RECOMMENDED ACTION:
Adopt Resolution No. 94-30Z approving a quitclaim for drainage easements across
portions of lots 89, 99, 100, 105, 121 and 122 of Aviara Planning Area 24, Unit No. 4, CT
90-15-4 according to Map No. 12972.
ITEM EXPLANATION:
This is a request by Hillman Properties to quitclaim the City’s interest in portions of the
drainage easements located in Aviara Planning Area 24, Unit No. 4. The drainage
easements were originally dedicated on the final map. Subsequent construction changes
to the plans for this project have rerouted some of the storm drain lines into the public
streets. These storm drain lines had run along the sides of some of the residential lots.
In one case a storm drain was redesigned to be much less deep in the ground, thereby
allowing the overlying easement to be reduced in width.
The above easements are no longer necessary and staff recommends that Council
approve the quitclaim requested by Hillman Properties.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A QUITCLAIM FOR DRAINAGE EASEMENTS
IN AVIARA PA 24. UNIT 4. CT 90-15-4
WHEREAS, Hillman Properties have submitted a request for quitclaim of some of the
drainage easements within Aviara Planning Area 24, Unit No. 4 (CT 90-15-4); and
WHEREAS, said drainage easements are not currently needed nor are they contemplated
to be needed for the purpose for which they were dedicated; and
WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public
interest to quitclaim a portion of said easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deed conveying drainage easements over portions of APN’s 215
642-01, 215642-l 1, 215642-l 2, 215642-l 7, 215-642-33 and 215-642-34 to Greystone Homes,
Inc., A Delaware Corporation, which is on file with the Ctty Clerk and is incorporated by this
reference; is approved.
3. That the Mayor is authorized to execute the original Quitclaim Deed and the City Clerk
is hereby authorized to cause the original Quitclaim Deed to be released to the property owners
to be recorded in the Office of the County Recorder of San Diego County, State of California.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 25th day of OCTOBER , 1994 by the following vote, to wit:
