RECOMMENDED ACTION:
Adopt Resolution No. c#5-60 approving quitclaims for a 15 foot wide sewer easement,
a 10 foot wide landscape and utility easement and a 20 foot wide drainage easement over a portion of Lot 2 and Lot 4 of Map No. 13978 (Carlsbad Ranch CT 92-07).

ITEM EXPLANATION:
The Carltas Company and the Carlsbad Ranch Company, owners of the Carlsbad Ranch
property, have requested the quitclaim of a 15 foot wide sewer easement, a 10 foot wide
landscape and utility easement and a 20 foot wide drainage easement located over a
portion of Lot 2 and Lot 4 of Map No. 13978 (CT 92-07). The easements were recorded
November 30, 1972 as File No. 320457 and 320458.
The original design of Paseo Del None, was located to the west of its present location.
Easements required for the original location were obtained in 1972. During the approval
process for the Pea Soup Anderson Motel, the City required Paseo Del None ‘straightened’
out. This required additional roadway, landscape and sewer dedications. In 1984, the
additional right of way was obtained and the present alignment of Paseo Del Norte was
constructed. In addition a new drainage channel was constructed to the north of the existing drainage channel. The drainage channel and pipes within the drainage easement
were abandoned.
The easement for sewer, landscape and utility and drainage recorded in 1972 were not quitclaimed during or at the end of the realignment process. Presently, the easements are not used, and there are no plans to utilite these easements.
The recordation of Carlsbad Ranch (CT 92-07) in December of 1993 created a developable parcel in the portion of land between the previous alignment of Paseo Del Norte and the existing alignment. Quitclaiming these easements will serve to “clean up” the land for development.
The easements recorded in 1972 are no longer necessary and staff recommends that Council approve the quitclaim requested by the Carltas Company and the Carlsbad Ranch
Company.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CAUFORNIA, APPROVING QUITCLAIMS FOR. A 15 FOOT WlDE SEWER
EASEMENT, A 10 FOOT WIDE LANDSCAPE AND UTIUTY EASEMENT, AND A 20 FOOT WIDE DRAINAGE EASEMENT OVER A PORTION OF LOT 2 AND 4, MAP NO 13978 (CT 92-07) PR 3.7.87 AND PR 3.7.72.
WHEREAS, the Carlsbad Ranch Company has submitted a request for quitclaim of a
15 foot wide sewer easement, a 10 foot wide landscape and utility easement, and a 20 foot wide
drainage easement located over a portion of Lot 2 and Lot 4 of Map No. 13978 (CT 92-07).
WHEREAS, said easements were never utilized and are no longer needed for the purpose
for which they were granted and are not now nor are they contemplated to be needed.
WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public
interest to quitclaim said easements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Cii .of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim deeds conveying a 15 foot wide sewer easement, a 10 foot wide
landscape and utility easement and a 20 foot wide drainage easement over a portion of Lot 2 and
Lot 4 of Map No. 13078 (CT 92-07) to the Carltas Company (Lot 4), Carl&ad Ranch Company
(Lot 2), which is on file with the Cl Clerk is approved.

3. That the Mayor is authorized to execute the deeds and the City Clerk is hereby
authorized to release the original Quitclaim Deed to the Carttas Company to be recorded in the
Office of the County Recorder of San Diego County, State of California
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 21st day of MARCH , 1995 by the following vote, to wit:
