PLN ti SIGN ORDINANCE - ZCA 94-04 RECOMMENDED ACTION: . h Introduce Ordinance No. A/S- 246 APPROVING ZCA 94-04. z u 3 .Z ITEM EXPLANATION: c Q) This item is a zone code amendment to extend the time that ‘A” Frame signs are permitted a, rn citywide, from January 1, 1995 to June 30, 1995. V In October 1993, City Council approved a Municipal Code Amendment to allow “A” Frame signs citywide subject to certain restrictions. This approval is due to expire on January 1, 1995. Recently, the City received a request from an association of merchants to extend the time that ‘A” Frame signs would be permitted. The reasons for this request were cited as lack of improvement in the economy and the need for alternate signage. Sign regulations, including “A” Frame signs, are being discussed as part of the current update of the Village Master Plan, due to be completed by June 1995. Extension of time of this ordinance would allow for discussion to continue regarding the regulation of “A” frame signs. . 2 This proposed amendment changes one aspect of the code only, to substitute a new expiration a date of June 30, 1995. No other changes are proposed. No administrative problems have arisen with the “A” Frame zoning regulations, and staff does not foresee that any problems will arise from extending approval for this limited period. The Planning Commission recommended approval of this amendment by a 7-O vote at its meeting of November 2, 1994. ii FISCAL IMPACT E +J c The extension of time could result in the need for staff to spend additional time on enforcement 9-l activities and the sign permit approval process. PROJECT DESCRIPTION AND BACKGROUND This application is for an amendment to the Municipal Code to extend the time that “A” Frame Signs are permitted Citywide from January 1, 1995 to June 30, 1995. A previous Zone Code Amendment to allow “A” Frame Signs subject to certain requirements was approved by the City Council in October of 1993. One of the requirements was that all “A” Frame Signs (except directory “A” Frame Signs) would be prohibited after January 1, 1995. Recently, the mayor and City Council received a request from an association of merchants to extend the time that “A” Frame Signs would be permitted. The reasons for this request were cited as lack of improvement in the economy, and a need for more signage options. Sign regulations for the Redevelopment Area are being developed as part of the current update of the ’ Carlsbad Village Design Manual, due to be completed by June 1995 and “A” Frame Signs are being evaluated as part of the updated manual. The proposed amendment changes one aspect of the code only, to substitute a new expiration date of June 30, 1995 instead of the existing date of January 1, 1995. The code still considers “A” frame signs as non-permissible except in unique situations. Staff still feels strongly that “A” frame signs are not appropriate generally in Carl&ad. No other changes are proposed to be made to the zoning ordinance. The proposed amendment modifies the time of applicability of the zoning regulations only. No changes are proposed to zoning standards. The proposed amendment is therefore consistent with the General Plan. ZCA 94-04 - “A” FRAME SIGNS NOVEMBER 2, 1994 PAGE 2 III. ENVIRONMENTAL REVIEW Based on the “Initial Study” prepared for this project the Planning Director determines that it is within the scope of Zone Code Amendment (ZCA 93-04) on file in the Planning Department, and there are no additional significant adverse environmental impacts associated with the project, therefore, no further environmental review of this project is required. SUMMARY This proposal is a six month time extension to an existing ordinance only. Staff does not foresee that any problems will arise from extending the expiration period to coincide with the anticipated completion of the updated Redevelopment Master Plan and Design Manual. l. Robert Green, Principal Planner, reviewed the background of the request and stated that this application is for an amendment to the zoning ordinance to extend the time that “A” frame signs are permitted Citywide from January 1, 1995 to June 30, 1995. The Zone Code Amendment which originally allowed “A” frame signs Citywide was approved by the City Council in October 1993. This amendment allowed “A” frame signs until January 1, 1995. Recently, the Mayor and City Council received a request from the Carl&ad Merchant’s Association to extend the time that the signs will be permitted. Lack of improvement in the economy was one reason cited for the extension request. This amendment changes one aspect of the code only, to substitute a new expiration date of June 30, 1995 instead of the existing date. Staff recommends approval. Commissioner Erwin inquired if staff had a problem extending this for one year. Mr. Green replied that staff responded to a request for a g-month extension made through the City Council. Their recommendation was based on that request. If the Commission wishes to extend for one year, he did not feel it would pose a problem. Commissioner Erwin would like to see it extended for one year for economic reasons. That should allow enough time for the work to be completed. Commissioner Monroy concurs with Commissioner Erwin. Another reason for the extension request was to allow sufficient time to complete the redevelopment study. It is always possible that the study could take additional time to complete. In that case, the one year extension wouM be more appropriate. Commissioner Welshons inquired if the extension could be tied to the redevelopment study, i.e. whichever occurs first. Mr. Green stated that, from a staff perspective, they would prefer a date certain. Rich Rudolf, Assistant City Attorney, stated that the legal notice was for a 6 month extension. He is afraid that doubling that might not be within the legal limits. People may have shown up at this meeting if they knew the extension woutd be for one year. Commissioner Noble stated that he has been a member of the Planning Commission for three years and there have been several occasions where an extension was granted for a time longer than was noticed. There has never been any reperchssions. MINUTES - PLANNING COMMISSION November 2, 1994 PAGE 16 Commissioner Erwin stated that he would be comfortable continuing this for two weeks to make the necessary adjustment to one year. Chairman Savary invited Debbie Fountain of the Housing & Redevelopment Department to speak. She addressed the Commission and stated that Village Redevelopment Master Plan is moving forward and they hope to have it completed by June 1995. Chairman Savary opened the public testimony and issued the invitation to speak. There being no persons desiring to address the Commission on this topic, Chairman Savary declared the public testimony closed and opened the item for discussion among the Commission members. Gary Wayne, Assistant Planning Director, stated that this ZCA is a one-time only extension but it could be done again, again, and again. He is concerned that we could reach January 1,1995 and not have the change in place. If the amendment is not in place by that time, all “A” frame signs being displayed would be illegal. Commissioners Compaq Noble, and Monroy feel that 6 months would be sufficient. ACTION: Motion was made by Commissioner Compas, and duly seconded, to adopt Planning Commission Resolution No. 3723, recommending approval of ZCA 94-04, based on. the findings contained therein.
