RECOMMENDED ACTION:
prohibit the placement of handbills upon vehicles.

Adopt Ordinance No. NS-290, amending Title 8 of the Carlsbad Municipal Code to
)[TEM EXPLANATION
Ordinance No. NS-290 was introduced at the regular City Council meeting of August 9,
1994. The second reading allows Council to adopt the ordinance which would then
become effective in thirty days. The City Clerk will have the ordinance published
within Meen days, if adopted.

CHAPTER 8.28 OF THE CARLSBAD MUNICIPAL CODE TO PROHIBIT THE PLACEMENT OF HANDBILLS UPON VEHICL]
WHEREAS, litter from discarded handbills placed on
has become a serious problem at public and private parking lo
the City of Carlsbad; and
WHEREAS, persons placing handbills on automobile
parking lots can interfere with the ingress and egres
automobiles from the lot, causing public safety concerns; an
WHEREAS, the regulation of handbill distributic
public and private parking lots is essential to protect the he
safety and welfare of the City's residents,
NOW, THEREFORE, the City Council of the City of Carl
California does ordain as follows:
SECTION I: That Title 8, Chapter 8.28 of the Car
Municipal Code is amended by the addition of section 8.28.0
read as follows:
118.28.05S. DeDositins handbills on vehicles in DE
lots prohibited. (a) It is unlawful for any person to place, thr
deposit any handbill in or upon any vehicle in a public parkiI
or to place, throw or deposit any handbill in or upon any VE in a private parking lot without the written permission o

EFFECTIVE DATE: This ordinance shall be effective th
days after its adoption, and the City Clerk shall certify
adoption of this ordinance and cause it to be published at 1
once in a newspaper of general circulation in the City of Carl
within fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of
Carlsbad City Council on the 9th day of AUGUST 11
and thereafter
PASSBD AND ADOPTED at a regular meeting of the
Council of the'city of Carlsbad on the 16th day of AUGUST
1994, by the following vote, to wit:
