PLN %ky SP 19(H) RECOMMENDED ACTION: That the City Council direct the City Attorney to prepare documents DENYING the Appeal and UPHOLDING the Planning Commission’s DENIAL of SP 19(H). ITEM EXPLANATION This specific plan amendment proposes to alter existing development standards for one particular lot (Lot 1) within the Car Country Specific Plan as shown on the attached Location Map. The applicant, Toyota Carlsbad, is currently located on the adjacent lot to the west of the site on the southeast corner of Cannon Road and Paseo del None. An expansion of Toyota Carlsbad is proposed for Lot 1 (which is an allowed use for the site per the specific plan) via the current processing of a site development plan (SDP 95-08) which is designed to comply with existing specific plan standards for the site. However, this specific plan amendment proposes to alter two standards applicable to this lot: (1) create an allowance for access from/to Cannon Road, and (2) reduce the required (and existing) landscaped setback area along Cannon Road from 25 to 10 feet. As more fully discussed in the staff report dated January 17, 1996, and as reflected in the excerpts of the Planning Commission minutes dated January 17, 1996 (both attached) staff could not support these requests due to conflicts with the City’s General Plan. The Circulation Element of the General Plan establishes policy regarding prohibiting access to major arterials (Cannon Road) for individual lots (such as the subject site, Lot 1) and is implemented by the City’s Engineering Standards with regards to intersection spacing. The Circulation Element also contains Scenic Corridor Guidelines which designate Cannon Road as a Community Scenic Corridor, and establishes policy to maintain and preserve natural and manmade landscapes and environments. This policy objective is implemented by the specific plan standard of a 25 foot landscaped setback adjacent to Cannon road. At the Planning Commission meeting of January 17, 1996, the Planning Commission considered SP 19(H) and SDP 95-08. The Commission voted 5-2 (Commissioners Erwin and Nielsen were the dissenting votes) to uphold staff’s recommendation to deny the specific plan amendment. The applicant requested, and was granted, the ability to return to the Commission with a revised site development plan which complies with all existing specific plan criteria and does not implement the development standard alterations covered by SP 19(H). On January 25, 1996, the applicant appealed the Planning Commission denial of SP 19(H). Based on the analysis contained in the attached staff report as summarized above, both staff and the Planning Commission recommend that the City Council uphold the Planning Commission denial of Specific Plan Amendment SP 19(H). i PAGE 2 OF AGENDA BILL NO d3+w ENVIRONMENTAL REVIEW As discussed above, since the project can not be supported at the staff level (General Plan conflicts), environmental review initiation was not required as allowed by statutory exemptions (Statutory Exemption 15270 (a) and (b)) per the California Environmental Quality Act (CEQA). FISCAL IMPACT Denial of the specific plan amendment would not preclude development of the site with the allowed use of an automobile sales dealership. The specific plan amendment proposal to allow Cannon Road access to the subject site, Lot 1 of the Car Country Expansion specific plan area, cannot be supported because direct access to major arterials is not consistent with policy established by the Circulation Element (Implementing Policy C.4 and Table 1: Street Classifications) of the City’s General Plan. Adequate access for the subject site exists via the existing Auto Center Court roadway located at the southeast area of the site. Access to Lot 1 is also provided internally with the Toyota owned and operated site adjacent to the west of the subject site, at the southeast comer of Paseo de1 Norte and Cannon Road. Lot 1 was originally subdivided and designed to adequately function without an access to Cannon Road. In addition, the specific plan amendment request for Cannon Road access cannot be supported because it violates Engineering Standards (Table A) which implement General Plan policy, regarding intersection spacing. The proposed access is 600 feet from the Paseo de1 Norte intersection to the west and 600 feet from the Car Country Drive intersection to the east. Required intersection spacing on major arterials is 1200 feet. 2. The specific plan amendment proposal to reduce existing and required landscaping along Cannon Road cannot be supported because it would be inconsistent with the objectives of the City’s Scenic Corridor Guidelines which designates Cannon Road as a Community Scenic Corridor. The Scenic Corridor Guidelines have been incorporated by reference into the Circulation Element for implementation and therefore are part of the General Plan. Implementation policy C.6 calls for the enhancement and preservation of the natural and developed environments along each designated scenic route. Reduction of landscaping in general would be inconsistent with this policy and in turn, the General Plan. Specifically, the reduction of the existing 25 foot landscaped setback area to 10 feet to allow a continuous row of new cars parked/displayed in the same area is not consistent with the objective of providing a substantial landscaped amenity to this major arterial. 