During 1994, the City Council approved two affordable housing zone code amendments as fol ZCA 93-05 - Senior Citizen Housing - Amended the density provisions for Senior Citizen Hou: projects to conform to State Density Bonus Law and established locational guidelines and ( and development standards which respond to senior citizen needs; and ZCA 92-04 - Second Dwelling Units - Modified the processing requirements and development star for second dwelling units for the purpose of encouraging and enabling the developmc second dwelling units in the residential zones of the City. This Local Coastal Program Amendment (LCPA) is a follow-up discretionary action to the pre\ approved zone code amendments, which is necessary to ensure consistency between the Crty's 2 Ordinance (Title 21) and it's Local Coastal Program. The Planning Commission recommended approval (7-0) of LCPA 94-02 on December 2 I, 1994. ' were no major issues associated with this item. Please see attached staff report to the PI: Commission for details. ENVIRONMENTAL REVIEW Negative Declarations were approved for the two Zone Code Amendments (ZCA 93-05 and ZC 04), which are the topic of this LCPA, on April 19, 1994, and June 14, 1994, respectively. Since 94-02 is a follow-up legislative action to these zone code amendments and will not revis environmental findings of the previously approved Negative Declarations, the Planning Directc issued a Notice of Prior Compliance on October 19, 1994. FISCAL IMPACT Aside from typical administrative costs associated with processing project applications, no direc impacts are anticipated to resutt from LCPA 94-02. Any Senior Citizen Housing or Second DI Unit project processed pursuant to the amended zone code shall be subject to growth managi conditions. assessments. In addition, the approval of this Local Coastal Program Amendment will not gra development entitlements. PROJECT DESCRIPTION AND BACKGROUND During this year, two affordable housing zone code amendments (i.e. ZCA 93-05, Senior ( Housing and ZCA 92-04, Second Dwelling Units) were approved by the Carlsbad City C as follows: ZCA 93-05 - Amended the density provisions for Senior Citizen Housing projects to conform to State Density Bonus Law and established locational guidelines and design and development standards which respond to senior citizen needs; and ZCA 92-04 - Modified the processing requirements and development standards for second dwelling units for purposes of encouraging and enabling the development of second dwelling units in the residential zones of the City, In that the City’s Zoning Ordinance as approved by the California Coastal Commission fia as the implementing ordinance for the City’s Local Coastal Program (LCP), the pre! approved zone code amendments also require an amendment to the LCP. This Local ( Program Amendment (LCPA) is a follow-up discretionary action to the previously approve code amendments and will result in consistency between the City’s Zoning Ordinance 2 LCP. Upon approval of this Local Coastal Program Amendment, it will be submitted California Coastal Commission for approval. A six week public comment period was provided for the proposed Local Coastal I? Will this Local Coastal Program Amendment affect other sections of Carlsbad’s ce Local Coastal Programs? Will this Local Coastal Program Amendment significantly impact coastal resourct 2. DISCUSSION Any proposal to develop Senior Citizen Housing or Second Dwelling Unit(s) within the C Zone, pursuant to the amended zoning regulations shall be required to comply with all applicable Local Coastal Program policies and provisions. Therefore, no effects on othe sections are anticipated. This proposed LCPA, which will add new zoning provisions applicable to Senior Citizen Hc and Second Dwelling Unit projects, is not anticipated to result in significant impacts to c resources. As discussed above, any Senior Citizen Housing or Second Dwelling Unit I proposed within the Coastal Zone, shall be required to comply with all applicable LCP p and provisions, including those dealing with the protection of coastal resources. IV. ENVIRONMENTAL REVIEW Negative Declarations were approved for the two Zone Code Amendments which are thc of this LCPA as follows: ZCA 93-05 - Senior Citizen Housing - April 19, 1994; and ZCA 92-04 - Second Dwelling Units - June 14, 1994. Senior Citizen Housincr by Site DeveloE Plan. (a) This section is intended to provide a mechanisi standards for the development of rental or for-sale hot available to senior citizens. (b) The city may approve a Site Development Plar privately developed senior citizen housing on property in thc zone where the general plan applicable to such property pel such permits. (c) Senior Citizen Housing projects shall meet following requirements: (1) Senior housing projects should, whei reasonably possible, be located consistent with the follc locational guidelines: The proposed project should be locat close proximity to a wide range of commercial re' professional, social and community services patronized by SI citizens; or have its own private shuttle bus which will pri daily access tho these services; and (B) The proposed project should be 101 within two to three blocks of a bus or transit stop unlr common transportation service for residents is provided maintained; and The proposed project should be locat a topographically level area; and Development of a senior citizen hai project at the