HD. +& TITLE: ADOPTION OF THE 1994 UNIFORM BUILDING CODE, THE 1994 UNIFORM PLUMBING CODE, THE NATIONAL ELECTRICAL CODE 63 w .. z 8 F 0 J z 2 a i3 oi 01 RECOMMENDED ACTION: It is recommended that the City Council ADOPT Ordinance No. M5-3-39 , amending Title Chapter 18.04 of the Carlsbad Municipal Code; Ordinance No. ~7-3w , amending Title Chapter 18.16 of the Carlsbad Municipal Code; Ordinance No. M3-23C, amending Title Chapter 18.08 of the Carlsbad Municipal Code; and Ordinance No. MS-334 , amending ' 18, Chapter 18.12 of the Carlsbad Municipal Code, to adopt by reference the I994 Edition o Uniform Building Code, the 1994 Edition of the Uniform Plumbing Code, the 1994 Edition oi Uniform Mechanical Code, and the 1993 Edition of the National Electrical Code. ITEM EXPLANATION: Staff is proposing adoption of the latest editions of the model codes. These model code: jurisdictions are required to enforce these regulations as the minimum standards for construi throughout the State. This Council action will bring the City into compliance with the t requirements. The 1994 Uniform Building Code was completely reformatted in this edition. This was dor bring the document into a format consistent with model Codes in other geographic areas o country. There are few substantive changes to the document since there was a one moratorium on code change proposals to accommodate the new format revisions. The Buil Permit Fee section of the 1994 edition of the Code incorporated an approximate 40% incrc in the building permit and plan check fees. Staff is proposing to not adopt this fee increase to carry over the fee schedule from the 1991 Codes into this Edition. The building permit plan check fees will likely be reviewed in 1996 when the Finance Department conducts its Study. Staff is proposing that the 1994 Editions of the Uniform Plumbing Code and the Un' Mechanical Code be adopted into the Carlsbad Municipal Code with only prior modifications fee increases to plumbing or mechanical permits are proposed by either ordinance. Staff is proposing the 1993 Edition of the National Electrical Code with only prior modifica No fee increases are proposed to electrical permits are proposed by this ordinance, FISCAL IMPACT: No fee increases are proposed by these ordinances. Fee schedules from the 1991 Editic the Codes have been carried forward to maintain the same fees. Section 106.4.1 of f Uniform Building is amended to read: The application, plans and specifications filed by an applicant for a permit shall reviewed by the Building Official. Such plans may be reviewed by other departments of 1 City to check compliance with the laws and ordinances under their jurisdiction. If 1 Building Official is satisfied that the work described in an application for permit and the pli filed therewith conform to the requirements of this code and other pertinent laws a ordinances and that all applicable fees have been paid, he shall issue a permit therefor to 1 applicant. In the case of new building, all fees required for connection to public wa systems and to sewer systems provided by entities other than the City must be paid or a bc posted before a permit is issued. When the Building Official issues a permit, he shall endorse in writing or stamp on b sets of plan and specifications, "Approved". Such approval plans and specifications shall be changed, modified, or altered without authorization from the Building Official, and work shall be done in accordance with the approved plans. The Building Official may issue a permit for the construction of part of a building structure before the entire plans and specifications for the whole building or structure h been submitted or approved, provided adequate information and detailed statements h been filed complying with all pertinent requirements of this code. Section 106.4.4 of the Unif~ Building Code is amended to read: Every permit issued by the Building Official under the provisions of this code shall expi by limitation and become null and void if the building or work authorized by such permit not commenced within one calendar year from the date of such permit, or if the building work authorized by such permit is stopped at any time after the work is commenced for period of six consecutive calendar months or if the building or work authorized by su( permit exceeds three calendar years from the issuance date of the permit. Work shall I presumed to have commenced if the permittee has obtained a required inspection ap rov of work authorized by the permit by the Building Official within one year of the 0 ate permit issuance. Work shall be presumed to be stopped if the permittee has not obtained required inspection approval of work by the Building Official within each six month peril upon the initial commencement of work authorized by such permit. PERMITS THAT HAVE EXCEEDED THREE YEARS. For perrpits that have exceec three years beyond the issuance date, a renewed permit may be obtained provided: (A) Construction in reliance upon the'building permits has commenced and bc approved. (B) No changes have been made or will be made in the original plans i specifications for such work. (C) A fee equal to the full amount required for a new permit be paid, except 1 where the Building Official determines that construction has progressed to the point 1 a lesser fee is warranted, such lesser fee shall be paid. The maximum life of a permit renewal in accordance with this subsection shall be ( calendar year from the date of renewal. The permit may be renewed for each calendar y thereafter provided that all requirements of (A), (B), and (C) as stated in this subsection met. 4. EXTENSION OF AN UNEXPIRED PERMIT. Any permittee holding an unexpi permit may apply for an extension of the time within which he may commence work un that permit when he is unable to commence work within the time required by this sect for good and satisfactory reasons. The Building Official may extend the time for action the permittee for a period not exceeding 180 days upon written request by the permil showing that circumstances beyond the control of the permittee have prevented action fr being taken. No permit shall be extended more than once. 5. The provisions of any sewer allocation system adopted pursuant to Chapter 18 of the Municipal Code shall supersede Section 106.4.4 of the Uniform Building Code if permit is issued pursuant to such system. 