ITEM EXPLANATION The claimant is a former Police Reserve Officer in the Carlsbad Police Department. She functioned in that capacity from 1978 to 1991. She also worked as a Police dispatcher for the City, through Western Temporary Services, from 1987 to 1991. Ms. DeMary sustained several injuries during her time of service with the City. These injuries resulted in permanent physical restrictions. The terms and conditions of the proposed settlement are set forth in the Compromise and Release (Exhibit 2, on file in Risk Management). The terms and conditions were agreed upon by the attorney representing the claimant and the attorney representing the City, and have been approved by HCM Claim Management, the City’s Third Party Administrator. FISCAL IMPACT The total cost of the settlement is $83,000. There are sufficient funds available in the Workers’ Compensation Self-Insurance Fund to cover the cost of this settlement. That the above recitations are true and correct. That the expenditure of $83,000 from the Workers Compensation Self- Insurance Fund is authorized for the settlement of said claims.