proposed location should not be detriment: public health, safety and general welfare. (2) As used in this section, "housing for s citizens" means housing: (A) Provided under any state or fe program that the Secretary of Housing and Urban Develo determines is specifically designed and operatedto assist el persons as defined in the state or federal program; or (B) Intended for, and solely occupiec persons sixty-two years of age or older; or (C) Intended and operated for occupancy least one person fifty-five years of age or older per unit i following factors are shown: (i) The existence of signif facilities and services specifically designed to meet the phy or social needs of older persons, or if the provision of facilities and services is not practicable, it must be shown residential uses. Significant facilities and servj specifically designed to meet the physical or social needs older persons include, but are not limited to, social recreational programs, continuing education, information counseling, recreational, homemaker, outside maintenance referral services, and accessible physical environment, emergt facilities, transportation to facilitate access to social serv: and services designed to encourage and assist residents to use services and facilities available to them. The common areas that provided shall be designed to make these areas useful functional for residents. Examples of common areas include are not limited to the following: a recreation social roo1 common cooking and dining facility, passive open space; reading/TV rooms. The total amount of common area require( each senior housing project shall be no less than twenty square feet per dwelling unit. Common space excludes stairwells and any balconies of less than forty (40) square f The size of the recreation/community-social room may appropriately reduced if it is located adjacent to usable out space. Adjacent toilet facilities for men and women shal provided. Unless the building is serviced by an elevator, recreation/community-social room shall be located on the gr floor ; (E) A manager-Is unit is recommended t included in every senior citizen housing project. All senior citizen housing proj which do not have an on-site manager shall provide a posted p number of the project owner or off-site manager for emergencie maintenance problems; All buildings exceeding two stories s include elevators; (6) Dwelling units in senior citizen hou projects shall observe the following requirements: (A) Tubs shall be equipped with at least (B) Tubs and/or showers shall be equi with temperature regulating devices; (C) Tub or shower bottom surfaces shal slip resistant; (D) Peepholes in entry doors; and (E) All projects are required to comply Title 24 of the State Building Code (Disabled Access Regulatic (F) All senior citizen units must confoi the requirements of the applicable building and housing code (7) Upon written request by an applicant, ax return for his agreement to develop and operate the senior cit housing project in accordance with this section and Chapter : (Residential Density Bonus), the final decision making authority shall allow an increase in the number of dwelling I permitted per acre (density) subject to the following condit: (A) A minimum increase of twenty-five pel (25%) over the Growth Control Point of the applicable General dwelling unit density as specified by the applicable master or specific plan, at the time of application, consistent Section 21.86 of this Title. (8) All senior citizen housing pro requesting a residential density bonus shall comply witk requirements of Chapter 21.86 of this Title. The preliminary application shall include the follow information: (A) A brief description of the propo including the total number of senior units, density bonus un and affordable senior units proposed; (B) The zoning, General Plan designations assessors parcel number(s) of the project site; (C) A site plan, drawn to scale, wh includes: building footprints, driveway and parking layc building elevations, existing contours and proposed grading; (D) A letter identifying what speci (d) incentives (i, e, ; density bonus, standards modifications, Within 30 days of receipt of the preliminary applicat by the Planning Department, the Department shall provide to applicant, a letter identifying project issues of concern staff, and the incentives or assistance that the Planning Direc can support when making a recommendation to the final decis making authority. ZCA 92-04 modified the processing requirements and development standa second dwelling units for purposes of encouraging and enabling the development of second dwel in the residential zones of the City. Mr. DeCerbo stated that the City's Zoning Ordinance is the implementing ordinance for the City's Coastal Program (LCP) and must be approved by the California Coastal Commission. Consequei LCPA 94-02 is a follow up legislative action to the previously approved ZCAs so that the LCP and Ordinance will be consistent with each other. A six week public comment period has been providc appropriate noticing in two local newspapers. A copy of the notice was also mailed to an interestc list maintained by the City. No comments were received. Mr. DeCerbo stated that the amendment is consistent with the LCP and it will have no impact on environmental resources. Staff recommends approval. Chairman Savary opened the public testimony and issued the invitation to speak.
