Authorize staff to enter into an agreement with the California State Departme1 Parks and Reueation to keep parking free at the Garlsbad State Bea~h from Ju 1995 to June 30, 1996. 2. Adopt Resolution No. ‘3 5 - 27 % ITEM EXPLANATION On February 4, 1992 the City Council authorized staff to enter into an agreement wit1 California Department of Parks and Recreation (DPR) to keep parking free at the Carl: State Beach parking lot. The agreement was executed after the California COi Commission granted a two year permit for the installation of a fee collection device at parking lot. The permit has been extended and now expires on March 17, 1997. attached Agreement would require the City to pay the State $36,000 during the 1995-96 f year to maintain free parking at the Tamarack lot during that time. FISCAL IMPACT $36,000 is appropriated in the FY 1995-96 General Fund Budget’s Miscellaneous I Departmental Account for this purpose. EXHIBITS I 1. Agreement regarding day use parking fees. 2. The STATE proposes to collect day use parking fees at the Tamarack Avenue lot at Carlsbad State Beach for the purpose of offsetting operation and maintenanc of state beaches. 2. The CITY opposes imposition of fees at this location and has agreed to prc City funds to help offset operation and maintenance costs of state beaches for the fisc 1995-1 996. AGREEMENTS 1. Term of Agreement: This Agreement shall begin on July 1, 1995 and shall CI through June 30, 1996. 2. Collection of Day Use Parkinq Fees: The State shall not impose or collect c parking fees at the Tamarack Avenue parking lot during fiscal year 1995-96. 3. Citv Funds: The State has obtained a valid Coastal Commission Permit installation of a fee collection device at the Tamarack Avenue beach parking lot which until March 17, 1997. The City shall make quarterly payments of $9,000 to keep parki at the Carlsbad State Beach in the 1995-96 fiscal year. Total payments shall not I $36,000. The State shall submit $9,000 invoices to the City on a quarterly basis. ph . I I I i~ I ~l I1 ~I ~l m 0 RESOLUTION NO. 95-278 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA AUTHORIZING AN AGREEMENT WITH THE CALIFORNIA STATE DEPARTMENT OF PARKS AND RECREATION AND THE EXPENDITURE OF FUNDS FOR MAINTAINING FREE PARKING AT THE CARLSBAD STATE BEACH IN FISCAL YEAR 1995-96. The City Council of the City of Carlsbad, California does hereby resolve as follows 1. That the agreement regarding day use parking fees at Carlsbad State Beach is hc approved. 2. That the Mayor of the City of Carlsbad is hereby authorized and directed to exc this agreement for and on behalf of the City of Carlsbad. 3. This resolution shall not act in any way, or be deemed to be, a waiver of any c City’s rights or abilities to obtain or pursue legal, legislative, or other methods to oppos continued implementation of parking fees.
