ENG RECOMMENDED ACTION: +x- ". c- -r" CW OF CARLSBAD - AGEWA BILL - - SUPPLEMENT NO. 013 TO STATE AND LOCAL TWNSPORTATION PARTNERSHIP AGREEMENT CITY A CITY M SLTPP-5308 Adopt Resolution No. 95,-3/b approving Program Supplement No. 013 to the Stat Local Transportation Partnership Program Agreement No. SLTPP-5308 providing fu for street overlay and authorizing the Mayor to execute the documents. ITEM EXPLANATION: In 1991, the City entered into a State and Local Transportation Partnership Program II Agreement with the State which permits the City to apply for funds for transpor projects. The State contribution rate is based on the prorata share of funds allocatc the State legislature relative to all projects being funded. For Cycle 5 the perce participation rate is 19.35 percent. Supplements are made to the Master Agreemc authorize the individual projects and funding amounts. Approval of Program Supplement No. 13 will permit the City to receive $23,956 in I for Cycle 5, street overlay program. To date, the City has received over $4 million under the SLTPP program with only I administrative effort. FISCAL IMPACT: Approval of Program Supplement No. 013 will allow the City to receive $23,956 in funds. EXHIBITS: 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cai follows: 1. That the above recitations are true and correct. 2. That the City Council hereby approves Program Supplement No. 01 3 to the : Local Transportation Partnership Agreement SLTPP-5308. 3. That the City Council hereby authorizes the Mayor to execute documents for Supplement No. 013. It is mutually understood between the parties that this contract may have been written before ascertaining the availability of legislative appropriation of funds, for the mutual benefit of both parties, in order to avoid program and fiscal delays that would occur if the made. SPECIAL COVENANTS FOR SLTPP PROJECTS UNDER EARLY REIMBURSEMENT PLAN AND UNDER $300,000 STATE SHARE These Covenants supersede any conflicting provisions of the Master Agreement: A. The LOCAL ENTITY agrees that the payment of State Share Funds will be limited to the lessor of the product of multiplying the calculated pro rata percentage as determined 1: the STATE by either: (a) (b) in the approved State/Local Partnership Program Application ai accepts any consequent increase in LOCAL ENTITY funding requirements.
