Adopt Resolution No. 95,-3/b approving Program Supplement No. 013 to the Stat
Local Transportation Partnership Program Agreement No. SLTPP-5308 providing fu
for street overlay and authorizing the Mayor to execute the documents.
ITEM EXPLANATION:
In 1991, the City entered into a State and Local Transportation Partnership Program II
Agreement with the State which permits the City to apply for funds for transpor
projects. The State contribution rate is based on the prorata share of funds allocatc
the State legislature relative to all projects being funded. For Cycle 5 the perce
participation rate is 19.35 percent. Supplements are made to the Master Agreemc
authorize the individual projects and funding amounts.
Approval of Program Supplement No. 13 will permit the City to receive $23,956 in I
for Cycle 5, street overlay program.
To date, the City has received over $4 million under the SLTPP program with only I
administrative effort.
FISCAL IMPACT:
Approval of Program Supplement No. 013 will allow the City to receive $23,956 in
funds.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD
CALIFORNIA, CALIFORNIA APPROVING SUPPLEMENT NO. 013 TO STATE ANC
AND AUTHORIZING THE MAYOR TO EXECUTE DOCUMENTS
WHEREAS, the City and State have previously entered into State and Local Trans[
LOCAL TRANSPORTATION PARTNERSHIP PROGRAM AGREEMENT NO.-530(
Partnership Program Master Agreement No. SLTPP-5308; and
WHEREAS, the City has applied for and been granted approval for the streel
program; and
WHEREAS, the City Council finds that receipt to supplemental funding is benefic
transportation system for both the City and the State.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cai
follows:
1. That the above recitations are true and correct.
2. That the City Council hereby approves Program Supplement No. 01 3 to the :
Local Transportation Partnership Agreement SLTPP-5308.
3. That the City Council hereby authorizes the Mayor to execute documents for
Supplement No. 013.

SPECIAL COVENANTS OR REMARKS
1. It is mutually understood between the parties that this contract may have been written before ascertaining the availability of legislative appropriation of funds, for

Any increase in State Partnership funds will require a
revised program supplement. Any decrease in State Partnership funds will require a
revised finance letter.
2. The State Funds Share is calculated based on the lower of the approved eligible application amount or the eligible award
amount.
3. SPECIAL COVENANTS FOR SLTPP PROJECTS UNDER EARLY REIMBURSEMENT PLAN AND UNDER $300,000 STATE SHARE
These Covenants supersede any conflicting provisions of the Master Agreement:
A. The LOCAL ENTITY agrees that the payment of State Share Funds will be limited to the lessor of the product of
multiplying the calculated pro rata percentage as determined 1: the STATE by either:

C. Prior to reimbursement under this Program Supplement, a Request For Early Reimbursement form, executed by the LOCAL ENTITY, must be on file with the STATE.
