RECOMMENDED ACTION:
Adopt Resolution No. $?%?& approving the Final Map for Carlsbad Tract No. 93-10,
Seapointe Resort.
Engineering staff has completed checking the final map of Carlsbad Tract 93-10. This
subdivision is located on the east sMe of Carlsbad Boulevard at Ponto Drive in Local
Facilities Management Zone 22.
It is comprised of 78 units with uses as a timeshare hotel and 5.87 acre open space.
The final map conforms substantially with the Tentative Map, the Carlsbad Municipal
Code, the Subdivision Map Act and with the conditions of approval of the Planning
Commission on August 17, 1994, per Resolution No. 3691.
This map has been found to be consistent with the Growth Management Ordinance and
the requirements of the Local Facilities Management Plan for Zone 22. Currently all
public facilities within or Impacted by Zone 22 meet or exceed the adopted performance
standard. For a more complete analysis of the public facilities impact for this project, see
the attached Local Facilities Impact Assessment Form.
The developer has entered into an agreement with the California Coastal Commission,
creating a deed restriction over the open space areas within the subdivision. This deed
restriction prohibiis any encroachment for development into said areas in perpetuity.
FISCAL IMPACT:
This project will generate the following fees at building permit issuance:
1. Traffic Impact Fees 624 trips @ $22/trip
2. Sewer Connection Fees 78 units @ $1 @X/unit
3. Water Service Connection Fee $2,4OO/unit @ 78 units
4. Drainage Area Fees 8.02 acre @ $4,114/acre

The exact amount of public facility fees and C.F.D. #l fees are unknown until the
applicant submits an application for Building Permits. Public improvements for this
project include full street improvements, drainage system, potable water system, and
sewer system to City Standards and construction of streets, storm drains and sewer as
shown on the improvement plans. No detailed economic impact analysis of this
development has been conducted. While increased operating expense related to this
project are expected to be offset from the increased tax or fee revenue, no exact
percentage of offset can be predicted.

This project is located within Community Facilities District No. 1 (CFD). Annual special
taxes on the undeveloped land will be levied on all lots within the subdivision with the
exception of Open Space Lots. (Because this is a commercial project the owner has the
option of 1) paying the one time special development tax at time of issuance of building
permit or 2) of having the one time special development tax amortized and paying
annually for 25 years).

RESOLUTlON NO. 95-240
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CAUFORNIA, APPROVlNG A FINAL MAP FOR CARLSBAD TRACT CT 93-10, SEAPOINTE RESORT.
WHEREAS, Continental Commercial Corporation, a California Corporation, has
submitted a final map known as Carl&ad Tract No. 93-10 to the City of Carlsbad for
approval; and
WHEREAS, the Tentative Map of Carl&ad Tract No. 93-10 with conditions,
was approved by the Planning Commission on August 17, 1994 pursuant to Resolution
Number 3691; and
WHEREAS, the CXy Engineer has determined that said map substantially conforms
to said conditionally approved tentative map; and
WHEREAS, the conditions of approval for said final map have been completed or
secured; and
WHEREAS, the developer has offered public streets and public easements for
dedication to the City of Carlsbad; and
WHEREAS, the final map conforms to the City of Catfsbad General Plan and all
requirements of City Codes and Standards; and,
WHEREAS, the City Council of the City of Carlsbad determined it to be in the
public interest to approve said Final Map;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That said Final Map known as Carlsbad Tract CT 93-10 from Continental
Commercial Corporation which is on file with the City Engineer and is incorporated herein
by reference, is accepted.
3. That the City accepts dedications shown on the Final Map.
4. That the Cii Clerk is authorized to sign the Certificate of Acceptance on
the Final Map.
5. That the City Clerk is authorized to cause the original Final Map to be
recorded in the Offii of the County Recorder of San Diego County, State of California.
6. That the City Clerk is authorized to release the map to Stewart Tile
Company of San Diego for recording in the office of the County Recorder.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 5th day of Sept. , 1995 by the following vote, to wit:
