DEPT MTG. 10/4/94 FACILITIES MANAGEMENT PLAN TO INCLUDE CITY DEPTaPLN # RECOMMENDED ACTION: REVISIONS TO THE CIRCULATION AND SCHOOL CITY FACll ITIFS CFCTIONS I FMP 87-7 I/A\ Both Planning Commission and staff are recommending that the City Council direct the Attorney to prepare documents APPROVING the revisions to the Circulation and Scl Facilities section of the Zone 2 I Local Facilities Management Plan. ITEM EXPLANATION The Zone 2 I Local Facilities Management Plan (LFMP) was originally adopted on September I99 I. To ensure the provision of adequate circulation and school facilities, in compliance Growth Management standards, special conditions were added to the circulation and scl facilities section of the Zone 21 LFMP. One of the special circulation facilities conditions requires that prior to the recordation of the final map or issuance of a grading or building permit, whichever occurs first within the zone, ultimate grade and alignment be established for Poinsettia Lane between El Camino Real and Road. Recently the City received development proposals which are located within Zone 21 which are not located along the future alignment of Poinsettia Lane. Staff came to the conclc that the existing condition was burdensome as it would be difficult to require a property OL to establish an alignment for a roadway when his development is not directly affected by roadway alignment. Consequently, staff is recommending that this condition be modified to r "Prior to the record Lane between El Camino Real and Alga Road" (See Attachment "X" to Planning Commir Resolution No. 3688 for text changes). In addition, staff is recommending that a new circulation special condition be added whick ensure funding of Poinsettia Lane, This condition would read "Prior to recordation of the first map within Zone 2 I, a fee or other financing program guaranteeing construction of Poinsettia between El Camino Real and Alga Road shall be approved by the City Council.'' The modifici of the existing condition and the addition of the new condition would alleviate the o burdensome condition of requiring property owners located within the zone, but not adjacei the proposed roadway alignment, to establish the alignment of Poinsettia Lane. Finally, staff is recommending that the School Special Condition be amended. This change accordance with City Council direction requiring that a new school condition be applied t legislative approvals. The new school condition would read: "Prior to the approval of any map or the issuance of any permits within Zone 2 I, the applicant for the final map or permit submit evidence to the City that impacts to school facilities have been mitigated in conform with the City's Growth Management Plan to the extent permitted by applicable state lav legislative approvals, If the mitigation involves a financing scheme such as a Mello-Roos Comml Facilities District which is inconsistent with the City's Growth Management Plan including Council Policy Statement No. 38, the developer shall disclose to future owners in the projec the maximum extent possible, the existence of the tax and that the school district is the t; agency responsible for the financing district." II. PROJECT DESCRPTION AND BACKGROUND The Zone 21 Local Facilities Management Plan (LFMP) was originally adopted September 17, 1991. To ensure the provision of adequate circulation facilities compliance with Growth Management standards for Zone 21, special conditions wt added to the Circulation Facilities section of the Zone 21 LFMP. One of the spec conditions requires that prior to recordation of the first final map or issuance of a gradi or building permit, the ultimate grade and alignment be established for Poinsettia La between F,l C&o Red and Alga Road. This condition was imposed to ensure tha? reasonably accurate cost estimate to construct Poinsettia Lane was developed and a fundi mechanism was identified before development occurred within the zone. Subsequent to approval of the Zone 21 LFMP, the Zone 20 LFMP was amended to inch a financing plan for the provision of public facilities. The financing plan of the Zone LFMP proposed a zone fee program for the Poinsettia Lane and Alga Road arterials wh occur in Zones 19, 20 and 21. The fee program is intended to provide a way developments to contribute financially to the construction of the roads since they will benefit from these roadway improvements. The basic mechanism for constructing the ro: will be by improvement agreement with those property owners who have frontage on c of the roads or who require one of them for access to their project. bE 0 m LFMP 87-21(A) ZONE 21 LOCAL FACILITIES MANAGEMENT PLAN JULY 20, 1994 PAGE 2 A precise fee formula was not established in the Zone 20 financing plan because i accurate cost estimate for the roadways was not available at that time. The Zone 20 LFN includes a condition requiring that a fee program be approved by the City Council prior 1 approval of the first final map in the zone. rt was noted at the time the Zone 20 LFb was approved that it may also be necessary to amend the Zones 19 and 21 LFMPs include the same condition. Staff is currently working on developing a fee program for Poinsettia Lane. To this en a reasonably accurate cost estimate for the Poinsettia Lane extension has been develop4 without fixing the alignment of the roadway. In addition, it has been determined that i property owners within Zone 21 must participate in the f'kmcing of Pokettia Lane. 1 it will be possible to develop a financing program for Poinsettia Lane without fixing t alignment of the roadway at this time, it appears that the establishment of the ulh alignment for Poinsettia Lane can be postponed until a property owner, located along o of the proposed future alignments of the roadway, is prepared to develop. The following is a summary of the updated status of each of the facilities for LM Facilities Management Plan Zone 21. Citv Administrative Facilities. Librarv, and Parks. Community Facilities District (CFD) PI 1 was formed in 1991 to finance a number of facilities of Citywide benefit. AU propert in Zones 21 are required to annex into the Citfs Mello-Roos Community Facilities Distri A combination of CFD No. 1 and payment of Public Facilities Fee (PFF) constitutes t required financial guarantee for City Administrative Facilities and Library. Park facilit are guaranteed by a combination of park-in-lieu Fees and PFF in compliance with i special condition of the LFMP. Wastewater Treatment CaDacity. The Phase IV expansion of the Ench Water Poh Control Facility has been completed. Wastewater treatment capacity is funded by sew connection fees. Ongoing monitoring of Encinas treatment plant flows is a condition of Zone. Drahaqe. Sewer facilities will provided to meet established standards. III. ANALYSIS Planninn Issues 1. Does the proposed amendment to the Zone 21 Local Facilities Management P1 satisfy all requirements of the Growth Management Ordinance (Chapter 21.90 the Carlsbad Municipal Code)? DISCUSSION The proposed amendment to the Zone 21 Local Facilities Management Plan has be prepared in accordance with Chapter 21.90 of the Carlsbad Municipal Code. Terri Woods, Associate Planner, reviewed the background of the request and stated that LFMP 87-21, a request to amend the circulation and school facility sections of the Local Facilities Management Plan Zone 27 is located in the southwest quadrant of the City, west of El Camino Real, and north of Alga Rc The Zone 21 LFMP was originally approved in September 7 991. At that time, special conditions were added to both the school and circulation sections of the plan. These special conditions included a circulation requirement that prior to final map, the ultimate alignment for Poinsettia Lane be establishec Recently, the City has received development proposals in Zone 21, although the properties are not Ioc2 * along the alignment for Poinsettia Lane. Staff came to the conclusion that the existing condition was burdensome and difficult to require a property owner to fix an alignment when his development is not affected by the alignment. Therefore, staff is recommending that the condition be revised to require th; the alignment be established when the first property along one of the two alternative alignments comes for development. In addition, staff wants to ensure that a fee program be prepared so that all property owners within Zone 21 pay their fair share for those facilities. There was a staff memo dated July 19, I! containing a change requested by the Enginwing Dmrtment. They have requested permission for a program or other program. They are currently working with the property owners to develop a financing plan for Poinsettia Lane and they are uncertain whether that will be a fee program so they have request! this change to allow for another financing mechanism, if it becomes necessary. Staff is also recommending a change to the school condition pursuant to recent Council direction on Zone 20. This condition basically addresses how school impacts would be handled at the LFMP level.
