ITEM EXPLANATION:
The city of Carlsbad currently has separate automatic aid agreement; Oceanside, Encinitas and San Marcos. In 1990, a master automat agreement was formulated for the purpose of replacing all existing indi agreements, Each fire agency in the North Regional Zone present(
agreement to their respective governing body for approval.
The approval process resulted in several differing versions of the agre being approved, which effectively negated the agreement. Exhibit 2 att, represents a recently revised agreement to which all agencies : agreement. Approval of this agreement will enhance our ability to make the automatic aid system. Section 55632.0 of the Government Code pr local governments the statutory authority to enter into such agreements,

NORTH REGIONAL ZONE MASTER AUTOMATIC AID
AGREEMENT FOR FIRE AND RESCUE RESPONSES
WHEREAS, certain cities, districts and others located in San Diego County maintai
as part of their service, and organized and equipped Fire Department charged with the duty
fire protection and rescue within the limits of said jurisdictions, herein referred to as the
"parties"; and
WHEREAS, it would be to the benefit of the parties that the fire suppression and
rescue services of each of their Fire Departments be, in some circumstances, extended out6
of the limits of each party hereto; and into the limits of the other parties; and
WHEREAS, the parties desire that in some circumstances the Fire Departments of 1
other parties will respond to fire suppression and rescue incidents within the limits of their
jurisdictions, and
WHEREAS, it is the desire of the parties that EMT-P advance life support services
are not included within the scope of this agreement.
NOW, THEREFORE BE IT RESOLVED:
1. The parties to this agreement, as set forth in Exhibit "A" have agreed to
respond to emergency alarms outside of their geographical limit, and within
geographical limits of the other parties in accordance with the terms and
conditions hereinafter set forth.
Any agencies may, upon determining mutual benefit, agree to provide resou
overlooking political andor jurisdictional boundaries, and adhere to the nea
unit concept for determining response patterns as a part of this agreement.
The details as to the method of operations, procedures, and other planning a

5. The duties of Incident Commander shall be assumed by the first arriving fire
officer from a participating agency who is at the scene of the incident,
regardless of which jurisdiction the incident occurs. There shall be an
orderly transfer of command when an Officer from the jurisdiction in which t
incident occurs arrives at the scene, ;f said Officer chooses to assume Incider
Command.
All parties agree to indemnify the other parties for any liability imposed up01
the other parties under Government Code $895.2, based upon a negligent or
wrongful act or omission of the indemnifying party’s officers, agents, or
employees occurring in the performance of this agreement. This
indemnification agreement is entered into pursuant to Government Code $892
and is intended to eliminate the prorate right of contribution described in
Government Code $895.6 and distribute the joint and several liability descrit

in Government Code g895.2 between the parties so that each party bears the
liability and cost of its own negligence.
Each party to this agreement shall maintain proper Worker’s Compensation
Insurance covering its own employees without cost to the other parties, and
each party shall payroll its own personnel without cost to the other parties.
Each of the parties shall be fully responsible for all repairs, maintenance an(
upkeep, including gas, oil, lubrication, parts replacement and repair of casua
damage, of all its own equipment used pursuant to this agreement while saic
equipment is used outside of its political boundaries, except for replenishing
chemical agents used for fire suppression by the responding parties, which s
be paid for by the requesting party, However, during prolonged suppressior
activities, the requesting party shall replenish fuel as needed, provide minor
maintenance of fire suppression equipment, and provide for the well being c
human resources.
The assurance of automatic aid herein set forth shall constitute the sole
consideration for the performance hereof. It is, therefore, understood and
agreed that no money payments shall be made between the parties, that no

charges shall be assessed by any party against any other party, and that each
party shall be fully responsible for all of its costs in connection with the
performance of this contract except as provided for in Section 8.
Nothing in this agreement shall limit either party from participating in separate
agreements with other fire jurisdictions and shall have no effect upon the
existing San Diego County Mutual Aid Agreement.
This agreement shall become effective upon the execution by the parties heretc
and shall continue until terminated by mutual agreement of the parties or until
a party shall give sixty (60) days written notice of intention to terminate to
each of the other parties hereto.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSB, CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE NOF REGIONAL ZONE FIRE AGENCIES FOR AUTOMATIC AID FOR FIRE AND RESCUE RESPONSES
BE IT RESOLVED by the City Council of the City of Carlsbad, Californi:
follows:
1. That an automatic aid agreement for fire and rescue responses
between the city of Carlsbad and the North Regional Zone Fire Agenc
hereby approved.
2. That the Mayor is hereby authorized and directed to execute SE
agreement for and on behalf of the city of Carlsbad.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Carlsbad City Council held the 24th day of JANUARY
1995 by the following vote, to wit:
