ITEM EXPLANATION: The La Costa Village Homeowners Association has requested an above ~ encroachment permit to allow a six-foot high open steel fence to be located thr behind the curb in the public right of way of Almaden Lane. The area where this project is located was developed prior to its annexation to tl of Carlsbad, under County of San Diego standards. The street improvements ( include the construction of a sidewalk because a steep slope was allowed constructed to the edge of the curb. There are no plans to install a sidewalk Staff has reviewed the request and inspected the site and has determined tl encroachment into the street easement will not adversely affect the public's ability the easement. Resolution No. 5?F-JdY Encroachment Agreement with attached plat. ;. 1 2 3 4 5 6 7 8 9 LO I' 12 13 14 15 16 17 18 19 2o 21 22 23 24 25 26 27 28 e 0 RESOLUTION NO. 95-229 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING THE ABOVE GROUND ENCROACHMENT FOR ALMADEN LANE FROM PAMPLONA WAY SOUTHERLY ON THE EAST SIDE OF ALMADEN LANE, PR 4.78 WHEREAS, the La Costa Village Homeowners Association has submitted a re allow a six-foot high open steel fence to be located within a public street and utility E along Almaden Lane, and WHEREAS, the City Engineer has determined the encroachment will not adven the public's abilrty to use the easement, and WHEREAS, the owners of the encroachment have executed an Encroachment A wherein they covenant and agree with the City of Carlsbad as follows: (A) The encroachment shall be installed and maintained in a safe condition cost, risk, and responsibility of the owner and its successors in intere5 The owner shall agree at all times to indemnity and hold the City harmless from any and all claims, demands, losses, damages, or resulting from the construction, maintenance, use, repair or rem0 structure installed hereunder, including any loss, damage, or expense of (1) loss or damages to property and (2) injury to or death of persoi The owner must remove or relocate any part of the encroachment witt days or such other time as specified in the notice after receipt of it fro Engineer, or the City Engineer may cause such work to be don reasonable cost thereof shall constitute a lien upon the property. The Owner. Owner is the owner of that certain rc property located at 7210 1/2 Plaza de la Costa, within the City Carlsbad, San Diego County, California, Assessor's Parcel Numk 2. The Easement. City currently owns an existing easemc over, under, and across Ownerrs property for street purposes wh. easement is described in Exhibit 9@B@9 attached hereto i incorporated by reference. 3. The Encroachment. City hereby covenants and agrees 4 grants its permission to Owner to install a steel fence three fc from the face of the curb into the parkway area, within the pub street easement. A plat showing the location of the encroachmc is attached as Exhibit IrA9@ attached hereto and incorporated reference. This Agreement is subject to the following terms q conditions: 215-232-20. (A) The encroachment shall be installed and maintained in a safe and sanitary condition at the sole cost, risk, and responsibility of the owner and its successors in interest. (B) The Owner shall agree at all times to indemnify and hold the City free and harmless from any and all claims, demands, losses, damages, . or expenses resulting from the construction, maintenance, use, repair or removal of the structure installed hereunder, including any loss, damage, or expense arising out of (1) loss or damages to property and (2) injury to or death of persons. AGREEMENTWAG-11B.FRM 1 REV L a , 0 I (C) The Owner must remove or relocate any part of the encroachment within ten (10) days or such other time as specified in the notice after receipt of it from the City Engineer, or the City Engineer may cause such work to be done and the reasonable cost thereof shall constitute a lien upon the property. Whatever rights and obligations were acquired by the City with respect to the easement shall remain and continue in full force and effect and shall in no way be affected by City's grant of permission to construct and maintain the encroachment structure. (D) 4. Entire Aareement. This Agreement constitutes the enti agreement between the parties with respect to the subject matt hereof and supersedes and replaces all other agreements, oral written, between the parties with respect to the subject matter 5. Notices. Waiver. Any waiver by City of any default must be in writing shall not be a waiver of any other default concerning the same any other provision of the Agreement. 7. Successors and Assians. This Agreement shall be bind and inure to the benefit of the parties hereto and their respect legal representatives, successors, and assigns.