3. As allowed by Statutory Exemption 15270 (a) and (b) of CEQA (California Environmental Quality Act), the CEQA environmental review process does not apply to projects which a public agency disapproves or rejects. Environmental review is not required for this project’s denial recommendation because the above referenced exemption allows for an initial screening of projects on the merits for quick disapprovals prior to the initiation of the CEQA process. AGENDA OF: JANUARY 17, 1996 Project Planner: Eric Munoz Project Engineer: Jim Davis SUBJECT: SP 19(H)/SDP 95-08 - TOYOTA CARLSBAD EXPANSION - Request for a specific plan amendment and site development plan to allow the expansion of the Toyota Carlsbad automobile dealership. A site development plan is required by the Car Country specific plan for the development of the site. A specific plan amendment is requested to alter development standards of the subject property which is generally located on the south side of Cannon Road, east of Paseo de1 Norte in the C-2-Q Zone within Car Country Expansion Specific Plan area, in the Coastal Zone, within Local Facilities Management Zone 3. I. RECOMMENDATION That the Planning Commission ADOPT Planning Commission Resolutions No. 3889 and 3890, DENYING Specific Plan Amendment SP 19(H) and Site Development Plan SDP 95 08, respectively, based on the findings contained therein. II. INTRODUCTION The subject site is Lot 1 of the Car Country Expansion Specific Plan area as shown on the attached Location Map. The project involves the expansion of the Toyota Carlsbad automobile dealership located on the lot immediately adjacent to the west of the subject site. The existing specific plan for the site requires the processing of a site development plan (SDP 95-08) and establishes certain development standards and criteria for this site. Two of the standards specific to this site are the subject of the proposed specific plan amendment: (1) direct access to Cannon Road is currently prohibited for this lot, and (2) a landscaped setback along Cannon Road is existing and required. The proposed specific plan amendment (SP 19-H) would allow a right in/right out access onto Cannon Road and reduce the landscaped setback requirement along Cannon Road from 25 to 10 feet. Staff recommends denial of the project as proposed because it would be inconsistent with the City’s General Plan. III. PROJECT DESCRIPTION AND BACKGROUND The applicant is proposing a use (automobile sales/operations) for the site which is acceptable and allowed by the governing Car Country Expansion Specific Plan SP 19(E). SP lS(H)/SDP 95-08 - TuYOTA CARLSBAD EXPANSION January 17, 1996 Pacle 2 SDP 95-08 would be an acceptable project in general terms with regards to the use, site design, provision of required amenities and compliance with applicable standards, with the two exceptions outlined above. With very minor and non-significant revisions to the project, SDP 95-09 could be supported by staff if Cannon Road access was not proposed and the landscaped setback is maintained at 25 feet. Given the Cannon Road access and reduction in landscaping proposal, a specific plan amendment is required to propose the modification of existing standards. SP 19(H) proposes specific plan text and graphics changes to implement the above described standard modifications applicable to the subject site. The project and site design details are generally acceptable as stated above, however, within the context of the two components of the proposed specific plan amendment, cannot be supported. Eliminating the specific plan amendment from the current proposal would allow staff to support development of the site. However, if the Commission concurs with the denial of the Specific Plan amendment, the Site Development Plan would need to be returned to staff for minor redesign, the environmental review process, and other entitlement processing details. Conversely, if the Commission supports the Specific Plan amendments in concept and Council agrees, then the project would still need to be returned to staff to complete the required processing