ITEM EXPLANATION: Poinsettia Community Park is the first community park project to be built in the Soutl az $I, rL 4 z 0 5 d a 2 0 2 Quadrant. It will be the largest park (42 acres) to date in the City. The site is lo south of Palomar Airport Road, north of Poinsettia Lane, and directly east of Pas€ Norte. The park is designated as a "community park" in the Parks and Recreation Ek of the General Plan, and Phase I is scheduled for construction in the 94-95 C Improvement Program. In December of 1991 , the City retained a landscape architectural firm, The Partnership, to prepare a Master Plan for the park. In March of 1992, an "open housc held at the Safety Center where more than 200 citizens reviewed and commented or concepts and alternatives. The consultants took the input from the community and from staff and using adopted park standards, developed the Poinsettia Park Maste (previously referred to as Alta Mira Park). The Parks and Recreation Comm recommended adoption of the plan in April 1992; and in August of 1992, the City C( approved the Poinsettia Park Master Plan. The Master Plan, which will be built out in three phases over several years, includes z variety of active and passive recreation opportunities. Phase I amenities, outlined in 1999-2004, will construct the remainder of the park features, less the community c The 22,500 square foot community center/gymnasium, which is the ultimate centel of the project, will be constructed in Phase Ill scheduled for year 2004+. Phase I includes the following work: below, are the subject of this agenda bill, Phase II, currently scheduled in the C 0 Grading for the entire site 0 Interior park roads and a portion of the parking 0 Landscaping 0 One baseball field (lighted) 0 One soccer field with two youth overlay soccer fields (lighted) 0 One restroomknack bar 0 One tot lot 0 A portion of the passive area including picnic facilities 1 0 e 0 Page 2 of Agenda Bill No. I 3. l'j '{ If the price of the successful bidder is lower than the engineer's estimate, one or mc the following amenities may be added to Phase I: e One or two youth baseball/adutt softball fields (lighted) 0 Three tennis courts (lighted) e One additional restroom 0 Stairway access from Paseo del Norte 8 Two basketball courts (lighted) e Additional passive area The Phase I construction schedule is anticipated to be as follows: e Bid Opening: August 0 Construction: September - February 0 Turf Maturation: March - August 0 Park open: September 1996 A "(d) Permit", reviewed by the U.S. Fish & Wildlife Service, is required for the projr because .04 acres of coastal sage is being destroyed to allow for the constructior sewer line and walkway from the park to Paseo del Norte. On May 16, Council authc issuance of a 4(d) permit for Poinsettia park. Staff has submitted notification of this p to the U.S. Fish and Wildlife Service and State Fish and Game Departments. The age Rave a 30-day period to object to the issuance of the permit. Staff believes it is t unlikely that the permit will be rejected because of the small amount of acreage I affected. Access to the Park will be from Camino de las Ondas to the south. Hidden Valley F a future street, will extend from Camino de las Ondas to the park site on land curl owned by Greystone Homes. Greystone Homes has granted the City the right of Wi Hidden Valley Road and permission to work outside the right of way to facilitatl construction of Hidden Valley Road. Greystone Homes is currently processing a m this property for a residential development. As a condition of map approval, they H required to either construct the portion of Hidden Valley Road on its property, or ents a reimbursement agreement with the City should the City construct the road. Grey: Homes has indicated that they wish to construct the roadway through their prc separate from the City contract to save money. To insure that access to the p provided prior to park completion, staff has requested Greystone Homes to exec reimbursement agreement. This agreement will enable the City to build Hidden ! Road and be reimbursed by Greystone Homes for the portion of Hidden Valley constructed on its property should their project be delayed. Greystone Homes possession of this agreement and has indicted that it will be signed. e w Page 3 of Agenda Bill No. / cii i 5 L/ Although the major portion of Hidden Valley Road is on property owned by Grey: Homes, two additional parcels will be affected by the construction of Hidden Valley F One, to the southeast of the park, is owned by Bramalea Inc. and the second, adjacc the park on the east, is owned by Sunbelt Properties (See Exhibit No. 6). Both of 1 projects have approved tentative maps and the conditions of approval require the ou to dedicate to the Crty the right of way for Hidden Valley Road. They are also requir construct a portion of Hidden Valley Road. Staff believes these owners will grar necessary right of way for Hidden Valley Road. Staff is not certain these owners will into a reimbursement agreement prior to the start of park construction. Depending o results of ongoing negotiations, the City may reduce the extent of Hidden Valley improvements, constructing only the minimum roadway necessary to provide access 1 park, thereby insuring adequate participation by developers at the time of their 1 residential development. Staff recommends approval of the plans and specifications for Poinsettia Community Phase I and putting the project out for bid. Staff will continue to meet with the property owners required to complete the program for the construction of Hidden \ Road. Hidden Valley Road will be constructed either by developers or under a sep Clty contract which would begin construction by April 30, 1996. The actual timinc extent of improvements are dependent on on-going negotiation with the developer: The City is currently in possession of adequate rights of way to complete safe and t access to the park when required. On going negotiation will attempt to construct ne improvements in the most economical approach possible. Finally, staff is recommending approval of Amendment No. 6 to the existing contrac The Dike Partnership for construction observation services in the amount of $57,114 (h not to exceed). These services will be utilized on an as-needed basis during biddin( construction to review contractor submittals, perform construction observation, atten meetings, and to insure overall conformance with the project design (refer to Exhibi ENVIRONMENTAL: The Carlsbad Planning Commission approved the Conditional Use Permit (CUP 9: hillside development permit (HDP 92-09) and mitigated negative declaration for his PI on October 7, 1992 as Resolution 3434. The Negative Declaration was filed wit County Recorder on October 14, 1992 in accordance with the California Environm Quality Act. The California Coastal Commission issued Coastal Development Permit 182 for this project in April 1995. The California Department of Fish and Game is the Fish and Game Code in August 1993. Streambed Alteration Permit 5-222-93 for this project in accordance with Section 1E FISCAL IMPACT: The total budget for the entire park master plan (Phases I, II, and 111) as outlined in tt 95 CIP is ten million dollars. EXHIBZ e w AMENDMENT NO. 6 TO AGREEMENT FOR CONSTRUCTION PHASE SERVICES FOR POINSETTIA COMMUNITY PARK THIS AMENDMENT NO. 6, made and entered into as of the 21st day corporation, hereinafter referred to as "City," and THE DIKE PARTNERSHIP, hereinafter referred to as "Consultant." of JUTU'E , 1995, by and between the CITY OF CARLSBAD, a municipal RECITALS WHEREAS, the City Council of the City of Carlsbad, California, adopted Resolution No. 91-386 on December 9, 1991 , approving a consultant agreement for the development of a Master Plan and architectural design services for City's "Aka Mira Community Park," later renamed "Poinsettia Community Park;" and WHEREAS, the parties to this agreement have previously amended said design services agreement on five (5) occasions to supplement said services; and WHEREAS, the parties to this agreement desire to expand the scope of work once again to include this Amendment No. 6 for construction phase architectural services required by City during the construction of "Phase I" of Poinsettia Community Park; and WHEREAS, a supplemental scope of work and fee schedule have been negotiated and agreed to between the parties hereto and are described below; and WHEREAS, the City of Carlsbad, California, hereby finds it necessary, desirable, and in the public interest to proceed with this Amendment No. 6 for said additional architectural services. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Consultant hereby agree as follows: 1.
