ENG CITY MGR.?i@ I I RECOMMENDED ACTION: Adopt Resolution No. 9 4 -9 i approving the Final Map for Carlsbad Tract No. 90-34, Aviara Planning Area 27. IlEM EXPLANATION: Engineering staff has completed checking the final map of Carlsbad Tract 90-34, also known as Aviara PA 27. This subdivision is within Local Facilities Management Plan (LFMP) Zone 19 and is located north of Batiquitos Drive and south of its intersection with Kestrel Drive. It is comprised of 35 single-family residential unit lots and one open space lot on an area of 15.500 acres. The final map conforms substantially with the tentative map as approved by Planning Commission on December 4,1991 per Resolution No. 3324. The final map also conforms to the General Plan and all the applicable requirements of the Municipal Code and City Standards. The applicant, Davidson Coscan Partners, a California General Partnership, is requesting the recordation of said Final Map. This map has been found to be consistent with the Growth Management Ordinance. The project density is 2.48 dwelling units per acre which is within the density range of O-4 du/acre specified for the site as indicated on the land use element of the General Plan, and is at or below the Growth Control Point of 3.2 du/acre. This map has also been found to comply with the requirements of LFMP Zone 19. Currently, all public facilities within, or impacted by, Zone 19 meet or exceed the adopted performance standards. For a more complete analysis of the public facilities impact for this project, please see the attached Local Facilities Impact Assessment Form. The developer entered into a Park Agreement with the City of Carlsbad on June 1, 1989. This Park Agreement provided for dedication of 24.2 acres of land by Aviara for park purposes in conjunction with Aviara’s Phase I project. This park dedication was in excess of the park requirements for Phase I so a Park Credit Accounting Ledger was established as part of the Park Agreement to monitor the Park Dedication Credit. An updated copy of this ledger is included as part of this Council agenda package. The 35 residential lots contained in CT 90-34, create a park dedication requirement of 0.244 acres. The Park Credit Accounting Ledger has been updated to reflect this quantity. The site has been previously graded as part of Aviara Phase II mass grading. In conjunction with the mass grading operation, the applicant has entered into an agreement with the California Coastal Commission, creating a deed restriction over the open space areas within the subdivision. This deed restriction prohibits any encroachment into said areas in perpetuity. Also in conjunction with the mass grading, the applicant has contacted with a licensed environmental consultant to provide construction observation and monitoring services for the mitigation measures required by the tentative map. Public improvements for this project include full street improvements, drainage system, potable water system, reclaimed water system, and sewer system all to City Standards. No detailed economic impact analysis of this development has been conducted. While increased operating expenses related to this project are expected to be offset from the increased tax or fee revenue, no exact percentage of offset can be predicted. This project is located within Community Facilities District (CFD) No. 1. Upon recordation of the final map, the CFD assessment will be apportioned to all lots within the subdivision with the exception of Open Space Lot 36. Because this is a residential subdivision, the owner will be required to pay the one-time special development tax upon issuance of each building permit within the project. This project is within Assessment District No. 66-l (Alga Road). The developer has signed an agreement to provide notification and disclosure of the assessment to potential home buyers. AVlARA PLANNING AREA 27. WHEREAS, Davidson Coscan Partners, a California General Partnership, have submttted a final map known as Cartsbad Tract No. W-34 to the City of Carlsbad for I apP~=h and I WHEREAS, the Tentative Map of Carl&ad Tract No. W-34 with conditions, was approved by the Planning Commission on December 4,1991 pursuant to Resolution I Number 3324; and I WHEREAS, the City Engineer has determined that said map substantially conforms I to said conditionally approved tentative map; and WHEREAS, the conditions of approval for said final map have been completed or secured; and WHEREAS, the developer has offered public streets and public easements for dedication to the City of Carl&ad; and , WHEREAS, the final map conforms to.the City of Carlsbad General Plan and all I requirements of city codes and standards; and, WHEREAS, the City Council of the City of Carlsbad determined it to be in the public Interest to approve said Final Map; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carisbad, Callfomla, as follows: 1. That the above recitations are true and correct. 2. That sakl Final Map known as Carl&ad Tract 9034from Davidson Coscan Partners which is on file with the Cii Engineer and is incorporated herein by reference, is accepted. Exhibit 5 3. That the Cii accepts the dedications shown on the Final Map. 4. That the City Clerk is authorized to sign the Certificate of Acceptance on the Final Map. 5. That the City Clerk is authorized to cause the original Final Map to be recorded in the Cffice of the County Recorder of San Diego County, State of California. 6. That the Cii Clerk is authorized to release the map to First American Title Insurance Company for recording in the Cffice of the County Recorder.
