RECOMMENDED ACTION:
ADOPT City Council Resolution No. 95 - 168 , AMENDING the Residential F
Agreement between the City of Carlsbad and the County of San Diego to include
of technical assistance for the administration of Carlsbad's Rental Rehabilitation P
ITEM EXPLANATION:
On May 11, 1995, the Housing Commission unanimously approved a recommendatic
Council for approval of an amendment to the Residential Rehabilitation Agreement
City and the County of San Diego to allow the county to provide technical assist
administration of the Rental Rehabilitation Program.
The establishment of a Rental Rehabilitation Program is consistent with the goals of
Element of the Carlsbad General Plan and the Comprehensive Housing Affordabi
(CHAS). The goal of the program is to provide decent, safe and affordable rental
and moderate income families within the City of Carlsbad, through the reh;
substandard housing stock. Pursuant to the Housing Element, priority for rehabilit
given to multi-family housing units identified by the Building Department as being :_
or deteriorating in which low or moderate-income families reside. The following potel
sources have been identified for this program:

0 Redevelopment Set-Aside Funds
CDBG Funds
Federal Home Funds

Although the program will be available to all eligible multi-family rental property owne
efforts will be made to target multi-family housing units located in Census Tract 179
located in the northwest quadrant of the City. This Census Tract contains most I
housing stock which is affordable to low and moderate-income households and
rehabilitation.
At this time staff is recommending that the City enter into the attached agreement an
existing residential rehabilitation agreement with the County. The amended agree1
allow the County to provide technical assistance to the City for the administration of th
rental rehabilitation program for the period beginning June 1, 1995 to September 30,
County has administered the Residential Rehabilitation Program for the City since I
1994. Since that time two (2) single-family homes and two (2) mobilehomes

As with the existing Residential Rehabilitation Program, the amended agreement
City and the County will allow the City to effectively access the technical assistant
to operate a Rental Rehabilitation Program. While City Staff will control program imp
it will not have to develop or add the in-house technical capacity which is significant i
effective for a smaller scale program. Technical assistance includes the provision c
ups; cost estimates; bidding and contracting; inspection of work progress; fund
relocation of tenants.
The full cost of all services incurred during the administration of the Rental F
Program by the County' Housing Authority would be reimbursed by the City, pur
Board of Supervisor's Policy B-29, "Fees, Grants, Revenue Contracts - Department R
for Cost Recovery". While staff would like to recommend limiting the reimb
administrative costs the County Housing Authority requires full cost recovery ar
significant benefits to establishing a Rental Rehabilitation Program and having
Housing Authority provide technical assistance and help the City to administer sucl
Under this initial agreement, the City would have the opportunity to evaluate
Rehabilitation Program and the assistance provided by the County Housing Autt-
expiration, the City may elect to extend the agreement with the County or ex;
alternatives.
Staff has discussed the proposed rental rehabilitation program and agreement witk
and both City Staff and the County Housing Authority have agreed to the terms OL
attached first amendment to the subject agreement.
FISCAL IMPACT:
There is no fiscal impact to the General Fund. The Carlsbad Rental Rehabilitation I
be funded through non-General Fund sources, including Redevelopment set-asidt
other state/federal sources. Funding of the Program will be recommended on a projec
basis.
Redevelopment set-aside funds in the total amount of $1.2 million were approved by
& Redevelopment Commission within the "1 995-2000 Village Redevelop
Implementation Plan"; this Plan was approved January 17, 1995. Over a five-year pl funds are available for single-family andlor multi-family rehabilitation projects.

FIRST AMENDMENT TO THE AGREEMENT BETWEEN
THE CITY OF CARLSBAD AND THE HOUSING AUTHORITY
OF THE COUNTY OF SAN DIEGO FOR ADMINISTERING A RESIDENTIAL
REHABILITATION PROGRAM
This First Amendment to the original Agreement (County contract No. 71704-E) is made i
entered into this 2 1 st day of JUNE , 1995 by and between the CITY (
CARLSBAD, a municipal corporation, hereinafter referred to as Tity", and the HOUSIN.
AUTHORITY OF THE COUNTY OF SAN DIEGO, a public corporation created pursuan
to the Housing authority law of the state of California, hereinafter referred to as "Authorit!
WHEREAS, there exists a need within the City of Carlsbad to assist property own(
with rehabilitation of their multi-family rental units; and
WHEREAS, the City Council believes it to be in the best interest of the citizens of
Carlsbad to provide an agency to administer a Rental Rehabilitation Program for eligible
property owners; and
WHEREAS, the authority has the expertise, staff and resources to enable it to
provide technical assistance for the administration of a rental rehabilitation program.
NOW, THEREFORE: The City and Authority hereby agree to amend Contract
Number 72704-E by amending Paragraph 1, 2 and 4 of the contract.
1. Grant Obligation:
The Authority shall provide technical assistance to the City to administer a Rental
Rehabilitation Program fully in accordance with the terms or requirements of the
funding source which is identified and other guidelines as established by the City.
2. Services to be Provided:
A. Provide technical assistance for the administration of a Rental Rehabilitation
Program:
The City shall refer eligible projects to the Authority for rehabilitation. The maXimUm amount to be expended on each project shall be determined by the rehabilitation needs of the property: the property owner's ability to repay the loan and the amount of funds
set-aside by the City. The Authority shall also provide technical assistance in regards to
determining relocation expenses for tenants and provide guidance for the relocation.

4. Contract Amount
In consideration of services provided for and by this Agreement, the City !
make additional funding available on a project-by-praject basis; these additional funds wil
