OFFICE SUPPLIES
Staff recommends Council adopt Resolution No. q 5 - I c 6 , accepting the bid of 1
Express for an annual contract for office supplies for the period May 1, 1995 through April
with the option to renew for three (3) additional one (1) year periods.
ITEM EXPLANATION
The City of Carlsbad purchases office supplies for all City departments. We enter into con
suppliers to help keep prices low and standardize the items ordered. The City of Carlsbc
approximately $70,000 annually for office supplies, of which $25,000 represents Central Stor
supplies and $45,000 consists of off contract items not carried in Central Stores.
In accordance with Section 3.28.120 of the Municipal Code, Notice to Bidders was pub' Requests for Bid were sent to nine vendors. Six bids were opened, witnessed and recordec

FISCAL IMPACT
Based on the City departments usage last fiscal year, the estimated cost for the contrac

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE BID PROPOSAL
BETWEEN THE CITY OF CARLSBAD AND CORPORATE EXPRESS
FOR THE ANNUAL CONTRACT FOR OFFICE SUPPLIES
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City o
California, as follows:
1. That the bid of Corporate Express, 8940 Activrty Road, Suite A, Sa
921 26 for the annual contract for office supplies is hereby accepted.
2. That an Agreement between the City of Carlsbad and Corporate Ex
Activity Road, Suite A, San Diego CA 921 26 for the period of one year commencing
through April 30, 1996 and may be renewed by the City Manager for three one (1) 1

AGREEMENT
THIS AGREEMENT, made and entered into this 26th day of APRIL , 1995
and between the CITY OF CARLSBAD, California, a municipal corporation, hereinafter refe
to as "City" and , hereinafter referred to as "Contrac Corporate Express
WITNESSETH
WHEREAS, the City does find that the proposal tendered by the Contractor for c

The Contractor agrees to furnish all office supplies listed as submitted in pror

The Contractor shall provide delivery service as required by the City. Deliver
be within three working days after receipt of order. Back orders will be filled \n
five working days for contracted items and within ten working days for off con
items. Orders will be picked up a minimum of three times per week.
The Contractor will provide monthly and yearly usage reports sorted by
Department. The Contractor will provide Material Data Safety Sheets as reqcl
The Contractor shall obtain and pay for a City of Carlsbad business license
to signing this Agreement.
This Agreement shall be for a period of one (1) year commencing on May 1,
and ending on April 30, 1996. At the end of one (1) year, the City has the
to re-bid or renew the Agreement for three (3) additional one (1) year perioc
It is expressly understood and agreed that the Contractor herein named it
furnishing of all labor and materials provided in this Contract, is acting a
independent Contractor and not an agent, servant or employee of the City.
This agreement or any part thereof shall not be assigned by Contractor wii

9. This Agreement may be amended or modified only by written agreement sigr
by both parties, and failure on the part of either party to enforce any provisior
this Agreement shall not be construed as a waiver of the right to cor
enforcement of such provision or provisions.
The Contractor shall be aware of the requirements of the Immigration Reform i
Control Act of 1986 and shall comply with those requirements, including but
limited to verifying the eligibility for employment of all agents, employees, s COntfaCtors and consultants that are included in this Agreement.
Once each year, after the first six (6) months of this Agreement, upon wri
request by the Contractor and approval of the Purchasing Officer, said prices s
be subject to change in accordance with the Consumer Price Index, San Di
as published by the U.S. Department of Labor, based on one-half of
percentage change in the index from the first month of this Agreement to e
succeeding anniversary thereof.
This Agreement may be terminated by either party by giving thirty (30) (
written notice to the other, and this Agreement shall terminate forthwith thirty
days following the date such notice is given.
