RECOMMENDED ACTION:
It is alleged that a public nuisance exists at 3286 Highland Drive within the City
on the lot identified as APN 205-060-04-00. It is recommended that the Cou
Resolution No. % -6.6 declaring the conditions which exist on the prop(
nuisance and ordering the abatement thereof.
ITEM EXPLANATION:
The purpose of this item is for the City Council to hear any evidence or objec
whether the property identified as 3286 Highland Drive, APN 205-060-04-00,
The property is an older house on a lot of approximately fourteen thousand squai
property is owned by Mrs Audrey 6. Miller. Mrs Miller is being taken care of by
Dan Mc Clure. The lot is littered with rubbish, debris, junk, house hold waste, wc
excess of sixteen vehicles. Some of the vehicles are operational howeve
inoperable. In addition several transients visit or live in the vehicles on the prog
Section 6.16.01 0 of the Carlsbad Municipal Code defines a public nuisance as:
The existence of real property within the City:
(1) In a condition which is adverse or detrimental to public peace, health, Si
general welfare; or
(2) Which is maintained so as to permit the same to become so defective, un
dangerous or in a condition of deterioration or disrepair so that the same will,
cause harm to persons, or which will be materially detrimental to pror
improvements located in the immediate vicinity of such real property; is dec

The property owner's have refused to maintain the property cleared of rubbish, c
house hold waste, weeds and inoperable vehicles. This promotes blight and de
tends to reduce the property values of private property, and invites plundering.
Numerous attempts to have the property owner remove vehicles and clear debr o\\D \m

FISCAL IMPACT:
The property owner(s) are financially responsible for abating the public nuisance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA DECLARING A PUBLIC NUISANCE AT 3286 HIGHLAND DRIVE, APN 205-060- 04-00.
WHEREAS, the City Council at their meeting of
1996 held a duly noticed public hearing and considered all
and testimony of anyone desiring to be heard; and
WHEREAS, the property is littered with rubbish,
junk, household waste, weeds, and in excess of sixteen r
most of which are inoperable; and
WHEREAS, the time limits imposed in a Notice and
the City's Code Enforcement Officer have expired; and
WHEREAS, the property is in a condition which i!

ORDER TO REMOVE
PLEASE TAKE NOTICE: As the owner or occupant of the property located at .
Highland Drive, you are hereby notified that you are in violation of Carlsbad Munic
Code, Section 10.52, for the storage of abandoned, wrecked, dismantled or inoperi
vehicles; and Section 6.12, for the accumulation of junk in the yard. Copies of t
municipal code sections were attached to a letter sent to you on September 12, 1995.
You are hereby ordered to be in full compliance with the provisions of Carlsbad Munic
Code no later than October 29, 1995. To be in full compliance you shall remove
miscellaneous junk from the premises and remove the vehicles, or store them in accord
with the above referenced code. This matter will be referred to the City Attorney's o
for legal action if you fail to comply by the above referenced date.

ORDER TO REMOVE
PLEASE TAKE NOTICE: As the owner of the property located at 3726 Highland Drive, Carl
California, you are hereby notified that you are in violation of the following Carlsbad Munic
