ENG AVIARA PLANNING AREA 7, UNIT NO. 1 RECOMMENDED ACTION: Adopt Resolution No. s-a/ approving a Final Map for Carlsbad Tract No. 90-05-l Aviara Planning Area 7, Unit No. 1. ITEM EXPLANATION: Engineering staff has completed checking the final map of Carlsbad Tract CT 90-05-l) also known as Aviara Planning Area 7. This subdivision is located in Local Facilities Management Plan (LFMP) Zone 19, at the northeast corner of Alga Road and Ambrosia Lane. It is comprised of 16 lots on 19.9 acres with uses as follows: 13 lots with 76 condominium units and three open space lots. The final map conforms substantially with the Tentative Map, as approved by the City Council on March 19, 1991, per Resolution No. 91-83 and as extended by City Council on April 20, 1993, per Resolution No. 93-71. The final map also conforms to the General Plan, Aviara Master Plan and all applicable requirements of the Municipal Code and City Standards. This map has been found to be consistent with the Growth Management Ordinance and the requirements of the Local Facilities Management Plan for Zone 19. Currently all public facilities within or impacted by Zone 19 meet or exceed the adopted performance standard. The total project density is 5.3 du/acres and is below the Growth Management Control Point of 7.9 du/acre. Unit No. 1 has a density of 3.9 du/acres. The findings required to approve the project below the Growth Control Point were made as a part of the Planning Commission Resolution No. 3140 adopted on January 16, 1991, and were accepted by City Council. The developer has entered into an agreement with the California Coastal Commission, creating a deed restriction over the open space areas within the subdivision. This deed restriction prohibits any encroachment for development into said areas in perpetuity. The developer has contracted with a licensed environmental consultant to provide construction observation and monitoring services for the mitigation measures required by the tentative map and the environmental impact report for the subdivision. FISCAL IMPACT: This project will generate the following fees at building permit issuance: 1. Traffic Impact Fees (78 units @ $432/unit) $33,696.00 2. Sewer Connection Fees (78 units @ $l,806/unit) $140,868.00 3. Water Service Connection Fee (78 units @ $2400/unit) $187,200.00 4. Community Facilities District No. 1 Fees (78 units @ 2,913.l l/unit) $227222.58 Page 2 of Agenda Bill No. .$ J?Zq The exact amount of public facility fees are unknown until the applicant submits an application for Building Permits. The drainage area fees are unknown and will be assessed at the time the Cii adopts a drainage fee schedule. No detailed economic impact analysis of this development has been conducted. While increased operating expense related to this project are expected to be offset from the increased tax or fee revenue, no exact percentage of offset can be predicted. This project is within Assessment District No. 88-l (Alga Road). The developer has signed an agreement to provide notification and disclosure of the assessment to potential home buyers. This project is located within Community Facilities District No. 1 (CFD). Because this is a residential subdivision, the owner will be required to pay the one time special development tax upon issuance of each building permit within the project. This is below the Master Plan 177 specified unit allowance of 216 units. Unit No. 1 contains 78 dwelling units. At this time, the impacts are not known since they are based on building square footage and use. The impacts will be determined using the Site Development Plan/Planned Industrial Permit review when the building square footages are provided. EXHIBIT 4 AVIARA PARKS AGREEMENT PARK CREDIT ACCOUNTING LEDGER Aviara Planning Area 7 is contained within the Aviara Phase I area. As such, the park dedication for this project was included in the initial 10.68 acres dedicated with the recordation of the Phase I Final Maps. UNiT 1 WHEREAS, Barratt American Incorporated, have submitted a final map known as Carlsbad Tract No. 90-06-l to the City of Carlsbad for approval; and WHEREAS, the Tentative Map of Carlsbad Tract No. 90-06-l with conditions, was recommended for approval by the Planning Commission on January 16, 1991 pursuant to Resolution Number 3140; and WHEREAS, the City Council has approved Planning Commission Resolution No. 3140 at its meeting of March 19, 1991 pursuant to Resolution No. 91-63; and WHEREAS, the City Council approved an extension on April 20, 1993 pursuant to Resolution No. 93-71; and WHEREAS, the City Engineer has determined that said map substantially conforms to said conditionally approved tentative map; and WHEREAS, the conditions of approval for said final map have been completed or secured; and WHEREAS, the developer has offered public streets and public easements for dedication to the City of Carlsbad; and WHEREAS, the final map conforms to the City of Carlsbad General Plan and all requirements of City Codes and Standards; and, WHEREAS, the City Council of the City of Carlsbad determined it to be in the public interest to approve said Final Map; NOW, THEREFORE, BE lT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That said Final Map known as Carlsbad Tract No. 90-05-l from Barratt American Incorporated which is on file with the City Engineer and is incorporated herein by reference, is accepted. 3. That the City accepts dedications shown on the Final Map. 4. That the City Clerk is authorized to sign the Certificate of Acceptance on the Final Map. 5. That the City Clerk is authorized to cause the original Final Map to be recorded in the Office of the County Recorder of San Diego County, State of California. 6.
