ITEM EXPLANATION: This project will provide for the widening of the south side of Alga Road between N Drive and El Camino Real with two traffic lanes and a bicycle lane. The proje temporarily eliminate sidewalk on the south side of Alga Road between Manzanits and El Camino Real. On March 28, 1995, City Council authorized the advertisem bids to construct the south side of Alga Road between Mimosa Drive and El Caminc Eight (8) sealed bids were received on April 10, 1995, as follows: The bid prices listed above are for schedule one, street widening and schedule two, facility relocation. The apparent lowest responsive bid was submitted by Castellc Review of the bid from Castello, Incorporated revealed an immaterial defect in thl Castello Incorporated failed to complete any portion of page 16, "AMOUN' SUBCONTRACTORS BIDS, of the bid documents. Completion of page 16, among o is required by the, "NOTICE INVITING BIDS" that is included in the plan and specific package. On May 30, 1995, five days after the bid opening, Castello, Incorporated prc a completed page 16 to City staff. The overdue data shows that Castello, Incorpc proposes to perform 56 percent of the work required to complete the contract. recommends that Council make the determination that the failure to complete Pas originally in the bid from Castello, Inc., is immaterial since absence of that information not give Castello, Inc., a bid advantage and Council is waiving an immaterial defect. recommends that Council award the contract for widening Alga Road between Mimosa and El Camino Real to Castello, Incorporated of Escondido, California. Funds in the amount of $300,000 have appropriated for this project from Traffic impact Fees. Funds in excess of those requir administer and construct this project will be returned to the Traffic impact Fee account. following table shows the distribution of costs for this project. That the omission by Castello, Incorporated of the data required b documents for Project No. 3428 for the widening of the south side of Alga Road MimosaDrive and El Camino Real is determined to be immaterial since absent information does not give a bid advantage to Castello, Incorporated. 3. That the bid of $170,323 by Castello, Incorporated for Project No. 34 widening of the south side of Alga Road between Mimosa Drive and El kino Real is and the Mayor is hereby authorized to execute a contract therefor.
