ITEM EXPLANATION:
In the early stages of evaluating the Batiquitos Lagoon Enhancement Project’s engineerinj

FISCAL IMPACT
The Carlsbad - SDNR railroad agreement requires the payment of the $500,000 maintc
within 60 days of execution of the agreement. This payment will be made by the

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSB, CALIFORNIA, APPROVING AN AGREEMENT WITH SAN DIEGO NORTHE RAILWAY FOR THE IMPROVEMENTS TO THE RAILROAD BRIDGE O\ BATIQUITOS LAGOON; BATIQUITOS LAGOON ENHANCEMENT PROJE PROJECT NO. 3349
WHEREAS, the City Council of the City of Carlsbad, California, has previously
into an agreement with the City of Los Angeles, acting by and through its Board oi
Commissioners, for the administration and financing of the Batiquitos Lagoon Enhai
Project; and
WHEREAS, said agreement includes provisions for the improvements to the
bridge owned and operated by the North San Diego County Transit Developmer
herein after referred to as "SDNR"; and
WHEREAS, the parties have negotiated and prepared an agreement outling
and responsibilities of the parties pertaining to said bridge improvements; and
WHEREAS, the Port of Los Angeles has authorized Carlsbad to enter
agreement with SDNR; and
WHERAS, the City Council hereby finds it necessary, desirable, and in tl

SUBJECT: AGREEMENT BETWEEN NORTH SAN DIEGO COUNTY TRANSIT
PlSTRlC T BOARD AND CITY OF CARLSBAD R IGHT OF WAY I ICENSE
As you know John, we have been very involved in the negotiations with the SDNR
railroad for the above mentioned agreement. The original construction contract went
to bid with certain work to be done on that railroad without approval of the railroad.
We have subsequently met over the last several months with the rsilroad and with
Carisbad's attendance worked out our differences and the resulting agreement has been finalized by the railroad.
This letter will confirm the Fort's concurrence with the terms of that agreement and
our responsibility to meet the terms of that agreement. Under the MOU that we have
with Carlsbad, we acknowledge that this work is the Port's responsibility and
subsequently after billing by Carlsbad for the $500,000 maintenance fee, we will
reimburse Carlsbad.
