SUPPLEMENTAL AGREEMENT NO. 012
I RECOMMENDED ACTION:
Adopt Resolution No. CrY-3@ authorizing the Mayor to execute Program Sup1 Agreement No. 012 to State and Local Transportation Partnership Program AI No. SLTPP-5308 providing funding for various projects in the City of Carlsbad. 1 ITEM EXPLANATION: I In 1991, the City of Carlsbad entered into a State and Local Partnership PrOgra Agreement which permits the City to apply annually for State funds for local tram
projects.
In 1992, the City applied for Cycle 4 funds for the following projects:

The attached agreement authorizes the expenditure of State funds for the widc
installation of sidewalks through the State and Local Transportation PartnershiF (SLTPP) for Cycle 4.
Supplemental Agreement 012 covers City Project No. 3391-2 for the const sidewalks along portions of Basswood Avenue, Monroe Street, Magnolia Avenue Drive. The Engineer's Estimate for this project was $321,000. Construction on t began in July, 1994, and is nearing completion. This Supplemental Agreemen: the City to invoice the State for reimbursement of a percentage of eligible cost in the construction of this project.
The State contribution is based on the pro rata share of funds allocated by legislature relative to all projects being funded. For the above project, the p
participation is 22.43%.
To date, over $1.1 million has been received under the SLTPP progr: supplemented the funding of projects within the City with only minor administr; being expended.
FISCAL I M PACT:
Approval of this Supplemental Agreement will allow the City to obtain app

CALIFORNIA, AUTHORIZING THE MAYOR TO EXECUTE STATE AN[
LOCAL PARTNERSHIP PROGRAM SUPPLEMENTAL AGREEMEN'
NO. 012 PROVIDING FUNDING FOR REPLACEMENT AND WIDENIN(
OF SIDEWALKS IN THE CITY OF CARLSBAD
WHEREAS, the City and State have previously entered into State and Loca
Program Master Agreement No. SLTPP-5308; and
WHEREAS, the City Council of the City of Carlsbad has applied for and t
State and Local Transportation Partnership Program (SLTPP) funding for the folio\
Widening and installation of sidewalks.
WHEREAS, the City Council finds that receipt of supplemental funding is bel
transportation system for both the State and City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
California, as follows:
1. That the above recitations are true and correct.
2. That the City Council authorizes the Mayor to execute Supplemental As
to the State and Local Partnership Agreement SLTPP-5308.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad

SPECIAL COVENANTS OR REMARKS
1. It is mutually understood between the parties that this contract may have been written before ascertaining the availability of legislative appropriation of funds, for the mutual benefit of both parties, in order to avoid
program and fiscal delays that would occur if the agreement were executed after that determination was made.
The total amount of State-Local Transportation Partnership funds payable by the State shall not exceed $89630 to be encumbered and reimbursed as follows:

Any increase in State Partnership funds will require a
rebised program supplement. Anv decrease in State Partnership funds will require a
revised finance letter. -A
2. The State Funds Share is calculated based on the lower of
approved eligible application amount or the eligible awar
amount.
3. The Reimbursement Ratio for this Cycle 4 (93/94) Project
22.43%.
4. SPECIAL COVENANTS FOR SLTPP PROJECTS UNDER EARLY REIMBURSEMENT PLAN AND UNDER $300,000 STATE SHARE
These Covenants supersede any conflicting provisions of t
Master Agreement:
A. The LOCAL ENTITY agrees that the payment of State Sh;
Funds will be limited to the lessor of the product of
multiplying the calculated pro rata percentage as determl
the STATE by either:
(a) The eligible award amount or
(b) The total eligible State/Local Partnership Project ( in the approved State/Local Partnership Program Applicat: accepts any consequent increase in LOCAL ENTITY funding requirements.
E. The LOCAL ENTITY will invoice the State for the full Share" after the contract award or upon the State Budget appropriation of funGs, whichever occurs later. "State's

is considered a grant and will be reimbursed as a lump sun payment regardless of final project cost.
C. Prior to reimbursement under this Program Supplement,
Request For Early Reimbursement form, executed by the LOCI ENTITY, must be on file with the STATE.
D. The financial audit and Final Project Expenditure Rep
provisions of Sections 9 and 10 of ARTICLE I of the Maste:
Agreement are not applicable to this PROJECT.
5. In accordance with the State-Local Transportation Partner
Program Guidelines dated June 8, 1994 the project eligibi Cycle 5 projects is limited to contract items plus locall State or Local Entity furnished materials and Supplementa
Supplemental Work eligibility is futher defined under the
Eligibility section of the Guildelines as limited to cert
