Dear Mr. Orenyak
Wc understand thc City is proposing to hitiate a process 10 select a golf course
development group for the City munivipal course. This process may include an option,
pursuant to ow carlier permission to plan, to c1tat.e a 27 hole fadity which will
ultimately serve both the proposed LEG0 resort and the Carlsbad community.
Furthc.r study of the potential for a 27 hole facility utilizing a ponion of the Carisbad
Ranch/SDG&E pruperiy together with the property recently acquired by the City has
led us to conclude Uut sigxiificani ptcntid benefits to the City may arise from a
phasing which contemplates an hiti81 18 holes including the Carlsbad Ranch property,
and connecting the additional 9 holes with construction of ff IC n'sori.
Such a phasing may signlficanfly improve the initial economic viability of rhe
municipal coune. Because of the absencc uf significant environniental constraitits, the
municipal course may also be realized earlier providing p18y fur the: wmmunity much

LEG0 Developmctit Agreement.
Cotisequently , if we are corral in our preliminary conclusion regarding the significant
advantage lo this pltasing, we at* prepad to include provisions in the Development
Agreement which will coninlit tliis course mclusiuely as a City municipal course unless
and until a resort is built, and to condilioii the resort on the construction of the
additional 9 holcs of golf coniyledng the 27 hole municipal facility,
