H MTG. 2/14/95 AMENDING CHAPTER 18.07 ENTITLED CITY AT CITY MC IDEPT. cLK I UNREINFORCED MASONRY BUILDINGS t I I RECOMMENDED ACTION: Adopt Ordinance No. NS-303, amending Title 18, Chapter 18.07 of the Carlsbad Municipal Code in accordance with the criteria, guidelines, and requirements of state law and the State Seismic Safety Commission. ITEM EXPLANATION Ordinance No. NS-303 was introduced at the regular City Council meeting of February 7, 1995. The second reading allows Council to adopt the ordinance which would then become effective in thirty days. The City Clerk will have the ordinance published within fifteen days, if adopted. NS-303 AN ORDINANCE OF THE CITY COUNCIL OF TEE CITY OF CARLSBAD8 CALIFORNIA8 AMENDING TITLE 18, CHAPTER 18.07, ENTITLED 'IUNREINFORCED MASONRY BUILDINGS" I WHEREAS, the State of California has enacted Chapter 12, Division 1 of Title 2 of the California Government Code ent. I'Building Earthquake Safety" (GCg8875 et. seq.), and WHEREAS, the State Seismic Safety Commission has establ certain criteria, guidelines, and requirements regarding mitigation of unreinforced masonry structures in accordance this law, and ' WHEREAS, the City of Carlsbad desires and intends to adop comply with said criteria, guidelines, and requirement: accordance with this law and the State Seismic Safety Commiss I NOW, THEREFORE, the City Council of the City of Carlsbad ~ 1 hereby ordain as follows: SECTION 1: That Title 18, Chapter 18.07, Section 18.07.0 the Carlsbad Municipal Code is amended to read as follows: 18.07.030 Actions bv the Buildinq Official. Whenever determined by the building official of the city or his 01 designee that a building falls within the criteria for a potent hazardous structure, as defined by this chapter, and the stru is not exempted for local conditions as defined by California H and Safety Code Section 18491.6(b), the building official and h her designee shall take steps to ensure that the provisions o code relating to mitigation are carried out as follows: (1) Service of Order. SECTION 2: That Title 18, Chapter 18.07, Section 18.07.0' added to the Carlsbad Municipal Code to read as follows: 18.07.040 Definitions. ItPotentially hazardous buildingfg 1 any building constructed prior to the adoption of local bui. codes requiring earthquake resistant design of buildings constructed of unreinforced masonry wall construction. tlPotent hazardous building" includes all buildings of this type, inclul but not limited to, public and private schools, theaters, plac public assembly, apartmentbuildings, hotels, motels, fire stat police stations, and buildings housing emergency serv equipment, or supplies, such as government buildings, dis relief centers, c-ommunications facilities, hospitals, blood b pharmaceutical supply warehouses, plants, and retail out llPotentially hazardous building" does not include warehous6 similar structures not used for human habitation, except warehouses or structures housing emergency services equipme] supplies. EFFECTIVE DATE: This ordinance shall be effective thirty after its adoption, and the City Clerk shall certify to the ado of this ordinance and cause it to be published at least once newspaper of general circulation in the City of Carlsbad w fifteen days after its adoption.
