RECOMMENDED ACTION:
Adopt Resolution No. 3?fid& accepting bids and awarding a contract in the
amount of $84,630 to Bryant Universal for the reroof of City Hall North and South Wings,
Contract No. CS 95-6.
ITEM EXPLANATION:
On June 6, 1995, the City Council approved the contract documents gpe&l pybions
and specifications and authorized the City Clerk to advertise for bids for the City Hall
Reroof North and South Wings.
Four bids were received, opened, witnessed and recorded on July 31, 1995. The bid
amounts ranged from $84,630 to $1 09,341. The bids were reviewed by the staff of the
Purchasing and Community Services Departments.

Bryant Universal submitted the lowest bid in the amount of $84,630. Bryant's bid
contained a mistake constituting a technical defect on its face because it reflected 100%
sublet to another firm, which is a violation of the Standard Specifications for Public Works
Construction (''the green book') requirement that 50% or more of the project be
completed by a bidder with its own organization. After further investigation, supported by
a letter of explanation from the bidder, staff concludes and recommends Council find that
the indication of 100% subcontracting was a mistake, and an immaterial defect, because
the project will be performed 100% by the contractor's organization. The attached
resolution so provides.
Staff therefore recommends the construction contract be awarded to Bryant Universal, the
lowest responsive bidder, in the amount of $84,630. The contractor's registration and
bonds are in order and references are satisfactory.
FISCAL IMPACT:
, The estimate for this work was $90,000 and funds are available in the Community Services

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
eARLSBAD, CALIFORNIA, ACCEPTING BIDS AND
AUTHORIZING THE EXECUTION OF CONTRACT NO. CS95-6 FOR THE REROOF OF CITY HALL NORTH AND SOUTH WINGS.
WHEREAS, bids have been received by the City of Carlsbad, California
the Reroof of City Hall North and South Wings; and
WHEREAS, the lowest responsive bid received was submitted by Bryar
Universal in the amount of $84,630; and
WHEREAS, sufficient funds are available in the Community Services
Department Facilities Management Major Maintenance Account Number 001 -820-532(
2462.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City c
Carlsbad, California as follows:
1. The above recitations are true and correct.
2. Funds are available in the Communtty Services Department Facilities
Management Major Maintenance Account Number 001 -820-5320-2462.
3. Council finds that bid indicating 100% sublet was an immaterial defect
that Contractor will perform 100% of work with its own organization. Council hereby

waives the immaterial defect.
4. The bid of $84,630 by Bryant Universal for the Reroof of City Hall Nort
and South Wings, Contract No. CS95-6 is hereby accepted and the Mayor and the C
Clerk are hereby authorized to execute a contract therefore.
