ITEM EXPLANATION: Staff is proposing adoption of the Uniform Building Code, 1994 Edition, the Uniform Plurr Code, 1994 Edition, the Uniform Mechanical Code, 1994 Edition, and the National Elec Code, 1993 Edition to replace the similar 1991 editions now in effect. The Uniform Building ( has been completely reformatted to be similar to Codes in other geographic areas of the cou The changes are nominal since there was a one year m.oratorium on Code change 1 accommodate the format revision. Government Code Section 50022.3 requires that this matter be introduced and subsequ scheduled for a public hearing for adoption of the Codes. Notice of the hearing will be publi: in a newspaper of general circulation stating the time and place of the hearing and that cc the hearing. FISCAL IMPACT: Staff is proposing no increase in building permit or plan check fees through these ordinar Fee levels dating to the adoption of the 1991 Codes will be maintained. EXHIBITS: 1. NS-333 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 18 BY THE AMENDMENT OF CHAPTER 18.04, TO ADOPT BY REFERENCE THE UNIFORM BUlLDlNC CODE (1994 EDITION) AND THE UNIFORM BUILDING CODE STANDARDS (1994 EDITION). The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1 : Whereas, the City of Carlsbad is supplied with water and sewer in certa! areas by other entities. It has been necessary in the past to allocate sewer use. (Sectio 106.4.1 and 106.4.4) Other amendments are in reference to fire protection. The City Carlsbad has many large brush-covered hillsides. The City is subject to a frequent Santa A condition of dry, gusty winds, which creates extreme fire danger. The City Coun specifically finds that these geographic and topographic conditions require greater f protection than that provided by the Uniform Building Code, 1994 Edition. Therefo, Chapter 18.04 has altered the Uniform Building Code to require prepaid sewer and wa fees, and to require all fire retardant roofs and more sprinklered buildings. Section 106.4.4 of the Unifor Building Code is amended to read: Every permit issued by the Building Official under the provisions of this code shall expi by limitation and become null and void if the building or work authorized by such permit not commenced within one calendar year from the date of such permit, or if the building ( work authorized by such permit is stopped at any time after the work is commenced for period of six consecutive calendar months or if the building or work authorized by su( permit exceeds three calendar years from the issuance date of the permit. Work shall I presumed to have commenced if the permittee has obtained a required inspection appro\ of work authorized by the permit by. the Building Official within one year of the date permit issuance. Work shall be presumed to be stopped if the permittee has not obtained required inspection approval of work by the Building Official within each six month perk upon the initial commencement of work authorized by such permit. For permits where work I commenced and was subsequently stopped as defined herein, a renewal permit may obtained provided: I (A) No changes have been made or will be made in the original plans a specifications for such work. PERMITS THAT HAVE EXCEEDED THREE YEARS. For permits that have exceed( three years beyond the issuance date, a renewed permit may be obtained provided: (A) Construction in reliance upon the building permits has commenced and be< approved. (B) No changes have been made or will be made in the original plans at specifications for such work. (C) A fee equal to the full amount required for a new permit be paid, except tt- where the Building Official determines that construction has progressed to the point tt- a lesser fee is warranted, such lesser fee shall be paid. The maximum life of a permit renewal in accordance with this subsection shall be 01 calendar year from the date of renewal. The permit may be renewed for each calendar ye thereafter provided that all requirements of (A), (B), and (C) as stated in this subsection a met. 4. EXTENSION OF AN UNEXPIRED PERMIT. Any permittee holding an unexpirc permit may apply for an extension of the time within which he may commence work und that permit when he is unable to commence work within the time required by this sectic for good and satisfactory reasons. Section 403.1 of the Unifor Building Code is amended to read: Scope. This section applies to all 'Group B office buildings and Group R, Division Occupancies, each having floors used for human occupancy located more than 55 feet ab0 the lowest level of fire department vehicle access. For use of plastics in roofs, see Chapter 26. For solar energy collectors located above or upon a roof, see Chapter 13. 18.04.235 Section 3102.3.8 amended - Spark Arrester. Section 3102.3.8 of the Unifo Building Code is amended to read: All chimneys attached to any appliance or fireplace that burns solid fuel shall equipped with an approved spark arrester. The net free area of the spark arrester shall be I less than four times the net free area of the outlet of the chimney. The spark arrester sere shall have heat and corrosion resistance equivalent to 12 gauge wire, 19 gauge galvaniz wire or 24 gauge stainless steel. Openings shall not permit the passage of spheres havin: diameter larger than 1/2-inch and shall not block the passage of spheres having a diamc of less than 3/8-inch. 18.04.260.Section 904.2 amended -Automatic Fire Extinguishing Systems. Section 90 of the Uniform Building Code is amended to add: 904.2.1 .l. Excluding detached R-3 occupancies, in buildings two or more stories height, an automatic fire-extinguishing system shall be installed in those areas which below the lowest elevation of Fire Department vehicular access. Secti( 904,2,8 is amended to read: An automatic sprinkler system conforming to UBC Standard 9-1 shall be install1 throughout every apartment house three or more stories in height or containing 16 or me dwelling units, every congregate residence three or more stories in height or having < occupant load of 20 or more, and every hotel three or more stories in height or containil 20 or more guest rooms. Apartment houses and other residential buildings, having an aggregate floor' at exceeding 10,000 square feet, may be protected by an approved automatic fire sprink system conforming to UBC Standard 9-3 when they are one or two stories in height a contain fewer than 16 dwelling units. Such automatic sprinkler systems shall not considered as the basis for increasing the allowable area of a building or for exemption frc any other Uniform Building Code requirement. Residential or quick-response standard sprinkler heads shall be installed in the dwelli units and guest room portions of the building.' 18.04.31 0 Violations. Any person or corporation who violates any of the provision: this Code or this Chapter is guilty of an infraction, except for the fourth and each additio violation of a provision within one year, which shall be a misdemeanor. Section 502 of the Unifc Building Code is amended to read: Each occupancy, principal building, structure, dwelling unit, and mobilehome Spi within the City shall be identified by a number or combination of number and letter. SI numbers shall be in harmony with other established postal addresses in the area. - numbers for commercial and industrial buildings shall be a minimum of six inches high i for residential buildings, three inches high, and shall be of contrasting colors so as to readable from the adjoining streets. Numbers shall be designated and assigned by Building Department. 18.04.330 Street Name Signs. All private and public streets within the Cit shall h designated street names which shall be identified by signs. Section 102.3.1 of the Unifor Plumbing Code is amended to read: Any person or corporation who violates any of the provisions of this chapter is guil of an infraction except for the fourth or each additional violation of a provision within 01 year which shall be a misdemeanor.
