BECOMMENDED ACTION:
Authorize staff to enter into an agreement with the California Department ol
Parks and Recreation to keep parking free at the Carlsbad State Beach from JU~J
1, 1994 to June 30, 1995.
Adopt Resolution No. 9y -235
ITEM EXPLANATION:
In February of 1992, the City of Carlsbad entered in to an agreement wit:
California Department of Parks and Recreation (DPR) to keep parking free at th
Carlsbad State Beach parking lot located at Carlsbad Boulevard and Tamarac
Avenue. This agreement was executed after the California Coastal Cornmissio
granted a two-year permit for the installation of a fee collection device at thj
parking lot. The permit was issued for a period of two years and expired o
January 13, 1994. At that time, DPR requested and received a new permit fror
the Coastal Commission.
The new permit includes all of the previous conditions placed on DPR's previoi
permit. These conditions include granting of the permit for a three-year perk
(permit would be valid until 3/17/94), requiring DPR to monitor any adver:
impacts in the area which includes the establishment of unauthorized trails, an(
identifying mitigation measures such as installing fences and signs to prevent tk
trails. The permit also requires DPR to submit a report to the Coast
Commission each year of the permit.
FISCAL IMPACT:
The cost to the City is $36,000 a year. Funds are included in the FY 1994-5
General Fund Non-departmental Budget.

AGREEMENT REGARDING DAY USE PARKING FEES
CARLSBAD STATE BEACH
THIS Agreement is made and entered into this 18th th day of , I994 by and
between STATE OF CALIFORNIA, acting through the Department of Parks and Recreation
hereinafter referred to as "STATE" and the City of Carlsbad hereinafter referred to as "CITY".
AUGUST
RECITALS
1. The STATE proposes to collect day use parking fees at the Tamarack Avenut
parking lot at Carlsbad State Beach for the purpose of offsetting operation an(
maintenance costs of state beaches.
2. The CITY opposes imposition of fees at this location and has agreed to provide
City funds to help offset operation and maintenance costs of state beaches for the fisc
year 1994-1 995.
AGREEMENTS
1. Term of Aqreement: This Agreement shall begin on July 1, 1994 and shall contin
through June 30, 1995.
2. Collection of Dav Use Parkinq Fees: The State shall not impose or collect day L
parking fees at the Tamarack Avenue parking lot during fiscal year 1994-95.
3. City Fundsee City shall pay $3,000 a month to ke the State parking free at the
Carlsbad State Beach for that period of time when a valid Coastal Commission permit is
in effect for installation of a fee collection device. Total payments shall not exceed
$36,000.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA AUTHORIZING
AN AGREEMENT WITH THE CALIFORNIA STATE
DEPARTMENT OF PARKS AND RECREATION AND THE
EXPENDITURE OF FUNDS FOR MAINTAINING FREE
PARKING AT THE CARLSBAD STATE BEACH IN
FISCAL YEAR 1994-95
The City Council of the City of Carlsbad, California does hereby resolve as follows:
1. That the agreement regarding day use parking fees at Carlsbad State Beach
hereby approved.
2. That the Mayor of the City of Carlsbad is hereby authorized and directed to execu
this agreement for and on behalf of the City of Carlsbad.
3. This resolution shall not act in any way, or be deemed to be, a waiver of any of tl
City’s rights or abilities to obtain or pursue legal, legislative, or other methods to oppo
the continued implementation of parking fees.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of tl
City of Carlsbad on the 16th day of August 1994, by the following vote, to wit:
