ITEM EXPLANATION: The City Council has previously approved an agreement with Fraser Engineering, Inc the design of Avenida Encinas Extension in the amount of $55,255. Additional work is required for the construction phase of the project. This work inc field surveying and calculations for determining earthwork pay quantities, draftin! related engineering tasks in order to provide third party verification of the constn contract work. Since Fraser Engineering, Inc., was the design consultant and is thoroughly familiz the project, staff is recommending that the agreement with them be extended to ( August 18, 1995 and an additional $30,000 be added to the consultant agreemeni total not-to-exceed $85,255. FISCAL IMPACT: Funds are available in the project account. Encina Waste Water Treatment Plar deposited funds of $622,000 for their share of the improvements; NCTD has depc $178,000 as their share. 1. WHEREAS, the City Council of the City of Carlsbad, California hereby finds it nc desirable, and in the public interest to extend and amend an agreement with Fraser Eng Inc.; and WHEREAS, the City Council finds that sufficient funds are available in the projec to cover the additional costs. The following Sections are amended as follows: SECTION 1 - CONSULTANT'S OBLIGATIONS Provide the following construction phase engineering services pursuant to Contra( 341 6, Avenida Encinas Extension: A. Perform field surveying to verify and collect topographic data necessary to calculate unclassified excavation and imported borrow payment quantities. Perform necessary calculations based on data from Item A above to quantify final earthwork pay quantities for unclassified excavation and imported borrow. Plot cross sections of field surveyed topography and design grades for determining unclassified excavation and imported borrow final payment quantities. B. C. D. Perform related surveying, drafting, and engineering tasks as requested by the City for determining earthwork quantities or related work. Attend meetings as requested by City relating to measurement and quantification of earthwork. Provide the City with earthwork cross sections, calculations, field notes, and quantity certification. E. F. 0 0 SECTION 4 - FEES TO BE PAID TO CONSULTANT The total shall not exceed the fee payable according to Paragraph 6, "Payment of Fees" and shall be $85,255. No other compensation for services will be allowed except those items covered by supplemental agreements per Paragraph 8, "Changes in Work." SECTION 6 - PAYMENT OF FEES Payment of fees shall be based on Exhibit "A", attached hereto and made a part of this agreement.
