RECOMMENDED ACTION:
Approval of Resolution No. 9(-a3:pproving the Stipulations with Request for Award
which authorizes the payment of $8,155.00 to Michael Bliss as settlement of his workers’
compensation claim.
ITEM EXPLANATION
This matter arose on May 22, 1991, when the claimant, a. Tree Trimmer in the Community
Services Department, Parks Division, sustained head injuries when he was struck by a fallir
tree.
The claimant’s condition has stabilized and he is now peirmanent and stationary. He is
continuing to work in his usual and customary occupation as a Tree Trimmer in the Parks
Division.
The claimant’s medical reports were submitted to the Workers’ Compensation Appeals Bc
(WCAB) for evaluation and determination of a permanent disability rating.
The permanent disability rating, as well as the need for possible future medical treatment,
have been incorporated into the settlement agreement (Exhibit 2 on file in Risk
Management). The WCAB has set the terms and conditions contained in that agreement.
Staff recommends that the Stipulations with Request for Award be approved.
FISCAL IMPACT
The cost of the settlement is $8,155.00, excluding possible future medical treatment. If sut
treatment is required, the City will be obligated to pay tlhose expenses. There is no metho
for predicting what those costs may be. There are sufficient funds available in the Workel
Compensation Self-Insurance Fund to cover the cost of this settlement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA,
AUTHORIZING THE EXPENDITURE OF FUNDS
FOR SETTLEMENT OF THE WORKERS’
COMPENSATION CLAIM OF MICHAEL BLISS
WHEREAS, the California Workers’ Compensation Appeals Board has
.etermined the settlement in the Workers’ Compensation case of Michael Bliss; and
WHEREAS, there are sufficient funds available in the Workers’
1ompensation Self-Insurance Fund to pay the settlement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
If Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the expenditure of $8,155.00 from the Workers’ Compensation
ielf-Insurance Fund is authorized for the settlement of said case.
3. That the Council accepts the Stipulations with Request for Award on
