RECOMMENDED ACTION:
Adopt Resolution No. “10 - 5 7 rnodrfying Agreement No. 11-8156 with the State of
Department of Transportation, District 11 (Caltrans) for maintenance of City-owned tre
systems.
ITEM BPLANATION:
City Council approved Agreement No. 1 1-81 56 with Caltrans for maintenance of City-ow
signal systems on November 6,1990. The agreement was subsequently modified in 1993
two additional intersections along Palomar Airport Road, added as a result of the incree
volumes after completion of the Price Club and Palomar Airport Road/l-5 Bridge Widenir
Caltrans agreed to perform necessary maintenance on City signals in order to better mar
flow on City corridors in close proximity to freeway ramps.
Poinsettia Avenue is currently undergoing a widening project similar to that of Palomar Air,
The La Costa Avenue widening is scheduled to follow. Upon completion of these two pro
anticipates the need for these and future intersections to be added to the agreement. I
recent economic constraints placed upon the State of California and the City of Carlsbac
concerns that neither agency is adequately prepared to accept full maintenance respons
these intersections. Therefore, a modification to the existing agreement is proposed.
Under the modified agreement, Caltrans will be responsible for maintenance of all compon
the confines of the signal controller cabinet as well as all controller assembly functions, a1
will maintain all field appurtenances. Caltrans will perform routine inspections of the inters
notify the City whenever a fautt is found. At that time, City electrical staff would either re!
make necessary repairs or contact our signal maintenance contractor.
Staff believes these modifications best serve both the City and Caltrans by providing low
quality maintenance without overburdening the staff of either agency. The future will t
traffic, signalized intersections, and more congestion. By making these agreement adjustr
we can ensure continued inter-agency cooperation, thereby providing the best possible
for future traffic problems.
FISCAL IMPACT:
Due to the redistribution of work between City and Cattrans staff, the proposed amendr
anticipated to increase the current contract. Sufficient funds are available in the Trz
Maintenance Account to handle the proposed amendment to the agreement.

A RESOLUTION OF THE CITY COUNCIL OF THE CIN OF CARLSE CALIFORNIA, APPROVING AMENDED AGREEMENT NO. 11-8156 WITHm STATE OF CALIFORNIA FOR MAINTENANCE OF CITY-OWNED TRAl
SIGNAL CONTROLLER ASSEMBLIES ONLY
WHEREAS, the City of Carlsbad, hereinafter referred to as "CW has
agreement for maintenance of City-owned traffic signal systems in close proximit)
ramp signals with the State of California, Department of Transportation, District 11
referred to as 'Cattrans'; and,
WHEREAS, the City and Cattrans mutually agree that both parties are setvw
modification of this agreement; and,
WHEREAS, the fiscal impact to the City resutting from these changes is ex1
minimal.
NOW, THEREFORE, BE IT RESOLVED, by the C'Ry Council of the City of

WORK FOR OTHERS AGREEMENT
WITH CITY OF CARLSBAD
The CITY of Carlsbad, a municipal corporation of the State of California, ht
referred to as "CITY," and the State of California, Department of Transportatior
11 , hereinafter referred to as "STATE," do enter into the following agreemen.
WHEREAS, CITY pursuant to Section 131 of the Streets and Highways (
requested STATE to maintain traffic control signal systems on the City Street S
shown on Exhibit "A" attached hereto, and by this reference made a part herc
WHEREAS, STATE does have qualified personnel available to perfc
maintenance of said traffic control signal systems within the CITY; and
WHEREAS, STATE and CITY will mutually benefit from said rnainter
providing safety to the traveling public; and
WHEREAS, CITY and STATE do mutually desire to cooperate and to speci
the conditions and the maintenance to be done:
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
SECTION I
For and in consideration of the covenants and conditions to be kept and pr
by STATE as set forth herein, CITY agrees:
(a) That the degree or extent of maintenance work to be performed

from any and all liability for injuries to persons or damage to propel
or resulting in any manner from STATE'S performance under this A!
excepting for injuries to person or damage to property caused 01
from the sole negligence or willful misconduct of STATE, its officer
and employees.
SECTION II
For and in consideration of the covenants and conditions to be kept and
by CITY as set forth herein, STATE agrees:
(a) To maintain traffic control signal systems at locations shown in I
in accordance with the provisions of Section 27 of the Streets anc
Code when requested by CITY. STATE maintenance will be

(b) To bill CITY monthly for actual costs required to maintain said tra
signal systems, including assessments for indirect charges to I
