PLN & HABITAT MANAGEMENT PLAN CITY RECOMMENDED ACTION: ACCEPTANCE OF SECOND FEDERAL GRANT IN SUPPORT OF CARLSBAD That the City Council ADOPT Resolution No. 9 5 -7 9 , authorizing the Mayor t the agreement with SANDAG for federal grant funds in support of the City’ to provide consultant services. Management Plan, and to execute an amended agreement with the Rick Alexander ITEM EXPLANATION On July 26, 1994, the City Council authorized entering into an agreement with the and Wildlife Service for a grant in the amount of $23,477 to support the City Management Plan (HMP). At that time it was noted that a second grant migh available, and this has occurred. The grant which is being offered to the City at tt from the National Fish and Wildlife Foundation via SANDAG and will initially be amount as the first one, $23,477. There is the possibility that the grant could be if additional federal funds become available at a later time. The purpose of the grant is to continue the planning activities of the HMP and to c with regional planning efforts. This work is a continuation of Phase Ill of the HMF specific tasks that will be undertaken are described in the scope of work which is a the amended consultant agreement (Exhibit 3). Q&L ALETHA L, RAUTENKRANZ, City Clerk) 2 e EXHlt AMENDMENT NO. 2 TO AGREEMENT BETWEEN THE RICK ALEXANDER COMPANY AND THE CITY OF CARLSBAD FOR FACILITATION AND CONSULTING SERVICES FOR THE HABITAT MANAGEMENT PLAN WHEREAS, the City of Carlsbad, California, hereinafter referred to as "City" the Rick Alexander Company, hereinafter referred to as "Consultant" have previou entered into an agreement on March 15, 1994, for facilitation and consulting servic related to the Habitat Management Plan (HMP); and, WHEREAS, the agreement has been amended once on October 11, 1994, reflect a grant to the City in the amount of $23,477 from the U.S. Fish and Wildlife Service in support of the HMP, and a modified scope of work as specified in this grant; and, WHEREAS, a second grant in the amount of $23,477 has been made to thc City from the National Fish and Wildlife Foundation in further support of the HMP, the funds being routed to the City via the San Diego Association of Governments (SANDAG); and, WHEREAS, the City wishes to retain the Rick Alexander Company to perfor the additional tasks stated in the modified Scope of Work which is attached hereti and made a part hereof; and, WHEREAS, the Carlsbad City Council hereby finds it necessary, desirable, in the the public interest to approve this Amendment No. 2 for additional facilitatic and consulting services. NOW, THEREFORE, IN CONSIDERATION OF THESE RECITALS, the partie hereto agree as follows: 1. Consultant shall provide to City the services as stated in the Scope ( Work which is provided as Attachment 1, incorporated by reference made a part hereof. Consultant's services under this Amendment No. 2 shall be providec within one year of the date of this amendment, unless extended by mutual agreement of City and Consultant. Merge public comments into plan Merge any preserve design changes into plan Incorporate discussion of MHCP results Produce maps, print document, and prepare all materials for City Council consideration EX W e AGREEMENT BETWEEN THE SAN DIEGO ASSOCIATION OF GOVERNMENTS AND THE CITY OF CARLSBAD THIS AGREEMENT is entered into as of this day of 9 between the San Diego Association of Governments (hereinafter referred to as "SANDAG' the City of Carlsbad (hereinafter referred to as "the City"), pursuant to Resolution - ad by the SANDAG Board of Directors on RECITALS WHEREAS, $1,15O,O00 is provided to the San Diego region from Congressional appropriations and private sources for habitat conservation programs; and WHEREAS, the San Diego Regional Conservation Coordination Comi recommends that the money be divided among five agencies based on an agreed upon pera as follows: SANDAG (8.16%), the Multiple Habitat Conservation Program (28.57% Mu1 tiple Species Conservation Program (28.57 %), and the City of Carlsbad Habitat Managl Plan (6.13%); and WHEREAS, of the total $1,150,000 allocated to the San Diego region, $383,33 be distributed to the five recipient agencies by the United States Fish and Wildlife SI (USFWS) and up to $766,000 will be allocated to SANDAG from the National Fish and W Foundation for distribution to the five recipient agencies in amounts equal to the percei allocated to each agency; NOW THEREFORE, the parties hereto agree as follows: Section 1. Employment of the City SANDAG hereby engages the City and the City agrees to perform the services herei described in Section 2. Section 2. Scoue of Citv's ResDonsibilities A. Financial , Upon signature of this agreement, SANDAG agrees to distribute to the City $23,4' or 6.13% of the amount SANDAG receives from the National Fish and W Foundation Challenge Grant, whichever is less. Scope of Work The City shall complete the work according to the attached budget as submitted approved by the USFWS. City agrees to assure that the funds are utilized for h: planning. D. Submission of Reports 1. The City shall communicate with SANDAG as necessary to report progress problems relating to accomplishing the work, if any. The City shall provide progress reports to the USFWS upon request, if US determines it to be necessary. One (1) copy of all reports shall be submitted to both USFWS and SANDAG Section 3. ScoDe of SANDAG’s Responsibilities A. Personnel 2. 3. The SANDAG Project Manager will provide to the City all directions and guidan received from the USFWS. SANDAG will provide to the City its share of the funds received from the National and Wildlife Foundation within ten working days after receipt of said funds. B. Section 4. Time of Performance The services of the City shall be undertaken and carried out in accordance with the bud€ submitted and approved by the USFWS. This contract shall terminate at 12:oO midr June 30, 1995. Section 5. Payment SANDAG will pay the total cost of the contract as described in Section 5, to the City receipt of the funds. Section 6.