steps, including environmental review, and a Local Coastal Program amendment. Normally, staff would not schedule a project for hearing which has not been thoroughly reviewed and processed according to city and state requirements. The applicant, however, has requested early resolution of the issues relating to the Specific Plan amendment. The analysis for this project, therefore, centers on the inability of staff to support the Specific Plan amendment portion of the project. The proposed project is reflected on project exhibits, Exhibits “A” - “II”. Iv. ANALYSIS The project is subject to the following analysis and/or regulations: A. Is the proposed specific plan amendment regarding Cannon Road access and a reduction/elimination of a 25 foot landscaped setback along Cannon Road consistent with the City’s General Plan, specifically the Circulation Element of the General Plan? B. Can the findings for a Site Development Plan pursuant to Section 21.06.020 of the City’s Zoning Ordinance be made? Specifically, (1) that the requested use is properly related to the site, surroundings and environmental settings, consistent with the various elements and objectives of the general plan, not detrimental to existing uses or to uses specifically permitted in the area in which the proposed use is to be located, and will not adversely impact the site, surroundings or traffic circulation; ’ SP lS(H)/SDP 9508 - ruYOTA CARLSBAD EXPANSION January 17, 1996 Page 3 (2) that the site for the intended use is adequate in size and shape to accommodate the use; (3) that all of the yards, setbacks, walls, fences, landscaping, and other features necessary to adjust the requested use to existing and permitted future uses in the neighborhood be provided and maintained; and (4) that the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use. A. General Plan Consistency The proposal for Cannon Road access is inconsistent with the Circulation Element of the City’s General Plan which establishes the policy to prohibit direct access to major arterials for lots that do have another access point (Implementing Policy C.4 and Table 1: Street Classification of the Circulation Element). Policy C.4 requires the number of access points to major and prime arterials to be minimized to enhance the functioning of these streets as throughways. To implement this General Plan policy, the City engineering standards contain a provision for intersection spacing of 1200 feet on major arterials. In this project’s case, an internal street (Auto Center Court) providing another access point and serves the lot from the south. In addition, access is also possible/proposed via internal reciprocal access between the subject lot and the existing comer lot serving Toyota Carlsbad’s current operations. Since the subject lot does not solely depend on Cannon Road access to adequately operate, and in fact was designed to not have direct access to this major arterial, the proposed Cannon Road access and this component of the specific plan amendment would not be consistent with the City’s General Plan. The Circulation Element of the General Plan also addresses scenic roadways in the City via the incorporation of the Scenic Corridor Guidelines which designates Cannon Road as a Community Scenic Corridor. One of the pertinent implementation policies of the Circulation Element (C.6) calls for the enhancement and preservation of the natural and developed environments along each designated scenic route. The elimination and reduction of required and existing landscaping along a landscaped setback area adjacent to Cannon Road would be inconsistent with the General Plan. Planning Commission Resolution No. 3889 contains the findings for the denial of specific plan amendment, SP 19(H). Attached to that resolution is Exhibit “X” which contains the proposed specific plan text and graphic changes to implement the two above described components of the proposed specific plan changes. B. Site Development Plan findings Although the proposed use and overall site design is properly related to the site, and physical surroundings, the Cannon Road access component of the proposal conflicts with the policies of the General Plan’s Circulation Element. Therefore, it is possible that there will be detrimental effects to existing or future permitted uses caused by adverse traffic impacts If SP lS(H)/SDP 95-08 - fuYOTA CARLSBAD EXPANSION January 17, 1996 Paae 4 to the site, surroundings and traffic circulation. The subject site was created and designed to function without Cannon Road access. In addition, the proposed access to Cannon Road violates intersection spacing requirements per City Standards which implement policies of the Circulation Element. The proposed access is approximately 600 feet from the Paseo de1 Norte intersection to the west and approximately 600 feet from the Car Country Drive intersection to the east. The required intersection spacing on a major arterial is 1200 feet. In general terms, the site is adequate in size and shape to accommodate the proposed use, however, the Cannon Road access does not meet General Plan policy for major arterials and violates the City’s Engineering Standard regarding intersection spacing standard. Therefore, traffic patterns may be adversely impacted both onsite as well as to Cannon Road. All features necessary to adjust the requested use to existing or permitted future uses in the area will not be provided and maintained given the proposal to reduce the existing/required 25 foot landscaped setback along Cannon Road to 10 feet. As described above under General Plan Consistency, reduction/elimination of the Cannon Road landscaping to a 10 setback would be inconsistent with the General Plan. In addition, the enhanced visual quality that is intended to accompany the development of the Cannon Road corridor would be significantly diluted. Reduced landscaping would detract from the visual and “gateway” statement this roadway segment represents as it leads into developing portions of the City. The street system serving the proposed use cannot be considered adequate to properly handle all traffic generated by the use since non-standard intersection spacing is proposed as well as access onto a major arterial; both of which are inconsistent with established policy and standards for this class of roadway in the City. Planning Commission Resolution No. 3890 contains the findings to deny the site development plan, SDP 95-08 for the project as proposed. V. ENVIRONMENTAL REVIEW As discussed in the analysis above, the project cannot be supported as proposed since it would be inconsistent with the City’s General Plan. As such, staff cannot recommend approval. The California Environmental Quality Act (CEQA) provides a statutory exemption for such projects that cannot be supported and are being processed for a quick denial. Statutory Exemption 15270 (a) and (b) allow the project to be taken to decision makers without initiating the CEQA process. Should an approval decision become desired by the decision makers (Planning Commission or Council on appeal) the project would have to return to staff for final review and to accommodate entitlement processing requirements including the processing of a Local Coastal Program amendment as well as environmental review consistent with the provisions of CEQA. SP lQ(H)/SDP 95-08 - TOYOTA CARLSBAD EXPANSION - Request for a specific plan amendment and site development plan to allow the expansion of the Toyota Carlsbad automobile dealership. A site development plan is required by the Car Country specific plan for the development of the site. A specific plan amendment is requested to alter development standards of the subject property which is generally located on the south side of Cannon Road, east of Paseo del Norte in the C-2-Q Zone within Car Country Expansion Specific Plan area, in the Coastal Zone, within Local Facilities Management Zone 3. Chairman Compas advised the public that the Planning Commission’s decision tonight is final unless appealed to the City Council within ten calendar days. Eric Munoz, Associate Planner, reviewed the background of the request and showed slides of the proposed project and site. He stated that the project involves the expansion of the Toyota Carlsbad automobile dealership located on the lot immediately adjacent to the west of the subject site. The existing specific plan for the site requires the processing of a site development plan and establishes certain development standards and criteria for the site. Two of the standards specific to the site are the subject of the proposed specific plan amendment: (1) direct access to Cannon Road is currently prohibited for this lot, and (2) a landscaped setback along Cannon Road is existing and required. The proposed specific plan amendment would allow a right in/right out access onto Cannon Road and reduce the landscaped setback requirement along Cannon Road from 25 to 10 ft. Mr. Munoz explained that the site was denied access to Cannon Road in their original specific plan. He noted that the curb cut for We&oh Chevrolet on Cannon Road occurred in 1980, seven years before the expansion plan was approved, and that it is a rtght in only. He also noted that granting the Weseloh curb cut on Cannon Road was a Planning Commission action which over-turned a staff recommendation to not allow Cannon Road access. He noted that the proposed driveway for Toyota Carl&ad would be 700 ft. fron the nearest intersection, which is below the engineering standard of 1200 ft. PLANNING COMMISSION January 17, 1996 Page 5 and that the rear yard landscape along Cannon Road is close to mature. He discussed the critical dates for Car Country and noted that the original specific plan was approved in 1972; in 1980 Weseloh Chevrolet created the driveway on Cannon Road; in 1987 the Car Country expansion plan was approved. In 1988 Cannon Road was designated as a scenic corridor; and in 1995 the scenic corridor designation was incorporated into the general plan. Staff recommends denial of the project as proposed because it would be inconsistent with the City’s general plan. Mr. Munoz noted a typographical error on page 4, last paragraph, of the staff report. ‘CERA’ should correctly read ‘CEQA.” On Exhibit ‘x” of Resolution No. 3889, the bottom sentence should correctly read “Amends p. 6 of existing Car Country Expansion Specific Plan.” These corrections will be made by staff on the appropriate documents. Commissioner Erwin is concerned about the proposed driveway. Cannon Road will have two through lanes and it looks to him as though any traffic turning in or out would have to turn in or out of a through lane. Mr. Wojcik replied that is correct. Commissioner EMlin assumes there will not be a third turn lane. Mr. Wojcik replied that is correct. Commissioner Monroy inquired if staff could estimate the traffic volumes when Car&bad Ranch is completed. Mr. Wojcik replied that in the year 2000, Cannon Road will carry 1300 vehicles per hour, or one car every 2.8 seconds. The current traffic is just a fraction of that amount. Commissioner Nielsen inquired if there have been any accidents as a result of the Weseloh driveway on Cannon Road. Mr. Wojcik replied that there have been no significant accidents reported. However, he noted that it is probably because of the low traffic volumes. The traffic engineer adamantly opposes adding other driveways to major arterials like Cannon Road due to the increased traffic which will be occurring. Commissioner Nielsen inquired if there will be traffic signals on Cannon Road. Mr. Wojcik replied that there will be two, a signal at Paseo del None and also at Armada Drive. Commissioner Nielsen inquired when 20,000 ADT will be achieved. Mr. Wojcik replied sometime between 2000 and 2010. Commissioner Welshons inquired if there will also be a signal at Car Country Drive. Mr. Wojcik replied yes. Commissioner Monroy inquired if there will be bike lanes on Cannon Road. Mr. Wojcik replied yes. Chairman Compas invited the applicant to speak. Jim Kelly Markham, 244 Ninth Street, Del Mar, addressed the Commission and stated that he is the architect on the project. He emphasized that staff supports the project for the site development plan without the two amendments being proposed in the specific plan. He introduced Mr. Lou Jones, owner of Toyota Carlsbad and Lexus Cadsbad. Lou Jones, 5124 Paseo del Norte, Carlsbad, addressed the Commission and stated that he has been doing business in Car Country since 1977. His two dealerships (combined) currently generate approximately $3 million annually in tax revenues. Location, visibility, and access are the three most important things when it wmes to an automobile dealership. He is requesting the same type of visibility and access as every other dealership in Car Country. A denial of his amendment would create a hardship on his business. Commissioner Erwin inquired if he was aware of these restrictions before processing the amendment. Mr. Jones replied yes, but he did not feel the request was unreasonable. Staff anticipated that Cannon Road would be the rear of his property. He would like it to be the front of the dealership. PLANNING COMMISSION January 17,1998 Page 6 Mr. Markham returned to the podium to complete his presentation. He stated that Toyota Carlsbad has proposed to remove the driveway when the ADT reaches 20,000 vehicles. He reviewed the plans for the dealership expansion, the circulation element, and plans to modify and reduce the landscaped area on Cannon Road to accommodate the driveway. Commissioner Noble inquired who will absorb the extra cost of removing the curb cut when the ADT reaches 20,000. Mr. Markham replied that this will be in 10-15 years. They would like to have a visible business during that period of time. He does not think that is unreasonable. The dealership has no problem absorbing the costs of removing the curb cut and recreating the landscape if they can conduct business during that period. Commissioner Noble stated that Carlsbad has always been very strict in upholding their standards. We like to plan for the future. Mr. Markham replied that he would accept a condition to remove the driveway and replant the landscape. Commissioner