RECOMMENDED ACTION:
Adopt Resolution No. 4 Y-332 approving a Final Map for Carl&ad Tract No. 94-01,
Unit 1 Poinsettia Shores.

ITEM EXPLANATION:
Engineering staff has completed checking the final map of Carl&ad Tract 94-01, Unit 1.
This subdivision is generally located in the southwest quadrant of the City east of
Carlsbad Boulevard, west of the l-5 freeway and north of the Batiquitos Lagoon in Local
Facilities Management Zone 9. It is comprised of 9 lots with uses as follows: Future
residential and open space. The purpose of this map is to subdivide into planning area
lots per the Master Plan.
The final map confomts substantially with the Carl&ad Municipal Code, the Subdivision Map Act and the conditions of approval as approved by the Planning Commission on July
6, 1994, per Resolution No. 6676.
Thii map has been found to be consistent with the Growth Management Ordinance and
the requirements of the Local Facilities Management Plan Zone 9. Currently all public
facilities within or impacted by Zone 9 meet or exceed the adopted performance standard.

attached Local Facilities Impact Assessment Form.
The developer has contracted with a licensed environmental, archaeological and
paleontological consuitant to provide construction, observation and monitoring sewices
for the mitigation measures required by the tentative map and the mitigated negative
declaration for the subdivision.
The developer has entered into an agreement with the California Coastal Commission,
creating a deed restriction over certain open space areas within the subdivision. This
deed restriction prohibits any encroachment for development into said areas in perpetuity.
Off site Imwovements
The developer is constructing off-site improvements which Include the construction of
Avenida En&as from the project boundary to Carfsbad Boulevard, a signal&I
intersection at Carlsbad Boulevard and a storm drain system required by the Master
Drainage and Storm Water Quality Management Plan.
Windrose Circle Street Vacation
A portion of Windrose Circle, which was previously dedicated but not in use, will be
abandoned with the recordation of the map.

FISCAL IMPACT:
The exact amount of public facility fees are unknown until the applicant submits an
application for Building Permits. All development applications for projects within
Poinsettia Shores will require a Site Development Plan and/or Tentative Map. Impacts
and fees can be better determined at that time. The drainage area fees have been
calculated and based on the general plan designation and size of lot total $3,233,000.
Public improvements for this project include onsite and off-site storm drain, construction
of Avenida Encinas on-site and off-site from project boundary to Carlsbad Boulevard, off-
site Ponto Drive from Avenida Encinas to existing Ponto Drive and a signal at Carisbad
Boulevard to City Standards and construction of sewer, water and reclaimed water as
shown on the improvement plans. No detailed economic impact analysis of this development has been conducted. While increased operating expense related to this
project are expected to be offset from the increased tax or fee revenue, no exact
percentage of offset can be predicted.
This project is located within Community Facilities District (CFD) No. 1. Annual special
taxes on the undeveloped land will be levied on all lots within the subdivision with the
exception of Open Space Lot 6 and 9. The purpose of this map is to subdivide the
property into master planning areas. Further subdivision of Lots 1 - 6, excluding 6, will
occur. The annual special tax will continue to be levied based on the general plan
designation and acreage of each lot. Because this is a residential subdivision, the owner
will be required to pay the one time special development tax upon issuance of each
building permit within the project.

The purpose of this subdivision is to subdivide lots and grade pads for future development. Each
lot is required to receive approval of a Site Development Plan. At this time, the impacts are not
known since they are based on building square footage and use. The impacts will be
determined using the Site Development Plan review when the building square footages are
approved.

RESOLUTION NO. 94-332
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A FINAL MAP FOR CARLSBAD TRACT 94-01, POINSETTIA SHORES
~ WHEREAS, Kaiza Poinsettia Corporation, a California Corporation, have submitted a final
~ map known as Carlsbad Tract No. 94-01 to the City of Carlsbad for approval; and
WHEREAS, the Tentative Map of Carlsbad Tract No. CT 94-01 with conditions, was
approved by the Planning Commission on July 6, 1994 pursuant to Resolution No. 3676; and
WHEREAS, the City Council upheld the approval of Planning Commission Resolution No.
3678, at its meeting of August 16, 1994 pursuant to Resolution No. 94-241; and
WHEREAS, the City Engineer has determined that said map substantially conforms to said
conditionally approved tentative map; and
WHEREAS, the conditions of approval for said final map have been completed or secured;
and
WHEREAS, the developer has offered public streets and public easements for dedication
to the City ‘of Carlsbad and the vacation of previously dedicated street, Windrose Circle,
including the reservation of an easement for all public utility purposes; and
WHEREAS, the final map conforms to the City of Carlsbad General Plan and all
requirements of City Codes and Standards; and,
WHEREAS, the City Council of the City of Carlsbad determined it to be in the public
interest to approve said Final Map;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That said Final Map known as Carlsbad Tract 94-01 from K&a Poinsettia Corporation,
a California Corporation, which is on file with the City Engineer and is incorporated herein by
reference, is accepted.

3. That the City accepts the dedications shown on Final Map and the vacation of a
portion of Windrose Circle.
4. That the City Clerk is authorized to sign the Certificate of Acceptance on the Final Map.
5. That the City Clerk is authorized to cause the original Final Map to be recorded in the
Office of the County Recorder of San Diego County, State of California.
6. That the City Clerk is authorized to release the map to First American Title Insurance
Company for recording in the office of the County Recorder.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City
DECEMBER
of Carlsbad on the2&hday of 1994, by the following vote, to wit: /
