been struck between Continental Commercial and 1 of Carlsbad. They have agreed to provide a traffic signal if the street is moved, which would release 2-1 /2 acres of land that they could purchase and develop adjacent to their project. He produced a I from the City Engineer to the City Manager dated March 23, 1994 and a letter from Continental Commercial to Lloyd Hubbs dated April 26, 1994 substantiating the fact that a deal was under consideration. He thought it was interesting that this information had not been revealed to the publi. newspaper or anywhere else. Mr. Donahue is not against the Seapointe Resort project but feels ther some serious problems which need to be worked out. Commissioner Erwin inquired if he understood it correctly, that if this applicant installs a signal at Descanso, then the area to the north would be sold to them which could then be developed. Mr. Do replied that the memo from the City Engineer alludes to that arrangement. However, it is his understanding that any City property being sold must be disclosed to the public before it can be solc What really bothered him is that when he met with Messrs. Westman, Hauser, and Quon, they denic knowledge of a probable sale when they were in possession of the letters which discussed the matte doesn't know what to make of it. Mr. Donahue turned copies of the letters over to the Commission for the record. Commissioner Schlehuber read both letters and believes they only discuss a proposal under conside that they do not say with a certainty that the bridge will be removed. He doesn't feel that staff misrepresented the matter because it was only a proposal and no deal had been consummated. Robert Barelmann, 1967 No. Highway 101, Leucadia, addressed the Commission and stated that he owns lots in La Costa Downs and would like to see this item continued because of the things which I been brought up tonight. He believes that the applicant may be planning a timeshare only at this tin he is reasonably sure that there is an option for a restaurant down the line somewhere. The main dl in La Costa Downs, just south of the project site. Specific Plan 201 was approved by the Planning MlNUTl 0 e PLANNING COMMISSION May 18,1994 PAGE 10 criteria for the timeshare is beach access, however he believes there are other alternatives to remoi bridge. He would like to see the bridge remain, with a pedestrian crossing to the beach. When the Costa Downs Specific Plan was approved, it was 50 pages long and there were 25 pages of deeds disclosures which they are required to do, i.e. noise, rail, odor, airport, to name a few. Nowhere do mention a signal at Descanso. He feels that is an impact to the single family homes which will be t La Costa Downs. They are already impacted by the North County Rail station which will soon be b to mention the trash transfer facility. Mr. Barelmann thinks that an EIR needs to be done because t are many unmitigable impacts which have not been addressed. In addition to being concerned abc access, he is concerned about zoning compatibility, the grade of the site which is 41-45 ft. above n< grade, parking, and conflict of interest. He, along with others, have tried on many occasions to see compromise with the applicant but they won't budge. Mr. Barelmann thinks a compromise is neede Tommy B. White, 691 0 Sandcastle Dr., Carlsbad, turned in a request to speak but was unable to st the meeting. He requested that his opposition to the project be recorded in the Minutes. Susan Beckmann, 3372 Donna Dr., Carlsbad, addressed the Commission and stated that she reprt 29 downtown merchants who are in favor of the proposed Seapointe Resort but could not attend th meeting due to a scheduling conflict with a Chamber of Commerce meeting. The merchants beliec proposed site is good for commercial tourist development and that this location will enhance the mi commercial growth in the City. A copy of the letter containing the 29 signatures is on file in the Plai Department. Mike Howes, Hofman Planning Associates, was given an opportunity for rebuttal. He stated that it ! that the biggest concern seems to be the location of the access. The access being required by staff project is in conformance with the recommendations of the Seapointe Carlsbad general plan study ' approved in 1985. The study recommends moving the overpass at Anacapa, realign Carlsbad Bou and sell the City property offset costs. It also recommends realigning Anacapa to serve as commor to La Costa Downs and property to the north. The existing bridge is approximately 40 years old an( soon be in need of serious retrofitting. The City does not want to be in the business of repairing brk The access being requested by the City would probably be requested regardless of the use of the Seapointe site. The idea is to produce a safe intersection to be used by both Seapointe and La Cos Downs. AS it is now, they have to walk down the street and attempt to cross Carlsbad Boulevard w gets quite busy in the summer. He assured the Commission that no "deal" has been made. There 1 recommendation in the study to vacate that right-of-way. His client has only had some preliminaq discussions with staff about that issue. He knows that any sale must go all the way to the City Cour that happens, his clients will need to come back again with another general plan amendment and dl plan. At this time it is purely speculative. He closed by saying that the building being proposed is if conformance with the City's height standards which the Commission will see when the plans come 1 in July.