Savary inquired why the dealership wants that extra space. Mr. Markham replied that the business is booming. Extra area is needed for sales and dealer prep areas. Commissioner Welshons inquired if they are making the proposed building face Cannon Road with the idea that in S-10 years the access will be eliminated. Mr. Markham replied that they decided to do this because having the entrance on a culde-sac would not be visible to motorists. Commissioner Welshons inquired how they plan to change the front of the building to the cul-de-sac once the access is eliminated. Mr. Markham replied that they will not change it. Customers will gain access from Paseo del Norte through the existing business. Commissioner Monroy inquired what would be done to the slope so they can maintain the visibility of cars on Cannon Road. Mr. Markham replied that the grade is only 2-3 ft. The cars will sit 18 inches above the sidewalk. Commissioner Nielsen inquired if they will continue to use the area as a used car facility. Mr. Jones replied from his seat that they would display used cars on Cannon Road. There will also be new trucks on that lot. Chairman Compas opened the public testimony and issued the invitation to speak. Richard Apel, 5600 Avenida Enctnas #130, Cartsbad, representing LEG0 Park Planning, addressed the Commission and stated that they support existing uses in the specific plan. However, they are concerned about the proposed landscape reduction on Cannon Road and the possibility of a curb cut for this project. LEG0 would like to preserve the scenic quality and 25 ft. setbacks along Cannon Road. They therefore support the staff recommendation. There being no other persons desiring to address the Commission on this topic, Chairman Compas declared the public testimony closed and opened the item for discussion among the Commission members. Commissioner Erwin supports the staff position in maintaining the 25 ft. setback. He thinks that is important, although he could support a right turn in and out with a condition that when the traffic increases to 20,000 ADT it would be eliminated and landscape put back in its place. He woutd like a requirement for some type of financial performance bond to ensure their performance. He thinks the business might need a jump start. Commissioner Savary supports the staff recommendation because it has been clearly stated from the beginning. She thinks the dealership should plan for the future and do it correctly now. Having an extra driveway would cause acceleration/deceleration issues. She thinks there are other options available for attracting attention. Perhaps they could use the existing comer. She does not think it is feasible to change the entrance down the road. She also likes the landscaping which is there now. Commissioner Noble agrees with Commissioners Savary and Welshons. He supports Car Country by giving them #I& their business but he thinks the dealership needs to devise a way to direct customers to the cul-de-sac entrance. He supports the staff recommendation. Commissioner Monroy is concerned because of the bike lane. It could cause a liability issue for the City. He thinks we should also go back to Weseloh and ask them to give up their driveway on Cannon Road. It is dangerous. He thinks they should be willing to do it as a good neighbor gesture. Commissioner Nielsen agrees with Commissioner Erwin. It is interesting that we make concessions for residential developers but we don’t want to do it for a business that brings in tax revenues. He agrees with the applicant since they have agreed to removing the curb cut at their own expense. He cannot agree with reducing the 25 ft. setback along the scenic wnidor. Chairman Compas inquired if access is allowed and a serious accident occurs, would the City be liable. Mr. Rudolf replied that if a traffic study indicated it is a safe situation, the City would have design immunity. Mr. Markham returned to the podium and requested a continuance, however the public testimony had been closed. Commissioner Savary made a motion, which was duly seconded, to adopt the staff recommendation and deny the project without prejudice. Commissioner Erwin inquired if the project is denied without prejudice, could the applicant bring it back immediately with changes. Mr. Rudolf replied that there is a provision for a one year bar on the resubmittal of applications if they are substantially similar. The Planning Director makes the determination of whether an application is substantially similar and allows or disallows it. If the Commission denies this project and the applicant resubmits the site development plan with tiat the staff believes the general plan and specific plan requires, the Planning Director would probably find