Program Supplement No. 19 to Local Agency - State Agreement No. 11-5301
reimbursement financing for the City’s replacement of the West Carlsbad Boulevai
over Batiquitos Lagoon, City Project No. 3349.
ITEM EXPLANATION
Attached for the City Council’s review and approval is Program Supplement No. ’
existing Local Agency - State Agreement No. 1 1-5308 for the reimbursement fina
the West Carlsbad Boulevard bridge over Batiquitos Lagoon. This project has
previous approval to be financed under the Federal Highway Administration’
Program which is administered by the State of California Department of Trans!
(CALTRANS). This program enables an 80% Federal and 20% Local Agency fund
for the replacement of the bridge which is currently underway. By virtue of pi
approved agreements between Carlsbad and the Port of Los Angeles, the 20‘
Agency match funding is the responsibility of the Port of Los Angeles. There arc
costs to Carlsbad for this project.
Staff recommends approval of this Program Supplement No. 19.
FISCAL IMPACT
Program Supplement No. 19 identifies a total project budget of $1,449,550 with $1,
to be funded by the Federal Highway Administration under the HBRR Program
CALTRANS. The remaining $291,390 of project costs are the responsibility of tht
Los Angeles by virtue of existing agreements with the City of Carlsbad. There arc
costs of the project to the City of Carlsbad.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSB CALIFORNIA, APPROVING PROGRAM SUPPLEMENT NO. 19 FOR 1 REIMBURSEMENT FINANCING FOR THE REPLACEMENT OF THE WE CARLSBAD BRIDGE OVER BATlQUlTOS LAGOON, CITY PROJECT I 3349.
WHEREAS, the replacement of the West Carlsbad Boulevard bridge over
Lagoon has been previously determined to be necessary and a component of the
Lagoon Enhancement Project; and
WHEREAS, the City of Carlsbad and the Port of Los Angeles have previou!
into agreements by which the Port shall be responsible for all costs require
project; and
WHEREAS, City has previously obtained the approval of HBRR Progran
for said project; and
WHEREAS, Program Supplement No. 19 to the existing Local Agen
Agreement No. 11-5308 has been prepared for the HBRR Program financir

WHEREAS, the City Council of the City of Carlsbad, California, does he
necessary, desirable, and in the public interest to approve said Program Suppl
19.

SPECIAL COVENANTS OR REMARKS
1. The Local Agency will advertise, award, and administer thi
project and will obtain the State's concurrence prior to e
award or rejection of the contract.
2, The Local Agency agrees the payment of Federal funds will limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2) Estimate, or its modification (PR-2A) or the FNM-76, and a any increases in Local Agency Funds as shown on the Financ Bid Letter or its modification as prepared by the Division Local Streets and Roads.
3. In executing this Program Supplemental Agreement, Local
Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program.
4. Whenever the local agency uses a consultant on a cost plus the local agency is required to submit a post audit report ing the allowability of cost payments for each individual tant or sub-contractor incurring over $25,000 on the proje The audit report must state the applicable cost principles zed by the auditor in determining allowable costs as refer CFR 49, part 18, Subpart C - 22, Allowable Costs.
