ITEM EXPLANATION: In the early stages of evaluating the Batiquitos Lagoon Enhancement Project’s engineerinj and economic feasibility, one of the many critical issues for the project was the identi assessment of potential impacts the project may have upon existing infrastructure within ( the lagoon. Staff recommends approval of the attached agreement. FISCAL IMPACT The Carlsbad - SDNR railroad agreement requires the payment of the $500,000 maintc within 60 days of execution of the agreement. This payment will be made by the Angeles to Carlsbad with the pass through to SDMR. Additionally, there are minor totalling approximately $22,000, of which $20,000 has already been paid to reimbursement of SDNR plan review, inspection, and miscellaneous administrative exF will be paid by Carlsbad and subsequently reimbursed by virtue of existing re1 agreements with the Port of Los Angeles. The original construction contract went to bid with certain work to be done on that railroad without approval of the railroad. We have subsequently met over the last several months with the rsilroad and with Carisbad's attendance worked out our differences and the resulting agreement has been finalized by the railroad. This letter will confirm the Fort's concurrence with the terms of that agreement and our responsibility to meet the terms of that agreement. Under the MOU that we have with Carlsbad, we acknowledge that this work is the Port's responsibility and subsequently after billing by Carlsbad for the $500,000 maintenance fee, we will reimburse Carlsbad.
