RECOMMENDED ACTION:
Staff is recommending that the City Council introduce Ordinance No. NS-356 establi!
Carlsbad Municipal Code Chapter 8.1 0 to require owners of commercial establishmento
provide entertainment to secure an Entertainment License, amending Chapter 8.09 to re
Licensed Cabarets to abide by the regulations set forth in Chapter 8.10, and amending Ch
1.08 to add references to Chapters 8.09 and 8.10.
Staff is recommending adoption of Resolution No. 9l~- /do establishing the fee fo
Entertainment License.
ITEM EXPLANATION:
The City has received numerous complaints about excessive noise from residents and busine
adjacent to commercial establishments that provide musical entertainment or dancing for , patrons. The noise is generally from live bands or disc jockeys performing at bars, a1
cabarets. The City currently does not have a City ordinance that regulates the exterior r
levels of these establishments.
To control the exterior noise level from music, staff is proposing to require commc
establishments that serve alcoholic beverages and providing musical and/or sir
entertainment, in either live or recorded form, to secure an Entertainment License. A stan
condition of the License will be that the exterior noise level at such a licensed establishment ~
not exceed sixty-five (65) decibels after 1O:OO P.M.. The noise measurement will be takc
property line of the affected property. This exterior noise limit will also apply to Cabaret Dar
The threshold of 65 dB(A) is derived from the Non-Residential Exterior Noise Guide
contained in the Planning Department's Noise Guidelines Manual which addresses r
mitigation for new development to comply with the City's General Plan. This ordinance

FISCAL IMPACT:
The,annual Entertainment License Fee is proposed to be $200. This is consistent with the CUI
fee for a Cabaret License. Establishments providing entertainment will be required to renev
license annually. The fees will recover costs associated with the administration of the lice

WHEREAS, the City of Carlsbad has received numerous
complaints from neighbors of cabarets and drinking and dining
establishments that provide entertainment regarding excessive
noise; and
WHEREAS, the City does not currently regulate the exterior
noise levels of either cabarets or commercial establishments the

WHEREAS, excessive noise levels have been found to be
detrimental to the peaceful and quiet use and enjoyment of
residents adjacent to commercial establishments.
The City Council of the City of Carlsbad, California, does
ordain as follows:
SECTION I: That Title 1, Chapter 1.08, Section 1.08.020(a)
is amended to read:

Dear Business Owner,
On April 2, 1996 the City Council will be considering the adoption wf an ordinance that
establishes a requirement for an Entertainment Liccnse. This ordinance is being proposed in response to numerous citizens complaints regarding excessive noise generated by .
businesses that serve acoholic beverages and provide live or recorded music. Businesses
that Serve .aicoholic beverages and provide either live or recorded music will be required
to secure an Entertainment License unless that business already possesses a valid Cabaret
License. The License is proposed to cost $200 annually.
One of the major components of the Erttertainment License Ordinance and the change to
the Cabaret License regulations is to place a limit on the level of noise from these
establishments after 1O:OO p.m. It is proposed that the maximum noise level bet set at 65 decibels as measured at the property line of the affected party over a one hour period.
This is not a public hearing, /lowever all business owners are encoljragd to attend and
provide input regarding the impacts of this ordinance IO their business. The City Council
meets at 6:OO p.m. in the City Council Chambers located at 1200 Carlsbad ViIIage Drive.