18.04.035 Section 107.4 amended - ExDiration of Plan Review. Section 107.4 of Uniform Building Code is amended to read: Applications for which no permit is issued within one year following the date application shall expire by limitation, and plans and other data submitted for review r thereafter be returned to the applicant or destroyed by the Building Official. Section 1501 of the Uniform Building Co shall be amended to read; Roof and roof structures shall be as specified in this Code and as otherwise required this Chapter. Roof coverings shall be fire retardant, Class B or Class A. Roof coverings shall be secured or fastened to the supporting roof construction and st- provide weather protection for the building at the roof. Subject to the requirements of this Chapter, combustible roof coverings and r( insulation may be used in any type of construction. Skylights shall be constructed as required in Chapter 24. Section 31 02.3.8 of the Unifa Building Code is amended to read: All chimneys attached to any appliance or fireplace that burns solid fuel shall equipped with an approved spark arrester. The net free area of the spark arrester shall be I less than four times the net free area of the outlet of the chimney. The spark. arrester scrc shall have heat and corrosion resistance equivalent to 12 gauge wire, 19 gauge galvaniz wire or 24 gauge stainless steel. Openings shall not permit the passage of spheres havin diameter larger than 1/2-inch and shall not block the passage of spheres having a diamc of less than 3/8-inch. 18.04.260 Section 904.2 amended -Automatic Fire Extinguishing Systems. Section 901 of the Uniform Building Code is amended to add: 904.2.1 .l. Such automatic sprinkler systems shall not considered as the basis for increasing the allowable area of a building or for exemption frc any other Uniform Building Code requirement. Residential or quick-response standard sprinkler heads shall be installed in the dwell units and guest room portions of the building. 18.04.31 0 Violations. Any person or corporation who violates any of the provisions this Code or this Chapter is guilty of an infraction, except for the fourth and each additio violation of a provision within one year, which shall be a misdemeanor. NS-334 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA,AMENDINGTlTLE 18,CHAPTER18.16, BYTHEAMENDMENT OF THE CARLSBAD MUNICIPAL CODE TO ADOPT BY REFERENCE THE OF SECTIONS 18,16,010, 18,16.070, 18,16,120,18,16~130 AND 18,16,160 UNIFORM PLUMBINC CODE (1994 EDITION). The City Council of the City of Carlsbad, California, does ordain as follows: SECTION 1: That Title 18, Chapter 18.1 6 of the Carlsbad Municipal Code is amend by the amendment of Sections 18.1 6.01 0, 18.1 6.070, 18.1 6.1 20 and 18.1 6.1 30 to read follows: 18.1 6.010 Adopted. The 1994 Edition of the Uniform Plumbing Code, copyrighr by the International Association of Plumbing and Mechanical Officials, is adopted reference as the plumbing code of the City, except for the changes, additions, a amendments set forth in this chapter, which shall supersede the provisions of said code. 18.1 6.070 Section 402.3 added i Ultra Low Fiush Toilets. Section 402.3 is added the Uniform Plumbing Code to read: Effective November 3, 1991 , only tank-type water closets that use an average of ‘ gallons of water per flush or less and urinals and associated flushometer valves that use average of one gallon of water per flush or less shall be installed in new construction. tank-type water closets, urinals and associated flushometer valves shall be approved by 1 Building Official as meeting adequate standards of safety and sanitation. The provision: this Section shall apply to existing buildings only when toilets are being replaced in exist bathrooms or installed in new bathrooms. Exceptions: The Building Official may allow the use of standard flush toilets or urir when, in the opinion of the Building Official, the configuration of the building drain; system requires a greater quantity of water to ‘adequately flush the system. The requirements for the maximum flush rate of 1.6 gallons per flush may suspended for a specified period of time by a resolution adopted by the City Council uy a finding by the Building Official that there is an inadequate supply of water closets or urir specified in this Section to satisfy the needs of new construction. Further, when unreasonable hardship can be demonstrated by an applicant the Building Official may gr an exemption to the requirements of this Section. The basis for the finding of unreasonable hardship shall be documented and kept v the building file. Fixtures installed in mobile homes approved by the State of California are exempt fl the requirements of this Section. Section 102.3.1 of the Unifo Plumbing Code is amended to read: Any person or corporation who violates any of the provisions of this chapter is gui of an infraction except for the fourth or each additional violation of a provision within o year which shall be a misdemeanor. Penalties for a violation of this chapter shall be designated in Section 1.08.010 of this code. 18.16.130 Section 103.4.1 amended - Permit Fees. Section 103.4.1 of the Unifo Plumbing Code is amended to read: (a) Permit Fees. Every applicant for a permit to do work regulated by this code shall state in writing l the application form provided for that purpose the character of work proposed to be done a such information pertinent thereto as may be required. Such applicant shall pay for ea permit issued at the time of issuance a fee in accordance ,with the following schedule and the rate provided for each classification shown herein. Any person who commences any work for which a permit is required by this cot without first having obtained a permit therefor shall, if subsequently permitted to obtain permit, pay double the permit fee fixed by this section for such work. This provision shi not apply to emergency work when it is proved to the satisfaction of the Administrati. Authority that such work was urgently necessary and that it was not practical to obtain permit therefor before the commencement of the work. In all such cases a permit must t: obtained as soon as it is practical to do so, and if there is an unreasonable delay in obtainir such permit, a double fee shall be charged. For the purpose of this section a sanitary plumbing outlet on or to which a plumbir fixture or appliance may be set or attached shall be construed to be a fixture.
