ITEM EXPLANATION: City Council adopted on August 16, 1994, Resolution No. 94-233 expressing intent to determine whether to form an underground utility district and setting a public hearing for September 6,1994. All affected property owners and residents within the proposed district boundaries were notified of the public hearing at least fifteen (1 5) days in advance by mail. Staff has met in the field with representatives of the utility companies and established the exact boundaries of the district with due consideration for the location of utility facilities, services to existing buildings, and property boundaries. The boundaries of the proposed district include Garfield Street south of Chinquapin Avenue to its terminating point south of Olive Street and both sides of Olive Street between Chinquapin Street and the North County Transit District railroad tracks. Upon City Council approval of the formation of undergrounding Utility District No. 15, the Council must also fix, by resolution, the time by which owners must be ready to connect to the underground system. After affected property owners have had an opportunity to speak, Council may determine that the public health, safety, and welfare require the removal of overhead lines and the installation of underground utilities and adopt the attached resolution. The time by which property owners must have work completed and be ready to connect to the underground is November 15,1994. FfSCAL IMPACT: The preliminary cost estimate for electrical undergrounding of District 15 is $400,000. All funds will come from monies set aside by SDG&E for undergrounding by the City of Carlsbad under Rule 20A of the Public Utilities Code. Property owners are required to provide a trench and conduit on their property for the underground lines. The estimated cost of this is $1,000 to $1,500. D w a- & 4 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbac California, as follows: 1. That the above recitations are true and correct. 2. That the City Council of the City of Carlsbad, California, hereby finds and determing that the public health, safety, and welfare require the removal of poles, overhead wires, ar associated structures, and the underground installation of wires and facilities for supplyir electric, communication, or similar or associated service in the above-described area. 3. That said area is hereby declared to be an underground utility district, and designated as Underground District No. 15 of the City of Carlsbad. 4. That the City Council finds that said District is in the public interest since the strec adjoin or pass through an area of unusual scenic interest to the general public. 5. That the City Council does hereby order said removal and installation within si! District. 6. That the date on which affected property owners must be ready to connect underground service is November 15, 1994. 7. That overhead poles are to be removed by the affected utilities March 1, 1995. 8. That the City Clerk is hereby instructed to notify all affected utilities and all persc owning real property within Underground Utility District No. 15 of the adoption of this resoluti within ten (1 0) days after the date of such adoption. NOTICE IS HEREBY GIVEN that the City Council of the City of Carlsbad will hold a public hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:OO p.m., on Tuesday, September 6, 1994, to consider whether to form an underground utility district on portions of Garfield Street, south of Chinquapin Avenue and also on Olive Street. As an owner or occupant of property affected by the proposed district, you are cordially invited to attend the public hearing. The proposed district will place all overhead electric, telephone, and dble television lines underground and remove utilrty poles entirely at utility company expense. However, the service to each building or residence must be placed underground by the property owner at the owner’s expense. The cost of this is estimated to be approximately $1 ,OOO to $2,000 and may be less in some cases. A map of the proposed district is attached, along with a reminder of the meeting.
