ITEM EXPLANATION:
In 1993, the California legislature passed Senate Bill 1082 to reduce the regulatory bL
business community by consolidating duplicative regulatory programs. SB 1082 m:
administration of six specified hazardous waste and hazardous materials regulatory F
consolidated under a Unified Program Agency. The six specified regulatory prog
consolidated under the Unified Program Agency are:
HAZARDOUS WASTE GENERATORS
UNDERGROUND STORAGE TANK OPERATION
HAZARDOUS MATERIALS INVENTORIES & RELEASE RESPONSE PLAl
ACUTELY HAZARDOUS MATERIALS HANDLING
HAZARDOUS MATERIALS MANAGEMENT PLANS & INVENTORY
ABOVEGROUND STORAGE TANK SPILL PREVENTION
The County’s Environmental Health Services (EHS) retains regulatory responsibility
elements 1 - 5, and currently administers a consolidated regulatory program for
waste/materials handling and related emergency planning for all 18 cities and the unit
areas. The sixth component is administered by the Regional Water Quality Control Boar(
EHS and RWQCB are working together to coordinate efforts.
The County has requested that all cities adopt a resolution by December 31,1994 des
San Diego County Department of Environmental Health as the Unified Program Agenc

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLS CALIFORNIA, DESIGNATING THE SAN DIEGO COUNTY DEPARTMEN ENVIRONMENTAL HEALTH AS THE UNIFIED PROGRAM AGENCY HAZARDOUS WASTE & HAZARDOUS MATERIALS MANAGEMENT
WHEREAS, Chapter 6.1 1 of Division 20 of the California Health and
requires that administration of six specified hazardous waste and hazard0
management regulatory programs must be consolidated as a Unified Program; ar
WHEREAS, the San Diego County Department of Environmental He
administers regulatory compliance for five of the six Unified Program components 1
Carlsbad; and
WHEREAS, the Department of Environmental Health, serving as a Uni
Agency, will coordinate administration of the sixth Unified Program component 1

The Department of Health Services, Environmental Health Serv: (EHS) is preparing a Unified Program Agency certifical
application for submission to the Secretary of the Calif01 Environmental Protection Agency in early 1995. This certificat:

San Diego County. In order to meet our application timeline, :
requesting that your city adopt a resolution by December 31, l!
designating the Department of Environmental Health (EHS will

administering California Health and Safety Code (HSC) Chapters and 6.95, or if they have an agreement with the County which I create a less fragmented regulatory program than currently ex: in the countywide region.
The six specified regulatory programs to be consolidated under Unified Program Agency are:

6. Aboveground Storage Tank Spill Prevention (HSC Sec
25270.5).
Environmental Health Services (EHS) currently administer consolidated regulatory program for hazardous waste/mater handling and related emergency planning for all eighteen cities the unincorporated areas of the county. Additionally, Assei Bill 1777 (O'Connell), also enacted in 1993, mandates 1 hazardous materials inventories and management plans provided UI HSC Chapter 6.95, shall be deemed to have met the requirement: UFC Section 80.103 (b,c) ; therefore, EHS retains regula1 responsibility under the HSC for program components 1-5 descr: above. AB 1777 eliminates duplicative reporting requirement: requiring that one set of information be submitted under Chapter 6.95 to EHS, EHS is already coordinating data collecl and information exchange with the local fire jurisdictions andl continue to do so to ensure consolidated efforts.

Prevention Plan, is administered by the Regional Water Qua: Control Board (RWQCB) . EHS is working with the RWQCB to coordii our efforts.
