RECOMMENDED ACTION:
Adopt Resolution No. 9s-8 approving an immediate one-time reimbursement to the
Carltas Company for the construction of Master Drainage Plan facility BAA in the amount
of 9342,686.
ITEM EXPLANATION:
As a condition of approval for the development of the Car Country Expansion (CT 87-03)
the Carltas Company, developer of the project, was required to construct an off-site
drainage improvement identified as Planned Local Drainage facility BAA on the Master
Drainage and Storm Water Quality Management Plan (Master Drainage Plan). In
accordance with the provisions of the City’s newly adopted Drainage Ordinance, Municipal
Code Section 1508.080, the City Council, at its discretion, may enter into a reimbursement
agreement with any developer who has constructed a Planned Local Drainage (PLD) facility
identified within the Master Drainage Plan.
The developer’s contractor has completed construction of the drainage facility and
associated channel work. The total design and construction cost of the project to the
developer, as verified by Engineering staff, is $578,767.68. This figure includes
approximately $49,000 in m-vegetation and environmental mitigation costs currently in
progress.
The Drainage Ordinance specifies that payment of any reimbursement shall be limited to
the extent that the funds are available through the collection of Planned Local Drainage
Area (PLDA) fees. The total amount of funds available for reimbursement through the
collection of PLDA fees for facility BAA is estimated at $585,703 ($527,052 in new PLDA
fees and $58,651 in previously collected PLDA fees). Since the amount available for
reimbursement exceeds the actual cost to construct facility BAA, the developer is eligible
to receive a 100% reimbursement on the constructed facility with no modification to the
existing PLDA fee program.
The Carltas Company paid $227,132.36 in PLDA fees for CT 87-03 (Car Country
Expansion), and CT 92-07 Units No. 1 & 2 (Carlsbad Ranch) under the previous PLDA fee
program. As a condition of development for both of these projects, Carltas signed an
agreement to pay any additional PLDA fees required under the new PLDA fee program.
The total amount of additional fees due to the City under the terms of the agreement is
$236,081.68 ($170,281.68 for CT 87-03 and $65799.34 for CT 92-07 Units 1 & 2).
Subtracting the balance due from the total reimbursable amount leaves a total amount to
be reimbursed to the developer of $342,686.
The City presently has adequate funds within the PLDA fee accounts to pay the requested
reimbursement while maintaining adequate resources to fund all the Planned Local
Drainage Area projects listed in the City’s current five-year Capital Improvement Program.
Staff is, therefore, recommending that an immediate one-time reimbursement be made to
the Carltas Company in the full amount of 3342,686.

FISCAL IMPACT:
The total cost to the Carltas Company to construct PLD facility BAA, as verified by
Engineering staff, was $578,767.68. Pursuant to an agreement with Carltas to pay any
increase in PLDA fees associated with the recently revised Master Drainage Plan, the
Carltas Company is obligated to pay an additional $236,081.68 in drainage fees into the
Area ‘B’ PLDA account. Applying the $236,081.68 as a credit against the cost to construct
the facility results in a remaining balance for the reimbursable cost of 3342,686.
The City currently has $2,041,064 in unreserved undesignated funds within the PLDA Area
“B” account. This amount includes $227,132.36 in PLDA fees previously paid by the
Carltas Company for the Car Country II and Carlsbad Ranch Units 1 and 2 projects.
Payment of the proposed one time reimbursement of 3342,686 to the Carltas Company will
not adversely affect the City’s ability to fund the drainage facilities included within the
current or proposed five-year Capital Improvement Program.

Dear Sherri:
Based on conversations with you and David Hauser today, we are forwarding with this
letter a copy of the landscape proposal for the above referenced project. The
previously submitted detailed reconciliation has been updated to include the landscape
amounts as well as the fti Hubbard bills submitted last week; a copy is also included
with this letter. It appears that the final total for the project will be $578,767.68 as
compared to a budgeted cost of $564,430 for a negative variance of $14,337.68.
It is my understanding that the target agenda date for this reimbursement will be
December 20, 1994. I will contact Hubbard to inform them of the status of the
reimbursement. Your assistance has been greatly appreciated. As always, if there is
anything I can do to assist, please call me.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CAUFORNIA,APPROVlNGANlMMEDlATEONE-TIMERElMBURSEMENT
TO THE CARLTAS COMPANY FOR THE CONSTRUCTION OF MASTER
DRAINAGE PLAN FACILITY BAA IN THE AMOUNT OF 8342,686.
WHEREAS, the Carltas Company, as a condition of approval for Carlsbad Tract 87-03, did
complete the construction of an off-site drainage facility identiiied on the City’s Master Drainage
and Storm Water Quality Management Plan (Master Drainage Plan) as Planned Local Drainage
, facility BAA located within Planned Local Drainage Area ‘B’; and,
~ WHEREAS, the Carlsbad Municipal Code Section 1508.080 provides that the City Council,
at its discretion, may enter into a reimbursement agreement with any developer who has
constructed a Planned Local Drainage (PLD) facility identified in the Master Drainage Plan; and,
WHEREAS, the Carftas Company has requested an immediate reimbursement for costs
incurred in the construction of PLD facility BAA; and,
WHEREAS, the Carftas Company has submitted detailed accounting records, verified by
City staff, which show that the total cost to construct PLD facility BAA was $678,767.68; and
WHEREAS, the Carltas Company, as a condition of approval for CT 87-03 and CT 92-07,
entered into agreements with the City to pay any increase in Planned Local Drainage Area
(PLDA) fees resufting from the recent Master Drainage Plan update; and,
WHEREAS, the Carltas Company is obligated to pay the additional sum of $236,081.68
in PLDA fees to the Clty in satisfaction of said agreements; and,
WHEREAS, the payment of the additional PLDA fees may, in accordance with the
Drainage Ordinance, be credited against the cost to construct PLD facilities; and,
WHEREAS, after application of credit there remains $342,686 in reimbursable costs for
PLD facility BAA; and,
WHEREAS, adequate funds are, or will be, available through the collection of PLDA fees
to reimburse the developer for the full cost of the PLD facility BAA; and,

WHEREAS, adequate funds currently exist within the PLDA account for Area ‘6’ to
reimburse the developer for the construction of PLD facility BAA and to finance all PLO Area ‘B’
drainage improvements programmed in the City’s current and proposed five-year Capital
Improvement Program.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Finance Director is hereby directed to make an immediate one-time
reimbursement to the Carttas Company in the amount of $342,686 for the construction of PLD
facility BAA from PLDA Area B account.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