that the new site development plan would not be substantially similar and could come back to the Planning Commission right away. The other alternative is to split the motion and only deal with the specific plan amendment. The applicant could then appeal the specific plan amendment denial and resubmit the site development plan. Chairman Compas reopened the public testimony for the beneffi of the applicant. Mr. Markham stated that he would prefer the second alternative because they would like to wme back as soon as possible to get the project underway. Chairman Compas reclosed the public testimony. Commissioner Savary withdrew her motion which was on the floor. RP 94-07(A)/CDP 94-08(A) - CARLSBAD BREWERY AND PUBLIC HOUSE GRAIN SILO The Design Review Board unanimously approved (5-O) a recommendation to the Housing and Redevelopment Commission to approve an amendment to major redevelopment permit 94-07 and Coastal Development Permit 94-08 to allow the installation of a Grain Silo on the site of the existing Carlsbad Brewery and Public House. This silo was approved with the following conditions: 1) height to be reduced to 21 feet; 2) no advertising or signage on the silo; 3) silo to be relocated 7 feet towards center of building to be less visible from Carlsbad Village Drive; 4) lattice work with landscaping to be added around bottom of silo to help provide additional screening of silo; and 5) the silo must be removed within 90 days if existing business ceases to operate for any reason. MURPHY/WILSON JOINT USE PARKING FACILITY The Design Review Board unanimously approved (5-O) revocation of a previous Planning Commission approval to allow joint use parking and a 15% parking reduction for the two existing commercial centers known as Murphy Old World Center and the Wilson Roosevelt Center located on the north side of Grand nc (4 s’ Avenue between Roosevelt Street and Madison Street. With revocation of the previous approval, each center will be required to individually comply with City parking requirements for uses existing or proposed in the centers. The Wilson Roosevelt Center will be able to meet its current parking requirement $ 1% 0 Y of 136 spaces on its site. However, the Old World Center does not meet its current on-site parking requirement of 71 spaces which will impact their ability to lease any space that is currently vacant such as the existing restaurant suite. OCEAN BLUFF AFFORDABLE HOUSING PROJECT The Housing Commission unanimously approved (8-O) a recommendation to the City Council to approve a 16 unit affordable apartment project to satisfy the affordable housing obligation of the project known as Ocean Bluff. The design of the project was complimented by various Commissioners. One Housing Commissioner (Sato) expressed concern regarding perceived segregation from other market rate units. 2. EMERALD RIDGE WEST AFFORDABLE HOUSING PROJECT The Housing Commission unanimously approved (8-O) a recommendation to the City Council to approve the proposal by MSP California to satisfy their affordable housing requirement through the provision of second dwelling units on at least 9 single family lots within the Emerald Ridge West project. Several Commissioners complimented the plan. Commissioners had some discussion on ongoing assurances that the project will provide covered parking for the second dwelling units and that these units will not be converted to other types of uses such as master bedrooms, etc. 3. 1996-97 HOME PROGRAM The Housing Commission unanimously approved (8-O) a recommendation to the City Council to approve funding allocations for the City of Carlsbad’s 1996-97 HOME Investment Partnership Program. The Commission recommended that 1) the Community Resource Center receive $13,400 for a Security Deposit Assistance Program; 2) the City of Carlsbad use $143,630 of the HOME funds for the Single Family Residential Rehabilitation Program; and 3) $17,670 be used for administration of the HOME program by the Housing and Redevelopment Department. 4. SECTION 8 FAMILY SELF-SUFFICIENCY PROGRAM The Commission received a report on the status of the Section 8 Family Self-Sufficiency Program. 5. AFFORDABLE HOUSING PROJECTS AND PROGRAMS The Commission received a report on the status of various affordable housing projects approved or proposed for the City and the other affordable housing programs being operated within the City. HOUSING COMMISSION POLICIES AND PROCEDURES The Housing Commission discussed the procedures used for taking the minutes for the Housing Commission meetings. No changes were proposed to the Policies and Procedures adopted by the Commission on July 29, 1993. At a later date, the Commission will discuss the procedures for distribution of the minutes, reports, etc. 7.
