PLN RECOMMENDED ACTION: - That the City Council INTRODUCE Ordinance No. /vS-Slt APPROVING ZCA 95-11 to extend the City’s Temporary Directional Sign Ordinance until June 1, 1996. ITEM EXPLANATION During staffs review of proposed revisions to the Temporary Directional Sign Ordinance involving new development and design standards for future kiosk structure designs and the possible expansion of the temporary directional sign program, consultation with the City Attorney’s office revealed legal issues requiring resolution prior to amending the ordinance. Since the ordinance (Chapter 21.41.076(8)(f) stipulates that it will expire on January 1, 1996, “unless before that date the ordinance codified in this section is reviewed and extended by City Council”, staff is recommending that the ordinance be extended for five months to give staff the opportunity to ensure that the proposed ordinance will result in a more contemporary directional sign program which is consistent with state and federal laws. I ENVIRONMENTAL REVIEW The Planning Director has determined that the environmental effects of the City’s Temporary Community Directional Sign Ordinance have been considered in conjunction with a previously adopted Negative Declaration; therefore a Notice of Prior Environmental Compliance has been issued. CASE NAME: CITY OF CARLSBAD CASE NO: ZCA 95-11 WHEREAS, the Planning Commission did on the 15 day of November, 1995, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Code Amendment. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: 4 B) That the foregoing recitations are true and correct. That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of Zone Code Amendment, ZCA 9511, according to Exhibit “X,” dated November 15, 1995, attached hereto and made a part hereof, based on the following findings: Findings: 1. 2. The proposed Zone Code Amendment is consistent with the overall Land Use Element policies of Carlsbad’s General Plan which call for the creation of a distinctive sense of place and identity for each community and neighborhood, and the creation of a visual form that is pleasing to the eye and highly identifiable. The temporary directional sign program will identify and provide direction to new subdivisions and communities in a uniform and tasteful manner consistent with these policies. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolution No. 3839 RECOMMENDING APPROVAL of ZCA 95-11. II. INTRODUCTION The City’s Temporary Community Directional Sign Ordinance (Chapter 21.41.076(8)(f)) will expire on January 1,1996 “unless before that date the ordinance codified in this section is reviewed and extended by the City Council”. Consistent with this provision, the proposed zone code amendment will amend the ordinance by extending it for five months from January 1, 19% through June 1, 1996. III. PROJECT DESCRIPTION AND BACKGROUND During staffs review of proposed revisions to the Temporary Directional Sign Ordinance involving new development and design standards for future kiosk structure designs and the possible expansion of the temporary directional sign program, consultation with the City Attorney’s office revealed legal issues requiring resolution prior to amending the ordinance. Rather than allowing the existing ordinance to sunset on January 1, 1996, staff is recommending that the ordinance be extended for five months to give staff the opportunity to ensure that the proposed ordinance will result in a more contemporary directional sign program which is consistent with State and Federal laws. Iv. ANALYSIS Staffs recommendation of approval for this zone code amendment is based upon the following analysis of the project’s consistency with the applicable General Plan policies and the intent of the City’s Temporary Community Directional Sign Grdinance. General Plan The proposed zone code amendment is consistent with the overall land use policies calling for the creation of a distinctive sense of place and identity for each community and ZCA 95-11 - COMM ,,TY DIRECTIONAL SIGN ORDIN, -ZE NOVEMBER 15,1995 PAGE 2 neighborhood, and the creation of a visual form that is pkasing to the eye and highly identifiable. The temporary directional sign program will identify and provide direction to new subdivisions and communities in a uniform and tasteful manner consistent with these policies. Section 21.41.076 - Temporary Community Directional Signs The proposed amendment to extend the Temporary Directional Sign Ordinance is consistent with the intent of the ordinance which is to provide directional information so that residents and visitors to the City can easily find public places, residential neighborhoods, or remote areas in an attractive and safe manner consistent with the City’s prohibition of off-site advertising signs or displays. In summary, the extension of the ordinance will enable more detailed staff review of the legal issues invohred in developing a more contemporary temporary directional sign program that is intended to encourage the use of directional signs over illegal advertising signs. Prior to the June 1, 19% expiration date, staff will return with documents to amend the Temporary Directional Sign Ordinance and the City’s Local Coastal Program to incorporate the ordinance into the Local CoastaI Program. V. ENVIRONMENTAL REVIEW The Planning Director has determined that the environmental effects of the City’s Temporary Community Directionai Sign Ordinance have been considered in conjunction with a previously adopted Negative Declaration; therefore a Notice of Prior Environmental Compliance has been issued.
