Adopt Resolution No, Yi/- $32- accepting $21 4,374.00 from Kemper C
Development Company as payment in full for parkway and median improvt

ITEM EXPLANATION:
The City is holding Bonds to secure the construction of parkway an(
improvements to Palomar Airport Road, required as a condition of approval of
Carlsbad Airport Business Center. An agreement was reached to accept $214
payment in full for these improvements, allowing the release of the surety bond!
7, 1994, Kemper Real Estate Management Company made the required $2
payment to the City, and the bonds should now be released. I FISCAL IMPACT;
The payment provides the City with $214,374.00 to be used for the construd
parkway and median improvements to Palomar Airport Road.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD
CALIFORNIA, ACCEPTING THE PAYMENT OF $214,374.00 FOR THI
CONSTRUCTION OF IMPROVEMENTS AND AUTHORIZING THI
RELEASE BONDS.
WHEREAS, the City Council of the City of Carlsbad, on December 16, 197
Resolution No. 3566 approving CT 74-21, Carlsbad Airport Business Center; and
I WHEREAS, said resolution required the developer to post surety for the co * 1) certain parkway and median improvements to Palomar Airport Road; and

WHEREAS, the City desires that the developer provide payment to prc
construction of said improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
California, as follows:
1. That the above recitations are true and correct.
2. That the City accepts the payment of $214,374.00 by the developer.
